A RESOLUTION OF THE CITY.OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY
CLERK.TO:SIGN THEMUTUAL AID.AGREEMENT WITH.KING COUNTY AND OTHER KING
COUNTY`MUNICIPAL'AGENCIES, PROVIDING FOR IaIUTUAL AID AND PLANNING IN THE
EVENT OF MAN-MADE AND NATURAL DISASTERS.
THE.CITY.COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO HEREBY.RESOLVE
AS FOLLOWS:
THAT the Mayar and the Deputy Eity Clerk of the City of Auburn, Washington,
be and they are hereby authorized and directed to sign; on behalf of the City of
Auburn, a mutual aid agreement with King County and other King County municipal
agencies, providing for mutual aid and planning in the.event of man-made and
natural diSasters; a copy of such agreement is.attached hereto and made a part
hereof as though set forth in full.

PBJTUAL AID AGREEMENT
A. Preamble: This is a memorandum of agreement betweea King County, herein-
after referred to as "the County," a Charter county goveramental entity, and
euch municipal corporations, hereinafter referred to as "participants," as
elect to enter into this agreement, and each of them. T'he agreement is intended
to be effective forthwith upon communication by a participant in writing to the
County of ite intent to be bound by this agreement, aad shall termiaate as to
any participant thirtq days after receipt by the County at its Office of Emer-
gency Services, hereinafter referred to as "OES," of that participant's written
notice of intent to withdraw herefrvm. Such withdrawal ehall, upon the effective
date thereof, teraninate anq dutq of the participant further to render sid here-
under, but sha1Z not therebq terminate any other duty matured prior to termin-
ation.
This agreement shall be liberally construed to effect its stated purpose:
To provide a vehicle defining the rights and duties of the County and partici-
pants in situations reasonably calling for cooperation between any or all of
them, the beat and most effectively to resolve such situations in the public
interest.

C. Definitions:
1. Mutual Aid: The coordination and utilization of all available
. resources,to assfst each-other, in event a disaster should occur resulting
from enemy attack, sabotage, or other hostile action, or bq fire, flood,
storm, earthquake, or other natural disaster, as to provide assistance and
support to,each other for search and rescue"operations for persons and
property.in diat:ress. This exchange of services.and facilities includes.
but is not limited to fire fighting servicea, police services, medic.al and
health services, rescue, engineering, air raid warning services, communica-
tions, radiological, chemical and other special weapons defense, evacuation
of.persons.from stricken areas, emergency welfare services, emergency trans-
. portation services, plant protection, temporary restoration of.public utility
services and all other functions related to the peace and function of normal
government in Kfng County, except for and save oniy those situatione involving
police services in actual or potential civil disturbances or riots, which are
the subject of a.separate agreement.
2. Emergency: A temporary situation involving substantial risk to prop-
erty or human life, the resolution of which may be beqond the capabilities
or resources of a department or agency of the jurisdiction within wfiich it
exists. An emergency may be:
a. Potential: A situation exists which by its nature can develop
into.an emergency within'a time frame beyond the capabilitq of the County or,
a participant to develop internal resources to resolve such emergency;
b. Anticipated: A situation exists which reasonably is expected to
become an emergency within a short period of time';
c. Undeclared: An emergency exists, the existence of which is
reasonably.recognizable but has not been formally proclaimed bg a publicly
disseminated executive declaration, oral or written;
d. Declared: An emergency exists and has been formaily proclaimed
by a publicly disseminated executive declaration.
3. Municipal Carporation: An entity created by,or under the law of the
State of Washington charged partly or wholly with the obligation:to the public
to protect lines or property, including without limitation cities, towns,
ffre protection districts, water districts, the Port of Seattle, Metro, public-
utill-ties, and any other entity possc3ssi.ng what is commonly termed "poliCe
power. " .

