AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR A CONDITIONAL 3 USE PERMIT ON PROPERTY ZONED:R-3 (DUPLEX).TO CONSTRUCT 7HREE FOURPLEXES
AND ONE TRIPLEX ON A PARCEL OF LAND 1.24 ACRES IN SIZE LYING ON THE
_ 4 SOUTHSIDE OF 37TH STREET S.E. EAST, OF "M" STREET S.E. FXTENDED,
WITHIN THE CITY.OF AUBURN, WASHINGTON.

6 WHEREAS, a petition dated December 1, 1981, together with 'plot plans and -
7 exterior elevations therefor, has been submitted to the Council of the City of
: 8 -Auburn, by MATHERS INVESTMENTS, INC., requesting a Conditional Use Permit on
9 . property zoned R-3 (Duplex), for the purpose.of constructing three fourplexes
10 and one triplex on a parcel of larid 1.24 acres in'size lying om the southside
•:11 of 37th Street S.E. east of "M" Street S.E. ?xtended, within the City of
12 Auburn, Washington, whieh property hereinafter legally described in Section'1
13 of this Ordinance and.which property presently carries an R-3 (Duplex), 14 classification; and • 15 ' WHEREAS, said request above;referred to was referred by the City Council .
16 to the City Planning Cortmission for study and public hearing thereon; and
: 17 WHEREAS, the Planning Commission held a public hearing to consider the,.
18 . request in the Council Cliambers of the Auburn City Hall, at 7:30 P.M. on
19 January 5, 1982, and subsequent thereto, the City Planning Commission"approved
20 the issuance of a~Conditional Use`Permit on property zoned R,3, finding that'
`21 .the proposed use illustrated.by the site development plans of the petitioner .
22 would not be undul detrimental to'tfie ad'acent and surroundin , y ~ g properties and
,23 'the enjoyrtient thereof; and . , 24 WHEREAS,•the City Council of the City of Auburn, held a public.hearing to
25 consider said petiti,on in.the Council Chambers of the Auburn City Hall at 8:00 26 P.M. on February 1,.1982, at the conclusion of which the City Council con- ,

curred with the recoimnendations of the Planning Cormnission as hereinabove

Section 2. That the site,plan be revised to provide a 30-foot right-of-

14 Section 3. That the existing water mai- n and sanitary sewer located at the
northwest corner of.the,s;ite be extended east across the frontage of the pro-

17 Section 4. That 37tfi,Street S.E. be constructed as a half street or delay
18 authorized in accordance with the provisions of City Ordinance No. 3635.
19 Section'5. That the developmentbe subject to the reguirements of the
20 Auburn Fire Department asrequired under City Ordinance Nos. 3064 and 3174. 21 Section 6. That the sewage liftstation be approved by the Public Works

22 Department as to the type and installation.
23 Section 7. The City;Clerk of the City of Auburn, Washington, is hereby
24 authorized,and directed to file a certified copy of this Ordinance with the
25 King County Auditor.
26 Section 8. The Mayor is hereby authorized to implement such admirtistra-
27 tive procedures as may be necessary to carry out the directions of this
28 legislation. ,
