The meeting was calied to order by Mayor Denise. Councilmen Present: Aaby, Petersen, Kammeyer, Stalder, Fitzsimmons, Towner, Prescott. Councilmen Absent: None Minutes of the previous meeting held March 15, 1960, were approved as mailed. PUBLIC HEARING None BIDS None COMMITTEE REPORTS PURCHASING COMMITTEE Councilrnan Pctersen reported that the Purchasing Committee has met with Elmer Stodd regarding phones and a generator. The Comrnittee withheld any action because the 1960 budget did not have available funds to cover this expense. Councilman Petersen reported that the Purchasing Committee had also met with Bob Millard, Cemetcry 5upt., regarding a back- hoe. A new backhoe would cost a considerable amount of money, and if Mr. Millard wanted to, he could (oak into the purchasing of a good used backhoe. It was moved by Prescott and 2nd by Towner that the City install two Mercury Vapar li9hts, one on each end of the Red Rooster parking lot. MOTlON CARRIED Councilman Towner stated that something shoutd be donc about thc driveway into the Red Rooster, This should bc done as a safet project. The City Engineer stated that he would contact Mr. Phil Downs and see if some kind of curbing can be installed to etiminat the large entrancc to the praking lot. It was moved by Prescott and 2nd by Petersen that the City instatl 1 300 watt light in front of Green Acres Rest Home. MOTION CARRIED PAGE 2319 AUBURN, WASHINGTON TOESDAY APRIL 5, 1960 ORDlNANCE #1380 it was moved by Prescott and 2nd by Stalder that Ordinance #1380, entitled, An Ordinance of the City of Auburn, Washington, relating to and providing for the vacating of a certain street in the City of Auburn and reserving an easement thereon to thc City for utilities, be introduccd and adopted with the following roll call vote being recorded: Aaby, yes; Petersen, yes; KammEyer, yes Stalder, yes; Fitzsjmmons, ycs; Towner, yes; Prescott, yes; ORDINANCE #1381 It was movcd by Kammeyer and 2nd by Prescott that Ordinance #1381, entitled, An Ordinance of the City of Auburn, Washington, authorizing the sale of municipa) water to King County Water District No. 101, be introduced and adopted with the following roll call vote being recorded: Aaby, yes; Petersen, yes; Kammeyer yes; Stalder, yes; FitzsimmQns, yes; Towner, yes; Prescott, yes; ORDINANCE #1382 tt was moved by Prescott and 2nd by Petersen that Ordinance #1382, entitled, An Ordinance of the City of Auburn, Washington, relating to and providing for the improvement of portions of certain streets in the City of Auburn by the construction of concrete curb and gutter and an asphaltic concrete surface, and cast iron water mains and fire hydrants, and sanitar:y sewer mains, all in accordance with petitions signed by a majority of the affected property owners and filed with the City Clerk of said City, end a certification of the City Engineer of said City that a ~ajority of the affected property owners have signed the petitio and that all of the facts set forth in said petitions are true and that the estimated cost to the property will not excced the limit established by law, and Ordinance No. 1339 having been passed on August 18, 1959, which provided for the proposed improve ments, and said proposed improvcments having been completed under said Local Improvement District No. 136, now levying and assess~- ing the amount thereof against the several lots and other property as shown on the said assessment roll, thcrefor, and now providing for the payment of such assessments to the Local Improvement District No. 136 Fund created by Ordinance No. 13391 be introduced and adopted with the following roll call vote being recorded: Aaby, ycs; Petersen, yes; Kammeyer, yes; Stalder, yes; Fitzsimmons yes; Towner, yes; Prescott, yes; The City Attorney presented an ordinance regarding the leas- ing of parking Iots from the Auburn Boosters, Inc. The Council BeqWested that this leasc be held over till agreements on the other two lots wcre made, This policy should be uniform on al) three parking lot5. The (ease on the other two lots expired in February. lt was moved by Towner and 2nd by Petersen that this lease be tabled till next regular Council meeting. MOTION CARRIED WRTER SUPT. REPORT The Water Supt. reported that Enumclaw