WITHIN THE CITY OF AUBURN, WASHINGTON. , 5 6 WHEREAS, Application No. CUP0005-93 dated July 19, 1993`, 7 together with site plans therefore, has been submitted to the- S Gity of Auburn, Washington, by RST DISPOSAL requesting. a 9 Conditional Use Permit to allow shredding of wood waste on 10 Property zoned M-2 (Heavy Industrial) and located at 655 'and ~ 657 Second Street N. W. within the City of Auburn, Washington, PI 11 ~ 12 hereinafter described in Section 2 of the Ordinance• and ~ WIiEREAS, said request above referred to, was refer-red to 10, 13 ~ the Hearing Examiner for study and public hearing thereon; and ~ . °14 15 WHEREAS, the Hearing Examiner, based upon staff review, ~ 16 held a public hearing to consider said petition in the Council w 17 Chambers of the Auburn City Hall, on September 21, 1993, at 18 the conclusion of which the Hearing Examiner recommended the EM19 approval of the issuance of a Conditional Use Permit to allow .a ~ 20 shredding of wood waste on property located at 655 and 657 ~ ' 21 Second Street N.W., in a M-2. (Heavy Industrial) zone based ~ u 22 upon the following Findings of Faet and Conclusions, to-wit: r 23 . ~ 24 ~ ~ 25 ~ . d ~ . - . . . •.-1 CU ~ 26 ~ Ordinance No. 4641 October 12,1993 Page 1 1 FINDINGS OF FACT 2 3 1. The owner/applicant, RST Disposal, through it's agent, Rupert Engineering, Inc., requests a conditional use permit to allow shredding of wood waste. 4 5 2. The subject property is located at 655 and: 657 Second Street N.W. The property is zoned M-2, and is currently 6 being utilized for a solid waste recycle and transfer facility. The land in all directions of the vicinity is 7 zoned for heavy industrial uses. g 3. The applicant obtained a conditional use permit to allow for the development of a solid waste recycle and transfer 9 station which was approved 'in 1990. The previously approved conditional use permit did not anticipate a 10 shredding operation. Accordingly, since the applicant. . now wishes to utilize a chipper/shredder and a baler, an 11 additional conditional use permit is required. 12 4. A baler would be a machine which compacts and binds recyclable materials so that they can be stacked in ~ bales. The baler would not be used with the shredder and ~ 13 • Would replace an existing compactor within the processing ~ 14 building. -The baler is an incidental function of the ~ existing approved use and is not a part of this ~ 15 conditional use permit. C) 5. However, the proposed chipper/shredder is a new use. It ~ 16 is a portable machine which would be located on the 17 northwest portion of the site. The shredder is approximately 12 feet wide and 40 feet long and would,be ig transferred to the site in one piece by a semi-truck and trailer. 19 6. The purpose of the chipper/shredder is to shred scrap 20 wood from construction sites together with pallets, limbs, and branches. This type of wood is now being 21 received at the existing recycling plant either from the public hauling the material to the site or from the 22 public leaving it in recycling bins which are subsequently transported to the site by RST Disposal. 23 7. The applicant indicates that wood to be shredded would be 24 placed outside along side the machine. A grapple type device will place the wood into the grinding tub which is ` 25 approximately 12 feet in diameter. After shredding, the 26 Ordinance Na 4641 October 12,1993 Page 2 . • ' • . ~ 1 shredded material will be placed into a trailer via a 2 conveyor be1t., When the trailer is full, it wi11 trucked off-site. Since the shredder is proposed to be. located 3 outside of the building, particular coneern needs to be. paid to the issues of noise, air pollution, storm 4 drainage, and storage of wood. 5 8. The Zoning Ordinance at Section 18.58.020, requires when noise emanates, from premises it is to . be muffled so. as 6 not to become objectionable due to a number, of factors. The noise is not permitted to exceed the n.oise standards set forth in the Washington Administrative Code. 7 8 9. The City has regulations regarding visible emissions as well as the applicable regional and State agencies and 9 accordingly the possibility of dust and sawdust being emitted into.the air will be adequately addressed. 10 10. The amount `of wood waiting to be shredded should be 11 controlled in order to avoid potential fire danger, and also a hard surface should be required where the wood. 12 will be sitting in order to ensure proper storm'drainage control. ~ 13 pp 11. The evidence establishes that as a result of the shredder ~ the nature of the existing operation at the recycling q4 14 ' center will not change considerably. The company aceepts ~ 15 Wood now for recycling which is then trucked to other ~ locations to.be shredded. The: number of outgoing truck ~ 16 trips will be less since the wood can be shredded on- site. The traf;fic study done initially estimated 344 ~ 17 round trips per average week.day. Actual traffic counts condueted dur.ing the week of August 23 indicate an ig. average truck count of 154 round trips which is substantially under the traffic projections estimated for 19 the project initially. The largest employee shift is 24 persons which would result in 48 - round trips for 20 employees. Even considering the round trips which the : employees add, for a total for a total of 202, this is 21 substantially under the 344 round trips which were initially projected. 