AN ORDINANCE OF THE CITY OF:AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION
3 AND INSTALLATION OF CURB AND GUTTER, ASPHALT PAVING, STORM DRAINAGE,
' STREET:iIGHTING AND SANITARY SEWER ON "E" STREET N.E. BETWEEN 16TH AND
4 18TH STREET N.E., DESCRIBED IN SECTION 2 OF THIS ORDINANCE; CREATING AND
. ESTABLISHING LOCAL IMPROVEMENT DISTRICT N0. 308; PROVIDING THE METHOD OF
5 ASSESSMENT IN SAID DISTRICT AND THE MODE OF PAYMENT THEREOF, AND CREATING
6 A LOCAL IMPROVEMENT FUND THEREFOR:

, 7 WHEREAS, a petition has been filed with the City Council of the City of.
$ Auburn, signed by the owners of the property aggregating a majority (1) of the
9 lineal frontage upon the improvement and (2) of the area within the proposed
10 district, setting forth the nature and territorial extent of the proposed 11 ;mprovement, the mode of payment and what proportion of the lineal frontage
12 upon the improvement and of the area within the proposed district is owned by
' 13, the petitioners ast shown by the records in the Office of the County Auditor'
14 for King County, Washington, petitioning for the construction and installation
15 of curb and gutter, asph'alt,paving, storm drainage, street lighting and
16 sanitary sewer on "E" Street N.F. between 16th and 18th Street N.E., legally
17 described in Section 2 of this Ordinance, inside the corporate limits of the
18 , City of Auburn; and

WHEREAS; the City,Engineer has~caused an estimate to be made•on the cost

' and expense.of the proposed;improvement and has certified said estimates to

the City Council; together with all'papers and information in his possession
22
touching the,proposed impr.ovements,"a description of the boundaries of the ;

, district, a statement of what portion of the costs and expense of the improve-
24 •
. ments should.be borne by the property within the proposed district, aI state=
25
ment in detail of any local improvement assessments outstanding and unpaid
26
against the property, in the proposed district, and a statement of the aggre-
27 .
gate actual valuation of the real estate and the actual valuation of tlie
28
improvements in the proposed district according to the valuat:ion last placed
29
upon it for the purpose of general taxation; and ~

WHEREAS,~said estimates are accompanied by a.diagram of the proposed

improvements showing thereon the lots, tracts and parcels of land and other

1 property which will be especially benefited by,the proposed improvements and
2 the estimated amount of the cost and expense thereof to be borne by each lot,
3 tract and parcel of land or other property.
4 . NOW, THEREfORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON DO
5 ORDAIN AS FOLLOWS: •
6 Section 1. That the property legally described in Section.2 of this 7 Ordinance, situate inside the corporate limits of the City of Auburn,.be
8 improved by the construction and installation of curb and gutter, asphalt
9 .
paving, storm drainage, street lighting and sanitary sewer on "E" Street N.E.
10 between.16th and 18th'Street N.F., all in accordance with plans and specifi- .

cations prepared by'the City Engineer and f.iled with the City'Clerk.
12 Section 2. That there is hereby created and established a Local
13 ImprovementrDistrict~~to be designated Local Improvement District No. 308,

Section 3. That the estimated cost in carrying out the foregoing improve-

ment is hereby declared to be as near as may be, the sum of $124,391.69. 32

1 Section 4. Applicable costs and expenses of all engineering, legal,
2 inspection, advertising, publication and notices, and all other expenses inci-
. 3 dent thereto, shall be levied and assessed against all of the property legally
• 4 and properly assessable therefor, as provided by the laws of the State of
5 Wasfiington and the Ordinances of the City of Auburn.
6 Section b. That said improvements shall be made by the City of Auburn
7 under the supervision of the City Council thereof or'such committee or person
8 as the City Council may designate. . 9 Section 6. Assessments or any portion thereof, may be paid at any time

11 of Collection of such assessments without penalty, interest, or cost, and

thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal
13 annual installments, with interest on the whole unpaid sum at the rate of one
14 •half (112) of one percent (1%) in excess of the net effectiverate of the
15
, Local Improvement.District bonds with the interest in no case being greater
16 •
than thirteen percerit (13%). ,

not paid when due sfiall be delinquent and there shall be added to.the same a

penalty of twelve percent (12%) of the amount of the overdue installments and

interest, and such penalty shall become a part of the lien upon the property
26 '
assessed.

' Section 7. That there is hereby created in the Office of the Finance '

Director for the City of Auburn, a fund of the City to be known as "Local
29 ,
Improvement District No. 308 Fund." Warrants'shall be drawn on said fund '

based on estimate"s made by the City Engineer and approved by the City Council
31 ,
in payment of the cost of,construction and installation of said improvements.

Section 8.The"Mayor is hereby authorized to implement such administra-
2 tive procedures as may be necessary to carry out the directions of this
Z legislation.`'' . . .
_4 Section.9. This Ord-inance shall take effect.and be in force five (5) days
5from and after its passage, approval and publication, as provided by law.
