Background Summary:
Resolution No. 4603 authorizes the Mayor to execute documents necessary to acquire property and
relocate inhabitants related to the M Street SE Grade Separation project.
The property needs for this project include the full acquisition of 10 properties and relocation of the
property inhabitants and partial acquisitions from 16 properties along with the necessary temporary
construction easements, and permanent easements.
The total estimated project costs are $22.4 million. The right of way phase is anticipated to cost $4.6
million and will be funded with federal and City funds.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, AUTHORIZING THE MAYOR TO
NEGOTIATE AGREEMENTS AND EXECUTE DOCUMENTS
NECESSARY TO ACQUIRE PROPERTY AND RELOCATE
INHABITANTS RELATED TO CITY PROJECT C201A — M
STREET SE GRADE SEPARATION
WHEREAS, the City is committed to constructing project C201A — M
Street SE Grade Separation; and
WHEREAS, this project requires the acquisition of real property, including
full acquisitions of 10 properties and partial acquisitions of 16 properties; and
WHEREAS, this project requires the establishment of permanent
easements for utilities, walls, and slopes and temporary easements for
construction; and
WHEREAS, the City Council has previously reviewed and approved
Resolution No. 4595 that accepted federal funds for right of way acquisition for
this project; and
WHEREAS, real property acquisition costs for this project are included in
the approved City budget; and
WHEREAS, the policies and procedures that will be followed in regard to
negotiation, purchase, and relocation of inhabitants for these properties is
governed by federal legislation and will be strictly adhered to; and

WHEREAS, negotiation and purchase of these properties in an
expeditious manner is imperative to the success of this project, and delay in the
process would not be in the best interest of the City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, HEREBY RESOLVES as follows:
Section 1. The Mayor is hereby authorized to negotiate agreements and
execute all documents necessary to complete the acquisition of real property
and the relocation of inhabitants required to complete City project C201A — M
Street SE Grade Separation, consistent with budgeted funds.
Section 2. That the Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of
this legislation.
Section 3. That this Resolution shall take effect and be in full force
upon passage and signatures hereon.