22 12. If properly conditioned, the conditional use permit can 23 enhance the goals of the Comprehensive Plan which seek to, , protect the public. health and safety by providing 24 efficient and cost effective water, sanitary sewer and solid waste services to the community while encouraging 25 recycling. 26 - - Ordinance.No. 4641. October 12,1993 Page 3 1 2 13. The.staff report, with its recommendation of conditional approval, is incorporated herein by reference as those set forth in full. 3 4 CONCLII$IONB.OF LAW 5 6 1. The Zoning Ordinance sets forth a series of criteria which must be established before a conditional use permit.. 7 ean be granted. The first,of-these criteria,is that the. 8 use will not have a more adverse affeet on the health, safety, or comfort of persons living or taorking in the 9 area than would any use generally permitted outright in the district. The M-2, Heavy Industrial, zone is intended for outside activities which are larger' in 10" nature. The sh'redder will not have an adverse impact on 11 adjoining properties if properly conditioned.. Some witnesses expressed concern regarding the noise;to be, 12 generated by the shredder. However, as a result of the ~ emissions. standards set forth in the Washington oD 13 Administrative Code the noise will have to be properly ~ controlled. ~ 14 2. The proposal is in accordance with the goaTs, policies, ~ and objectives of the Comprehensive `Plan which encourage ~ 15 efficient methods of waste reduction and promote C) 16 recycling. _ ~ 17 3. The proposal complies with all requirements of the Zoning Ordinance. 18 4. The proposal can be constructed and maintained so as to 19 be harmonious. and appropriate in design, character, and appearance with the existing or intended character of the : 20 vicinity since the previous CUP required landscaping and buffering which will help screen the use from adjacent 21 projects. 22 5. There is no evidence that the proposal will adversely affect the public infrastructure. 23 _24 For each , of the above referenced reasons, the. ' 25 recommendation of the Hearing Examiner to the Auburn City 26 Ordinance No. 4641 October 12,1993 Page 4 1 2 Council on this Conditional Use Permit to allow shredding of wood waste on property located at 655 and 657 Second Street 3 N.W., is approved. 4 NOW, THEREFORE, THE CITY COUNCIL OF TAE CITY OF AUBURN, 5 WASHIATGTON, DO ORDAIN AS FOLLOWS: 6 8ection 1. The above cited Hearing Examiner's Findings 7 of Fact and Conclusions, are herewith incorporated in this 8 Ordinance. 9 , Section 2. A Conditional Use Permit is hereby approved 10 to allow shredding of wood waste on property located at 655 11 12 and 657 Second Street N.W., in a M-2 (Heavy Industrial) zone, , ~ (Z) situate in the City of Auburn, County of King, State of U9 13 Washington, and is legally described in the attached Exhibit ; ~ 14 ~ np'n . ~ 15 ~ 16 Section 3. The shredder shall be limited to shredding 17 wood and wood products. 18 Section 4. The shredder, the storage area for the wood 19 to be.shredded, and the receiving trailer shall all be on a 20 Paved surface. 21 $ectioa 4. The material that has been shredded shall be , 22 placed directly into a trailer and removed from the site in 23 accordance with the time frame established by Section 4 of 24 Ordinance No. 4475. 25 26 Ordinanee No. 4641 October 12,1993 _ Page 5 L Section 5. The storage area for the wood to be shredded 2 shall be no larger than 25 feet by 25 feet. The material 3 shall be stacked no higher than 6 to 8 feet. 4 5 Section. 6. A"Notice of Construction" permit shall be approved by the Puget Sound Air Pollution Control Authority 6 (PSAPCA) prior to operation of the shredder. ? Section 7. Prior to the operation of the shredder, the 8 applicant shall.provide evidence to the Planning Director that 9 the shredder meets the noise limitations as outlined by WAC 10 173-60-040. ~ 11 V 12 Section 8. Prior to issuance of permits to allow paving, ~ the Public Works Director shall approve,a storm drainage/water ~ 13 ~ quality plan that addresses the operation of the shredder and ~ 14 ~ 15 the storage areas. ~ 16 Section 9. All conditions of Ordinance No. 4475 and the 17 Mitigated Determination of Non-Significance (SEP0044-90) shall 18 continue to apply. 19 Section 10. The shredder may operate on weekdays between 20 the hours of 8:00 a.m, and 5:00 p.m. 21 Section ii Upon the passage, approval and publication of 22 this Ordinance as provided by law,- the City Clerk of the City 23 of Auburn shall eause this Ordinance to be recorded in the 24 office of the King County Auditor: 25 26 Ordinance No. 4641 October 12,1993 Page 6 , ' • . ~ ' , . Section 12. The Mayor, is hereby authorized to implement 2 such administrative procedures as may be necessary to carry 3 out the directions of this legislation. 4 Section 13.
