Background Summary: Resolution No. 4595 authorizes the Mayor to execute a Local Agency Agreement with the State to obligate federal funds in the amount of $749,872 for the right of way acquisition phase of the M Street SE Grade Separation project. The federal funds do not require any local match. Federal environmental approval (NEPA) has been obtained and the design is approximately half way complete. State environmental approval (SEPA) and final design is currently underway. The right of way documentation required to authorize federal funds for right of way acquisition are nearing completion and WSDOT authorization to begin the right of way phase is expected this summer. Negotiations, acquisitions, and relocations are expected to continue through 2010 into 2011. Right of way certification is anticipated in summer 2011, followed by bidding, award, and the start of construction in late 2011. Construction is anticipated to last 18 to 24 months and will include a 9 to 12 month closure of M Street SE at the railroad crossing. The total estimated project costs are $22.4 million. The right of way phase is anticipated to cost $4.6 million and will be funded with federal and City funds. The construction phase is anticipated to cost $15.4 million and will be funded using federal, state, and other funding sources. C201A, M STREET SE GRADE SEPARATION WHEREAS, the City desires to improve the safety, capacity, and efficiency of the crossing of M Street SE and the BNSF Stampede Pass Railway; and WHEREAS, lowering M Street SE below the tracks and constructing a railroad bridge over the tracks will improve the safety, capacity, and efficiency of M Street SE at the crossing; and WHEREAS, the City received a grant in the amount of $749,872 from the 2010 Federal Appropriations Act to assist in the design of the M Street SE Grade Separation that does not require a local match; and WHEREAS, it is in the best interest of the City to use federal monies to finance capital improvements to the street system. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, HEREBY RESOLVES as follows: Resolution No. 4595 April 22, 2010 Page 1 Section 11 The Mayor is hereby authorized to execute a Local Agency Supplemental Agreement between the City and the State for the Design Phase in the total amount of $749,872 in substantial conformity with the agreement attached hereto, marked as Exhibit "A" and incorporated herein by this reference. In addition, the Mayor is hereby authorized to execute any necessary supplemental agreements for all future phases of the project. Section 2. That the Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 3.