4. Executive: The individual or group of individuals of a municipa.l cor-poration possessing the.power to carry.out the duties necessary to piotect
lives or property within such corporation's jurisdiction. -As used herein,
such term shall include the designee of such individual or group charged with
the protection role, or that person lawfully acting for auch designee.
5. Resources: Those means, both human and material, available for
application to an emergencq, the'allocation of which would serve to prevent,
reduce,, or eliminate the emergency nature of a situstion. :
6. Cooperation: A2location of resources'by one jurisdiction to another
for the purpose of application to an emergency. Such cooperation inciudes:
a. Coordination; Allocation of resourcea in poteatial or anticipated
em,ergencies to provide exchange of plaas, and information, designed to lessen
or prevent severity of an emergency;
b. Standby aid: Allocation of resource§ in anticipated, undeclared
and declared emergenices for preparation to deploy such.resources, to include
- alert and, if necessary, mobilization for deployment into another jurisdiction;
c. Actual sid; Deployment of resources in aaticipated, undeclared
and declared emergencies for utilization in another jurisdiction to reduce or
lessea the emergency nature of a situation.
D. Agreement: The executive of King County and the municipalities thereof: 1. Desire that a cooperative agreement be executed for the interchange
of such mutual aid on a county-wide basis, such mutual aid being reasonable
and such agreements being authorized under the terms of the Washington State
Emergency Services Act of 1951, as amended bq RCW 38.52.
2. Agree that the OES, by authority referenced above, will be the cooidin-
ating agency for developing or causing to be developed in collaboration with
municipal:corporations and private agencies such mutual aid operaCion.s plans
as are referred to hereia, consistent with state and federal emergency services
plans and programs. 3... Agree to develop operational plans providing for the effective mobili-
zation of all their resources and facilities., both public and private, to cope.
with types of disasters common to King County and their local jur.isdictions
and periodically review and update such plans not less than annually, with
copy to King County OES.
4. Understand that this agreement and the operational plans adopted pur-
suant hereto.shall supplant existing agreements between some of the parties
hereto providing for the exchange or furnishing of certain types of facilities
and services oa a reimbursable, exchange or other-basis, and that the mutual
aid extended under this agreeioent and the operatfonal.plans adopted pursuant
hereto, shall be without reimbursement except as otherwise herein prvvided;
except for and save only those situations involving-police services in actual
or potential civil disturbances or riots, which are the subject of a separate
agreement.
5. Understand that the responsible local official in whose jurisdiction
an incident requiriag mutual aid has occurred, shall remain in charge at such
incident including the direction of such personnel and equipment provided him
through the operation of such mutual aid operat-ional plans, un2ess the specific
mutual aid. operational plan should expressly provide otherwise.

, 6. Understand that the,failure of one or more of the parties to paitici=.
pate in a particular operational plan or any amendment, revision, or modifi-
catfon thereof, shall not affect the operation of thfs agreement and the - other operational plans adopted pursuant thereto. "
7. Understand that whenever a public employee of a participant or of -
the County;,dies, is injured, or is disabled from performing his duties by
reason of engaging in the apprehension or attempted apprehension of law vio-
lators or suspected law violators or protection or presexvation of life or
property,or the preservation of the peace anywhere in the County including
. the local jurisdiction in which he is employed, but is not at the time acting
under the immediate direction of his employer, he or his dependents, as the
case may be, shall be accorded by his employer the same benefits which he or
they would have received had that public employee been acting under the immediate
direction of his employer.
8. Agree to register with OES all person.nel who could be involved in
rendering Mutual Aid hereunder as Emergency Service (Civil Defense).workers.
9. Understand that they will utilize thefr own resources first in an
. emergency within their jurisdiction prior to requesting aid hereunder. -
. 10. Agree to notify OES immediately upon the determination by any of them
that an anticipated, undeclared or declared emergency exists within their,
jurisdiction. .
11. Agree to furnish, upon request of 0ES or atry participant hereunder,
such resources under their control as are requesr.ed and can reasonably be
provided, however, no participant of which mutual aid is requested shall.be .
required so to deplete its resources that it cannot meet an anticipated,
undeclared ar declared emergency within its own juriadiction.
12. Agree to furnish standby aid at their own expense, and actual aid at .
their own expense for manpower resources.
13. Agree that a participant requesting ac[ual sid will, upon request,
reimburse responding participants for all resources furnished other than man-
power, provi.ded sueh resources are actualIy expended in the rendi.tion of
actual aid. 14. Agree that a participant [o whom actual aid is provided for a period
oE longer than eight hours, wi"11 be responsible for furnishing on request all
reasonable and necessary support facilities, including food and shelter, for
allocate.d manpower resources.
IN WITNESS WHEREOF this'agreement has been executed and approved and is
effective and operative as to each of the parties as herein provided.
