Applicant’s failure to comply with any provisions/conditions of this permit shall be terms for immediate termination. 2. Applicant shall maintain current insurance naming the City as an additional insured throughout the life of the permit and provide the City with proof that they are insured. Proof of insurance shall be sent to City of Auburn, Amber Mund, Engineering Aide, 25 West Main Street, Auburn, WA 98001. 3. Applicant provides a signed and notarized Hold Harmless. 4. At any time the City deems it necessary to use the right-of-way for public purposes, the applicant will be financially responsible for the removal of any temporary or permanent objects that are placed by the applicant in the right-of- way. This could include but not be limited to objects such as signs, planters, lights, vehicles, and landscaping. The applicant shall have 180 days to remove any temporary or permanent objects. 5. If landscaping is not provided on private property along the property line in accordance with Auburn City Code (ACC) Chapter 18.50, then landscaping shall be provided in the right-of-way area (or a combination of along the property line and in the right-of-way) that meets or exceeds the C3 (Heavy Commercial) zone landscaping requirement along a street frontage (ACC Chapter 18.50). Should the Right-of-way Use Permit expire and/or be revoked, then the applicant shall be required to provide the code required landscaping entirely on the private property in accordance with ACC Chapter 18.50. Should the Right-of-way Use Permit expire and/or be revoked, then the applicant shall be required to provide Landscaping plans to the City as part of the civil plan review process for City review and approval. Construction pursuant to the approved plans shall be implemented within 6 months and an inspection requested by the applicant. 6. The City reserves the right to adjust the terms and conditions or revoke this Right-of-Way Use Permit pending the following considerations: a. Public complaints involving perceived issues impacting public use of the ROW affected by the permit. b. Public comment or other community interest concerns. c. Any emerging issue or change in use of the ROW that may impact the public interest, as follows: The remaining capacity of the rights-of-way to accommodate other uses if the applicant’s proposed use is granted. The effect, if any, on public health, safety, and welfare if the authorization is granted. rights- Such other factors as may demonstrate that the grant to use the of-way will serve the community interest.
