3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR -
THE REZONING OF.PROPERTY LOCATED ON THE NORTHEAST CORNER OF r~
, 4 4TH AND "V" STREET S.E., WITHIN THE CITY OF AUBURN,
WASHINGTON, CHANGING THE.ZONING CLASSIFICATION THEREOF FROM R-
1(SINGLE FAMILY) TO R-2 (SINGLE FAMILY).

WHEREAS, Application No. REZ0002-93 has been submitted to '
g , ~7 the Council of the City of Auburn, Washington, by RICHARD =
MILLER, requesting the rezoning of the real property -r~

~ %hereinafter described in Section 2 of the Ordinance; and

~ 10 ~EREAS, said request above referred to, was referred to

~ 11 the Hearing Examiner for study and public hearing thereon; and
~
~ WHEREAS; the Hearing Examiner, based upon staff review,

13 held a public hearing to consider said petition in the c Council
14 Chambers of the Auburn City Hall, on August 17, 1993, at the
15 conclusion of which the Hearing Examiner recommended the -
16 approval of the rezoning of said property, based upon the
17 following Findings of Fact and Conclusions, to-wit:
18 FINDINGS OF FACT

20 1. The applicant, Richard Miller, through his agent, John
Ewing, requested rezone from R-1, Single Family, to R-2,
~21 Single,Family.
22 2. The.subject property is .7 acres in size and is located
at the northeast corner of 4th and "V" Street S.E.

1 3. The evidence.-establishes that the subject parcel was,part
2 of a larger parcel annexed to the City in February, 1993.
Property which is annexed to the City of Auburn 3 automatically assumes the R-1 zoning pursuant to Section
18.02.050 of the Zoning Ordinance.
4 4. The evidence establishes that the Comprehensive Plan
5 designates land in all directions for single family uses.
Land to the north and east is zoned R-1 and land to the
6 south and west is zoned R-2. Existing land uses in the
vicinity include single-family to the north-and south,
vacant to the east, and a duplex to the west.

8 5. There is currently a manufactured home on.the parcel. It
is the intent of the owner to subdivide and create two
9 more lots.
6. The primary difference between the two zones, R-1 and'R-
10 2, is that 'the R-1 zone has a minimum lot size of 8, 000
li square feet and R-2 has a minimum lot size of 6,000
- square feet.
12 7. The Comprehensive Plan map illustrates the subject site
~ to be appropriate for single family uses in either zoning
~ 13 designation` and is consistent with the Comprehensive
Plan.

r4 15 ~ 16 CONCLUSIONS OF LAW
17 1. The rezone :is consistent with the Comprehensive Plan. i$ 2. The rezone is consistent with existing zoning.
19 3. The rezone is consistent with existing land uses.

21 For each of the above referenced xeasons, the
22 recommendation of the Hearing Examiner to the Auburn City
23 Council on this rezone from R-1 (Single Family) to R-2 (5ingle
24
Family) is approved and affirmed.

2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
3 WASHINGTON, DO ORDAIN AS FOLLOWS:
Bection 1. The above cited Hearing Examiner's Findings

5 of Fact and Conclusions, are herewith incorporated in this
6 Ordinance.
7 Section 2. The following described property located on
8 the northeast side of 4th and "V" $treet S.E., situate in the

9 City of Auburn, County of King, State of Washington,, be and_,
10 the same ishereby rezoned from R-1 (Single Family) to R=2
11 (Single Family) and legally described as follows:
12 Lot 2 as delineated on Short Plat No.
~ 13 181067., recorded under King County Recording No. 8190150581, being a portion
T4 of Lots 4 through 7, Block 4, East Auburn -
~ Garden Tracts, according to the plat
~ 15 recorded in Volume 18 of Plats, page 98,
~ in King.County, Washington.

~ 17 Section 3. Upon the passage, approval and publication of
18 this Ordinance as provided by law, the City Clerk of the City
19 of Auburn shall cause this Ordinance to be recorded in the
20 office of the King, County Auditor, Division of Records and
21 Elections.
22 Section 4. The Mayor is hereby authorized to implement
23 such administrative procedures as may be necessary to carry
24 out the directions of this legislation.
