AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON,.PROVIDING FOR THE CONSTRUCTION 3 AND INSTALLATION OF SANITARY SEWER AND APPURTENANCES ON AN EASEMENT LYING ALONG THE SOUTIi LINE OF THE NEa OF-THE SWa OF SECTION 12, TWP 21 N, R 4 4 EWM BETWEEN THE UNION PACIFIC RAILROAD RIGHT OF WAY AND SR 167, DESCRIBED IN SECTION 2 OF THIS ORDINANCE; CREATING AND ESTABLISHING LOCAL 5 IMPROVEMENT DISTRICT N0. 330; PROVIDING THE METHOD OF ASSESSMENT IN SAID . DISTRICT AND THE MODE OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT 6 ' "FUND THEREFOR. 7 , WHEREAS, a petition has been filed with 'the City Council of the City of 8 , Auburn, signed by the owners of the property aggregating a majority (1) of the 9 ` . lineal frontage upon the improvement and (2) of the area within the proposed 10 district, setting forth the nature and territorial extent of the proposed 11 , improvement, the mode of payment and what proportion of the lineal frontage 12 . 13 upon the improvement and:of the area within the proposed district is owned by the petitioners as shown by the records in_the Office of the County Auditor 14 . for King County, Washington, petitioning for the construction and installation 15 . 16 of sanitar,y sewer and appurtenances on an easement lying along the'South line 17 , of the NE; of the SW; of Section`12, Twp 21 N, R 4 EWM, between the Union Pacific Railroad Right of Way and SR 167, legally described in Section 2 of 18 19 this Ordinance, inside the corporate limits of the City of Auburn; and 20 WHEREAS, the City Engineer has caused an estimate to be made on the cost 21. and expense of the proposed improvement'and has certified said estimates to 22 the City Council, together with all papers and information in his possession 23 touching the proposed improvements, a description of the boundaries of the 24 district, a statement of what portion of the costs and expense of the improve- 25 ments should be borne by the property within the proposed district, a state- 26 ment=in.detail of any local improvement assessments outstanding and unpaid 27 against the property in the.proposed district, and a statement of the aggre- > . 28 gate actual valuation of the..real'estate and the actual valuation of the 29 improvements in the proposed district according to the valuation last placed . . , • . , 30 upon it for the purpose of general taxation; and 31 WHEREAS, said estimates are accompanied by a diagram of the proposed 32, improvements showing thereon the lots, tracts and parcels of land and other i Ordinance No. 3795 . ' . . . 2` under the supervision of the City Council thereof or such committee or person 3 as the City Council may designate. 4. Section 6_ Assessments or,any portion thereof, may':be :paid at any time 5' within thirty (30)•days from the date of-the first publication-of the Notice ~ g of Collection of such assessments without penalty, interest, or'.cost, and ry thereafter thesum remaining unpaid, if any, may be peid;tn ten (10) equal g annual instaYlments, with interest on the whole unpaid sum at the rate of, one g half (1/2)lof one percent (1%) in excess of the het effective rate of the . 10 Local Improvement District bonds. 11 Commencing with the first year.after the last day, such assessments, or 12 any portion thereof, may be paid without penalty, interest or cost (thirty ,13 (30) days from:the date of the first publication of the Treasurer's Notice of 14 Collection of Assessments) and each year thereafter.one of said installments, 15 'together with the interest due, shall be collected as.provided by law and-the, 16 `Ordinances of the City of Auburn; assessments or.installments of assessments lry not paid when due shall'be delinquent and there shall be added to the same a , 18 penalty of twelve percent (12%) of the amount of:the overdue installments and 19 `interest, and-such penalty shall become a part of the lien upon the property 20 assessed. , • , 21 Section 7,.
