HomeMy WebLinkAbout1356 1 RESOLUTION N0. 1 3 5 6 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, 3 AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF AUBURN, TO ENTER INTO AN INTER-DEPARTMENTAL MUTUAL AID AGREEMENT (POLICE SERVICES) BETWEEN . 4 THE MUNICIPALITIES OF AUBURN, DES MOINES, KENT, NORMANDY PARtC, RENTON, TUKWILA, AND THE PORT OF SEATTLE. 5 6 THE CITY COUNCIL OF TFfE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING 7 Dt1LY ASSEMBLED, HEREWITH RESOLVES THAT: 8 9 THE Mayor and City Clerk of the City of Auburn, Washington, are herewith 10 authorized and directed to enter into an Inter-Departmental Mutual Aid Agreement (police services) between the municipalities of Auburn, Des Moines, 11 12 Kent, Normandy Park, Renton, Tukwila, and, the Port of Seattle. ' ~ POLICE SERVICES ` ~ . ~ , . • , t Ttiis agreement.is entered into pursuant to RCW 39.34, the Inter-Local Cooperation G Act;_and among tihe following Municipalities: Auburn, Des Moinea, Kent, Normandy ~ Park,-Reaton, Ttikwila, and the Port of Seattle. , i 6 WHEREAS, It is necessary that the police resources and.facilities of tYie above' " muiiicipalities be made available to prevenfi and combat the effecta of actual and . ~ potential civil disturbances or riots, and _ f WHEREAS, It.is desirable:-that each.of the parties hereto should voluntarily aid and assfat each other iri auch event, by the interchanqe of police services and facilities to cope with the.problems which would arise in such event; and , 'WHEREAS, It is necessary and deairable that a cooperative agreement be executed for. . the.-iriterchange of euch mutual aid on an inter-departmental basis; NOW, THEREFORE, IT IS.HEREBY AGREED by and each and all of the parties hereto as follows: . 1. Each party shall develop a plan providing for~the effective,mobilization of.its police resourses and facilities to cope with actual and potential civil : disturbances or riots: 2. -Each party agrees to furnish such resources.and facilities and to render services to each'and every.other party to this agreement to prevent and combat any such Elnerqency, Disturbance or Riot in accordance.with mutual aid.operational plans ! presently under consideration for adoption, whether theretofore or hereafter adopted, detailing'the method and manner by`which such Resources, Facilities, and ~services are to be made available and furnished, which operational plans mayinclude provisions for Training and'Testing to make such"mutual aid effectivet provided, however, that no party shall be required to_ deplete unreasonably,its own police resources, facilities, and services in furnishing such mutual aid nor to participate if, under certain circumstances, it deems it in its best interests ' -to forego participation. 3. It is expressly understood that this agreement and the operational plans adopted pursuant thereto shall not supplant existinq aqreements between the parties: hereto providing..for the exchange or furnishing.of certain types of facilities and' ~ :services on a reimbursable, exchange, or other basis, but that the mutual aid ~ exteaaea under this agreement and the operational plans adopted pursuant thereto, F shall be without reimbursement,. unless otherwise provided for by the parties to . this agreement and tliat such.mutual aid is intended to be available in the'event of an emerqency, disturbance or riot of such magnitude that it is, or is likely to - f.be, beyond the control of a single party and require the combined forces of . several or all of the parties to this agreement to combat. 4. It is expressly understood that the mutual aid extended under this agreement and ` the operational plans adopted pursuant thereto.shall be available and furnished, in accordance with the terms of this agreement, in all cases of actual and . tpotential civil disturbance or riot, and in all cases in which a STATE OF EMERGENCY has been proclaimed as defined im Chapter 12.52 of the King County Code. c. i: i.: ~ , . • ` - • . . 5. It is expressly understood that the responsible local official in whose ' jurisdiction a disorder requiring mutual aid hae occusred ahall remaia in charge at such incident, including the directioa of such pereonnel and equipment provided him through the operation of such mutual aid plans. 6. Whenever any gublic employee of a city, county, or port district, dies or is disabled frcm4 performing his duties by reason of engaqing in the apprehensioa or attempted apprehension of law violators or protection or preservation of life or property, or the preservation of the peace anywhere within the jurisdictional litaits of the qovernmental entities named in this aqreement, including the local jurisdiction in which he is employed, but is not at the time acting under the i.mmediate direction of hia emplcyer, he or his dependents, as the case may;be, shall be accorded by his employer the same benefits which he or they would have I reaeived had that public employee been acting under the immediate 8lrectio4 of I hie employer. I 7. It is eacpressly understood that each participating party herein shall continue to maintaia insurance coverage on its own personnel whenever giving mutual aid, and furthermore, each party shall pay their owa smployeee while such employeee are rendering aid pursuant to this agreement. This plan is adopted a,s a part of the mutual aid agreesaent entered into by the following mnnicipalitiea: Auburn, Des Moines, Kent, Noraumdy Park, Renton, Tukwila and the Port of Seattle under the provisions of RCW 39.34. , Policy The participatinq muriicipalitiee shall respond to requests fox personnel and ' equipmeat ae enumerated by the mutusl aid agreement. ' Procedure I - I 1. Upon notification by the Chief of Police or his desi 9nee, the requesting amuaicipAlity, the requestor, shall provide the followipg information: a. Identification of requesting municipality. b. Manpower needs. ~ 1. Emergency Services Unit with special weapons'or equipment, I, includinq K-9. , I 2. Uniformed personnel with equipment, i.e., riot gear, protective' i vest, gas mask, batons, flashlights, etc. I 3. Non-uniformed personnel. c. Special equipment. d. Reporting time, location and commanding officer. e. Type of emerqency, i.e., riot, civil disturbance, aircraft, or ; crowd control. II. Notification priority. a. Chief of Police or designee b. Deputy Chief of Police c. Operations or Patrol Division Commander or designee ~ ; d. Eaergency Services or Special Operations Division Commander III. The re estin agen qu g cy shall provide subsistence, i.e., fuel for vehiclea, shelter if needed, and other necessary facilities for responding units.IV. Supervision/Ccmmand ~ A Depaztment supervisor or senior(supervising)officer shall accompany ~ responding personnel and shall remain for the duration of the emergency.