Hwy from the Ram House to completed after two years work. Last Council meeting the Water Brister Trailer Courts. The Water rates be changed to $2.00 per unit $1.25 per unit thereafter. the 16" water main along the 9th & C St. S.E. has been Supt. set fhe Irates far the Supt. recommended that these for the first three units and It was moved by Kammeyer and 2nd by Fitzsimmons that the recommendations of the Water Supt. be granted. MOTION CARRIED The Water Supt. also reported that Russel Bond, Sewaage Plant Operator, tendcred his resignation as of May 1960. They have hired another man, Jack Muir, who he thinks will be real good STREET SUPT. REP4RT No report. I PAGE 2320 Auburn, Washington tuesday APRIL 5, 1960 ENGINEER'S REPORT The City Engineer stated that he had gone to a meeting for the valley flood control. The City of Kcnt and Rentan are trying to get their water siituation tafcen care of, and when,this is finished, the property on the West Hwy. will be releatved of the winter waters. The reason for the high water on the West hwy is due to the fact that the river is so high the surface water has no drainage. The Cities at the narth end of the valley would like morat support from Auburn. It was moved by Aaby and 2nd by Kammeyer that the City of Auburn tcnd their moral support to the efforts of the othcr cities. MOTION CARRIED OLD BUSINESS The City Attorney exptained that he has been working on the Farl Staptes case. He was convicted of drunk driving, but is 'ifghting the suspension of his drivers licanse on the grounds that a Po 1 i ce Judge cannot suspcnd a I i cense granted °)y the State. Nis attorncy has appealed this to the State Supreme Court. The City Attorney, therefore, rcquested permission 'from the City Council to file a cross-appeal. ' it was moved by Kammeyer and 2nd by Petorsen that the City Attorney be instructed to proceed with the cross-appeat. MOTION CARREED Councilman Towner ;N.E. would like to know 'will be in effect. ' The City Attorney ipublication. stated that the people living on Park Pt. when the ordinance vacating that street explained fivc days after it's approval & Councilman Prescott asked the City Engineer if anything was being done to secure a flasher light on M S+. S.E. at the N.P. railroad crossing. The City Engineer stated that this is stil) be. ing argued as to who will pay for the light, the State or the Northern Pacific Railroad. Severa) lights that have been oeqweste< from the State have not been reccived. Councilman Stalder asked if the sidewalks on F St. S.E. have been taken care of. Tne City Engineer stated that the State is making preparations to take care of this. NEW BUS I NESS M The Mayor statcd that he has appointed Mr. Del Heisserman to fill the vacancy left on the Citil Servicc Board. The Mayor stated that he has attended several meetings for the Naches Tunnel. x It was moved by Prescott and 2nd by Towner that the City go on record as endorsing the construction of the Naches Tunnel. MOTION CARRIED CORRESPONDENCE WENOELL WORKMAN & B08 DRIGGERS The City Clerk read a letter from Wendell Workman and Bob Driggers protesting tha manner in which the City Transit Bus Co. is being allawed to operate. They request that the Transit System be rec,uired to operate only on the routes that are posted and only on the times that are shown. Thcy also requested that some type of corrective measures be taken to allow thcm to continue to give the community the type of scrvice it deserves. Mr. Workman stated he had severa( examples as to how the Transit Systcm has been operating. Mr. NC!'iIlE1C stated that he has not gone off his route. There was considerablc discussion as to how thc Trassit Syster has been working. It was moved by Aaby and 2nd by Petersen that the proper authorities notify the bus owner to comply with the ordinance, schedual, and route that is registered with the City. MOTION CARRIED PAGE 2321 AUBURN, WASHINGTON TllEBDAY APRIL 5, 1960 The Transit System has not paid for the bus stands as yet. The City Attorney had an ordinance prepared at the last Council meeting, but thc City Council reqeusted more time for consideration This was referred to the Street Committee and some kind of action be made. JOHN HAMILTON & HENRY NOLTING The City C{erk