" 3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, P.ROVIDING FOR THE CONSTRUCTION
AND INSTALLATION OF STREET PAVING, CURB AND GUTTER, SIDEWALK, STREET
4 LIGHTING, STORM DRAINAGE, SANITARY SEWER, WATER MAINS, AND FIRE HYDRANTS
ON 26TH STREET N.W. BETWEEN THE WEST VALLEY HIGHWAY AND A POINT 650 FEET
: 5 EAST'OF THE WEST VALLEY HIGHWAY,, DESCRIBED IN SECTION 2 OF THIS ORDINANCE;
CREATING AND ESTABLISHING LOCAL IMPROVEMENT DISTRICT N0. 329;,PROVIDING
6 THE METHOD OF ASSESSMENT IN SAID.DISTRICT AND THE MODE OF PAYMENT
THEREOF, AND CREATING A LOCAL IMPROVEMENT FUND THEREFOR.

g WHEREAS, a petition has been filed with the City Council of the City of
g Auburn, signed by the owners of the property aggregating a majority (1) of the
~ ~
10 lineal.frontage upon the improvement and (2) of the area within the proposed
11 district, setting forth the nature and territorial extent of the proposed
12 improvement, the mode of payment and what proportion of the lineal frontage
13 upon the improvement and of the area within the proposed district is owned by
14 the petitioners as shown by the records in the Office of the County Auditor
15 for King County, Washington, petitioning for the construction and installation
16 of street paving, curb and gutter, sidewalk, street lighting, storm drainage,

17 sanitary sewer, water mains, and fire hydrants on 26th Street N.W. between the
18 West Valley Highway and a point 650 feet east of the West Valley Highway,
19 legally described in Section 2 of this Ordinance, inside the corporate limits

20 of the City of Auburn; and
21 WHEREAS, the City Engineer has caused ari estimate to be made-on the cost
22 and expense of the proposed improyement and has certified said estimates to
23 the City Council; together with all papers and information in his possession,"
24 touching the proposed improvements, a description of the boundaries of the
25 district, a statement of what portion of the costs and expense of the improve-
26 ments should be borne by the property within the proposed district, a state-
27 ment in detail of any local improvement assessments outstanding and unpaid
28 against the property in the proposed district, and a statement of the aggre-
29 gate actual valuation of the real estate and the actual valuation of the
30 improvements.in the.proposedsdistrict according to the valuation last placed

31 upon it for the purpose of general taxation; and

1 WHEREAS, said estimates are accompanied by a diagram of the.proposed
2 improvements showing thereon the lots, tracts and parcels of land and other

3 property which will be especially benefited by the proposed improvements,and
4 the estimated amount of the cost and'expense thereof to be borne by 'each lot,

16 Section.2. -That.there is hereby created and established a Local`.~lry Improvement District,to be designated Local Improvement District,No. 329;
' 18 which said district .is ]egally described as follows, to-wit:

as recorded under King County Auditors file No. 7912260411.

Section 3. That the estimated cost in carrying out the foregoing improve-

ment is hereby declared to:be as near as may be, the sum of. $203,876.30.
23. , Section 4.' Applicable"costs and expenses of all engineering, legab,

inspection, advertising, publication and notices, and all other expenses inci-

dent thereto, shall'be'levied and assessed against all of the~property legally

Section 5. That said improvements shall be made by the City of Auburn

under the supervision of the City Council thereof or such committee or person
3
as the City Council.may designate.

Section 6. Assessments or any portion thereof, may be paid at any time
5
within thirty (30) days from the date of the first putilication of the Notice
6 ,
of Collection of such assessments without penalty, interest, or cost, and
7
. thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal
8
annual installments, with interest on the whole unpaid sum at the rate of one
9
half (1/2) of one percent (1%) in excess of the net effective rate of the
10
Local Improvement District bonds.

Commencing with the first year after the last day, such assessments, or
12 .
any portion thereof, may be paid without penalty, interest or cost (thirty
13 . `
14 (30)'days _from tfie`date'of the'first publicatfon of the Treasurer's Notice of
• Collection'of Assessments) and each year thereafter one of said installments,
15 . ' . `
'together with the interest due, shall be collected as provided by 1aw and the
16 ,
Ordinances'of the=City'of Auburn; assessments or installments of assessments

not paid when due shall be delinquent and there shall be added to the same a
• 18
19 penalty of twelve percent (12%) of the amount of the overdue installments and
20 interest, and such penalty shall become a part of the lien upon the property
21 assessed. ~

22 Section 7: TNat there is hereby created in the Office of the Finance
2 3 Director for the City of Auburn, a fund of the'City to be known as "Local
24 Improvement Distritt No. 329 Fund." Warrants shall be drawn on said fund
, 25 based on estimates made by the City Engineer and approved by the'City Council
26 in payment of the cost of construction and installation of said improvements.

Section 8. The Mayor is hereby authorized to implement such administra-

tive procedures as may be necessary to carry out the directions'of this

- legislation. "

Section 9. This Ordinance shall take effect and be in force five (5) days
5
6 from and after its passage, approval and publication, as provided by law.
