WITHIN THE PRELIMINARY PLAT OF AUBURN 400, WITHIN THE CITY OF AUBURN, WASHINGTON,{DESGRiBED IN'SECTION 2 OF THIS ORDINANCE; CREATING 6 AND ESTABLISHING-LOCAL• IMPROVENIENT DISTRICT N0. 327; PROVIDING.THE METHOD OF ASSESSMENT IN SAID DISTRICT AND THE MODE OF PAYMENT THEREOF, AND , ry j • CREATING+A'LOCAL'IMPROVEMENT FUND THEREFOR. " 8 . • g WHEREAS, a petition has been filed with the City Council of the City of 10 Auburn, si,gned by the owners of the property aggregating a majority (1) of the 11 lineal fro.ntage upon the improvement and (2) of the area within the proposed 12 • district, setting forth the nature and territorial extent of the proposed 13 improvement, the mode of payment and what proportion of the lineal frontage , ' 14 upon the improvement and of the area within the proposed district is owned by 15 the petitionersas shown by the records in the~Office of the County Auditor 16 for King.Counfy, Washington, petitioning for the construction of improvements 17 to streets, sanitary sewers, street lighting, landscaping, sidewalks, water 18 lines, storm drainage system,.storm detention ponds, underground electrical 19 . power and other improvements permitted in RCW 35.43, on 17th Street S.W./15th 20 Street S.W., "I" Street S.W. and "0" Street S.W. within the preliminary plat 21 of Auburn 400, legally described in Section 2 of this Ordinance, inside the 22 corporate l.imits of the City of Auburn; and 23 WHEREAS, the City Engineer has caused an estimate to be made on the cost 24 and expense of the proposed.improvement and has certified said estimates to 25 the City Council, together with all papers and irlformation in his possession 26 touching the proposed improvements, a description of the boundaries of the 27 district, a statement of what portion of the costs and,expense of the improve- 28 ments should be borne by the property within the proposed district, a state- 29 ment in detail of any local improvement assessments outstanding and unpaid 30 against the property in the proposed district, and a statement,of the 31 ' 32 , Ordinance No. 3776 , Page One of Four , 6-28-82 1 . . 2 aggregate actual yaluation of the real. estate and the actual valuat.ion of the * 3 improvements i"n-therproposed district"according to the valuation last placed . 4 upon it for the pur.pose3of general tazation; and , . WHEREAS,'said'estimates are accompanied by a diagram of the proposed 5 6 improvements,showing thereon the lots;;tracts and parcels of land and other 7 property which will be especially benefited by the proposed improvements and 8 the estimated amount of the cost and expense thereof to be borne by each lot, 9 `tract and parcel of land or other property. 10 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON DO 11 ORDAIN AS FOLLOWS: 12 Section 1. Tfiat the property legally described in Section 2 of this , 13 Ordinance, situate inside the corporate limits of the City of Auburn, be 14 improved by the construction of improvements to streets, sanitary sewers, 15 street lighting, landscaping, sidewalks, water lines, storm drainage system, 16 storm detention ponds,.underground electrical power and other improvements i _ 17 Permitted in RCW.35.43, on 17th Street S.W:!15th Street S.W., "I" Street S.W. 18 and "0" Street S:W. within the preliminary plat of Auburn 400, all in accor- lg dance with plans and specifications prepared by the City Engineer and filed 20 witfi the City Clerk. 21 Section 2. That there is hereby created.and established a Local 22 Improvement District to be designated Local Improvement District No. 327, 23 which said district is le-gally described as follows, to-wit: 24 That portion of the NE 1/4 of Section 23, Township 21 N., Range 4, EWM, City of Auburn, King County, Washington, lying SEIy of SR 167 25 and lying Sly of SR 18 and lying Nly of llth Street SW; 26 TOGETHER WITH.that portion'of the SW 1/4 of Section 13, Township 21 N., Range 4, EWM; City of Auburn,:Ki,ng County, Washington, lying Sly 27 of SR 18 and lying Wly of the Seattle-Tacoma Interurban Railway (AKA the Puget Sound Power and Light Company Right-of-Way). 28 ALSO TOGETHER WITH that portion of the NW 1/4 of Section 24, Township 29 21 N., Range 4, EWM, City of Auburn; King County, Washington, lying Wly of the Seattle-Tacoma Interurban Railway (AKA the Puget Sound 30 Power and Light Company Right-of-Way) and lying Nly of,17th Street SW. 31 32 . Ordinance No. 3776 Page Two of Four, 6-28,82 , ~ ~ . . . . . . . i ..r. _ . 1 The individual assessments shall be in accordance with the assessment 2 ~district`boundary map'attached hereto and made' a part of this ordi- nance. 3 Section 3. That tHe estimated cost in carrying out the foregoing improve 4 ment is hereby declared to be as near as may be, the sum of $2,936,565.00. 5 Section 4. Applicable costs and expenses of all engineering, legal, 6~ inspection; advertising', publication and notices; and all'other expenses inci- 7 dent thereto, shall be,levied and assessed against all of the property legally $ and properly assessable therefor, as provided By the laws of the State of 9 Washington and the Ordinances of the Ci.ty of Auburn. 10 Section 5. That said improvements shall be made by the City of Auburn 11 under the supervision of the.City'Council. thereof or such committee or person 12 as the City Council may designate. 13 Section 6. Assessments or any portion thereof, may be paid at any time 14 : within thirty (30) days from the date of.the first publ:ication of•the Notice ' 15 . of Collection of such assessments without penalty, interest, or cost, and 16 thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal 17 . annual installments, with interest on the whole unpaid sum at the rate'of one 18 ' . . half (1/2) of one percent (i%) in excess of the net effective rate of the 19 Local Improvement District bonds. . 20 Commencing wi.th the first year after the last day, such assessments, or 21 any portion thereof, may be paid without penalty, interest or cost (thirty 22- , (30) days from the date of the first publication of the Treasurer's Notice of 23 , Collection of Assessments) and each year thereafter orie of said installments, • 24 together with the interest due, shall be collected as provided by law and the 25 Ordinances of the City of Auburn; assessments or installments of assessments 26 • not paid when due shall be delinquent and there shall be.added to the same a 27 penalty of twelve percent (12%) of the amount of the overdue installments and 28 interest, and such penalty sHall become a part of the lien upon the property 29 ; essessed. , 30 ; 31 Ordinance No. 3776 , 32 page Tfiree of Four 6-28-82, 7=19-82 (page 3& 4 only) i . Warrants shall.be drawn on said fund • 4•based on'estimates made by the City Engineer and approved by the City.ICounci.l :-5 in,payment of the cost of construction and installation of said improvements. , . . , . 6 Tn the alternative, the City hereafter may provide by Ordinance for.the 7 issuance of. other short term obligations.pursuant to Chapter 216, Laws of 81982.
