AN ORDINANCE OF THE CITY OF AUBURN, WASIiINGTON, RELATING TO AND PROVIDING FOR
3., THE VACATION OF ALLEY, SITUATED ON THAT PORTION OF LAND DESIGNATED AS A
• PUBLIC ALLEY LYING BETWEEN "A" STREET N.W. AND THE BURLIN6TON NORTHERN
¢ RAILROAD R/W AND SOUTH OF 3RD STREET N.W. AND SITUATED WITHIN THE
CORPORATE LIMITS OF THE CITY OF AUBURN.

~ 6 WHEREAS, the City Council of the City of Auburn, Washington,.have passed

=q 7 and adopted Resolution No. 1324, resolving that a public hearing shall be had
8 for the purpose of determining whether or not the hereinafter tlescribed alley

9 right-of-way located on that portion of land designated as a public alley
10 running between "A" Street N.W. and the Burlington Northern Railroad R/W and
11 south of 3rd Street N.W:, within the corporate limits of the City of Auburn
12 shall be vacated, said portion to be vacated being hereinafter legally
13 described inlSection 1 of this Ordinance; and 14 WHEREAS, notice of public hearing to vacate the portion of a certain
15 alley right-of-way located on that portion of land designated as a public
16 alley running between "A" Street N.W. and the Burli,ngton'Northern Railroad R/W
17 and south of 3rd Street N.W,., within the corporate limits of the City of
18 Auburn, in the time and manner prov'ided by law, giving notice that the hearing
19 on said Resolution No. 1324 was held on the 21st day of June, 1982, at 8:00
20 P.M. in the Council Chambers of the'Auburn City Hall, at which time the matter
21 was referred'to the Utility and Street Committees for, further study and
22 discussion thereon; and
23 WHEREAS,I the Auburn City Council,Street Committee at their meeting of June
24 23,"1982,and the Auburn City Counc'il Utility Committee at their meeting of
• 25 June 24, 1982, approved the request for alley vacation; and ,
26 WHEREAS, the Auburn City Council at their regular meeting of July 6, 1982,
27 having deemed that the petition for vacation was proper and thet no vested
28 rights would be affected by the same;
29 NOW, THER'EFORE, THE CITY COUNCIL OF THE"CI,TY OF AUBURN, WASHINGTON, DO

18 Washington. ' 19 Section 2. That the request for vacation of alley right-of-way be granted
20 subject, to a public utility easement over, across, upon and underneath the
. 21 a portion of the vacated alley for ingress and egress for'tfie purpose of main-
22 taining the sanitary sewer. .
23 Section 3. Upon the passage; approval and publication of this Ordinance,24 the City Clerk shall cause a certified copy of this Ordinance to be,recorded
25 in the office.of the King County Auditor. _
26 Section 4. The Mayor is hereby authorized to implement such administra-
27 tive procedures as may be necessary to carry out the directions of this
28 legislation.

1. Section 5. Tfiis Ordinance shall take effect and be in force five (5) days