read letters from John Hamiiton and Henry Nolting, both protesting the increase in water rates. Counciiman Kammeyer stated that the Water ordinance has been adjusted for apartment buildings. They evidcntly have not receive the revised rates. PACIFIC TEL. & TEI. C0. The City Clerk read a lettcr from the Pacific Telephone Co. stating that their customers are using the Greyhound lot next to their building for temporary parking while paying bills. They, thereby, request that the City change the parking space in front of their building from all-day lbarking to at least three 15 min. Zoncs. This lettcr was referred to thc Street Committee. HOWARQ BOWEN The City Clerk read a(etter from Howard Bowen requesting additional street lights on A St. N.E. between third & fifth. This letter was referreci to the Light Commtttce. AUBtlRN PLANNING COMMI$SION Thc City Clerk read a letter from the Auburn P(anning Com- mission regarding Mr. N.C. VanWyck's petition to rezone from R-68 to RG in Ryan's Addition. This plat has a restrictive convenant which the City does not have power to nullify restrictive convenat previously placed on property in a real cstate development by pers ns who plattcd such development. The Planning Commission recommends the rejection of Mr. VanWyck's pctition. It was rnoved by Kammeyer and 2nd by Prescott that the Plann- ing Comrnission recommendation be granted and Mr. VanWyck's petitio bc denied. MGTION CARRIED ROBERT E. GAINES The City Clerk read a letter from Robert Gai,nes, Chairman of the Auburn Park Commissaon, requesting the City place under the Park Commission's jurisdiction the four acres tract located at 5th & M St. N.E., for the purpose of developing a recreational and play fiel,d for the area. Mr. Gaines stated tlaat the Commission feels there is a need for a ball park and other recreational facilities. It was moved by Aaby and 2nd by Kammeyer that the Parfc Commis sion's request be granted. MOTION CARRIED MIKE BRADY The City Clerk read a letter from Mike Brady requesting a petition be prcpared for the formation of a Local Improvement District for the south side of 25th St. S.E. and 632' of M St. S.E. The construction ta consist of paved streets, curbs, gutters, and sidcwalks. This letter *as referred to the Finance Committee & City Engi ee GEORGE SCHULER The City Clerfc read a letter from George Schuler stating that the attached petition for annexation West of Auburn has been favor able signed by 75.311. of the property,`based upon assessed valua- tion of the land and improvements'as listed on County tax tolls. Councilman Stalder wanted to know if the City would benefit from the annexation. George Sahuler stated that these people woul (ike to come into Auburn because of their taxes being so high and also beceese the County will not allow them to d6velop their land. MOTION CARRIED May 3, 1960 was the date set for Public Nearing. ZANE B. JONNSON The City Clerk read the quarterly report from Zane B. Johnson, Police Judge. Number of cases docketed, 536; Cases disposed of, 519; Minor Traffic violations, 370; Courtesy violations, 1477; Totat , receipts, $9102.45; Total Disbursements, $9102.45; Bail returns, $354.80; Totai to Treasurer, $8747.65. This letter was ordered filed. AUDIINCE BILL RAVEN gill Raven requested the Mayor proclaim June II, 1960, as ',Auourn's Operational Paint Brush Paint Up. The Governer and other 'distenguish visitors wil) be here on June II, 1960. JOEL BUFFINGTON ' Joe( Buffington stated that severa) complaints havc been made labout the condition of West Auburn as seen from the new h►ghway. 'iThe Mayor stated that last year the people in that area were told ',to clean up their property. The Mayor will look into this, ' Councilman Prescott stated that the complaints were probably ;about the blackberry bushes and other shrubs along the Millwalkee ;tracks. The Mayor stated he had ta(ked to them and they had showed ;him wherc the bushcs had been burned. The Fire Committee was ;instructed to check this for a fire hazzard. CLAfMS It was moved by Prescott and 2nd by Kammeyer that the followin claims against the City, all having previously been passed and signed by thc Finance Committea, be approved and the City Clerk be authorized to draw warrants in payment.
