3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING AN APPROPRIATION OF FUNDS AS PROVIDED IN
THE CONTRACT FOR 80CIAL SERVICES SETWEEN THE CITY AND THE
4 HOUSING AUTHORITY OF THE COUNTY OF KING FOR THE PERIOD
5 COMMENCING DECEMBER 1, 1993 AND ENDING.NOVEMBER 30,, 1994.
6 WHEREAS, the City Council of the City of A'uburn must
7 adopt and approve a11 appropriations by Ordinance pursuant to
8 Chapter 35A.33 RCW; and
9 WHEREAS, the King County Housing Authority has determined.
' 10 ~
a need exists for certain social services to be performed for
11 its residents but does not have the manpower or expertise to, -
12 perform.such services; and
13 WgEREAS, the Housing Authority desires to have the City
14 of Auburn perform such services.
15 NOW, THEREFORE, THE CITY.COUNCIL OF THE CITY OF AUBURN,
16 WASHINGTON, DO ORDAIN AS FOLLOWS:
17 Section 1. The Mayor and City Clerk of the City of
18 Auburn are authorized to execute a Contract for Social
19 Services between the City and the Housing Authority o€ the_
20 County of King pursuant to which the Housing Authority will
21 provide grant funding to the City of Auburn Police Department
22 to provide a fu11 time officer to be assigned to Green River '
23 Homes, Burndale Homes and Firwood Circle. A copy of said

the Housing Authority of the County of King for the period

Section 3. The Mayor is hereby authorized to implement

12 such administrative procedures as may be necessary to carry
out the directions of this legislation.

14 Section 4. This Ordinance shall take effect and be in
. 15 force five (5) days from and after its passage, approval and
- 16 Publication, as provided by law.

Contract Number D-4 CONTRACT FOR SOCIAL SIsRVICES
This Agreement is entered into by and between the Housing
Authority of the County of King, hereinafter referred to as the
"Housing Authority", and the Citv of Auburn, hereinafter referred
to as "the Agency", whose principal office is located at 15 North
Division, Auburn. WA 98002.
WHI3REA3, the Housing Authority has determined the need to
have certain social seryices performed for its residents but does
not have the manpower or expertise to perform such services, and
WHEREA3, the Housing Authority desires to have the Agency
perform such services pursuant to certain terms and conditions,
now, therefore,
IN CON3IDERATION -OF the mutual benefits and conditions
hereinafter contained, the parties hereto agree as follows:
1. Scove of Services to be Performed bv Aaencv. The
Agency sha11 perform those services. -descr.ibed on Exhibit" A
attached hereto and incorporated hereiri by this reference, as if
fully set forth. In performing such services, the agency shall at.
all times comply with all Federal, State and local statutes,
rules and ordinances applicable to the performance of such
services and the handling of any funds used in connection
herewith.
2. Compensation and Method of Pavment. The Housing
Authority shall pay the Agency for services rendered according to
the rate and method set forth on Exhibit B attached hereto and
incorporated herein by this reference. The total amount to be
paid shall not exceed 548,060.
3. Aaencv Budaet. The Agency shall apply the funds
received under this Agreement within the maximum limits set forth
in this Agreement and according to the budget itemized on Exhibit
B. The Agency shall request prior approval from the Housing
Authority whenever the Agency desires to amend its budget by
transferring funds among the budget categories.
4. Duration of Actreement. The Agreement shall be in full
force and effect for a.period commencing December 1, 1993, and
ending November 30, 1994, unless sooner terminated under the "
provisions hereinafter specified.

• . , . 5. Independent Contractor. Ageney and Housing Authority
agree the Agency is an independent Contractor with respect to the services provided pursuant to this Agreement. Nothing in this
Agreement sha11 be 'considered to create a relationship of
employer and employee between the parties hereto. Neither Agency , .
nor any employee of Agency shall be entitled to any benefits
accorded Housing Authority employees by virtue of the services
provided under this Agreement. The Housing Authority shall noG
be responsible for withholding or otherwise deducting federal
income tax or social security or contributing to the State
Industrial Insurance Program, or otherwise assuming the duties of
an employer with respect to the Agency, or any employees of the
Agency.
6. Indemnification. The Agency shall indemnify, defend and hold harmless the Housing Authority, its agents and
employees, •from and.against any and al.l liability arising from -
injury or death to persons or damage to property resul.ting in
whole or in part from acts or omissions of the Agency; its
agents, servants, officers or employees, irrespective or whether
in connection or such act.or omission it alleged or claimed that
an act of the Housing Authority, or its agents, or employees.
caused or contributed thereto. In the event that the Housing
Authority.shall elect to defend itself against any claim or suit
arising from such injury, death or damage, the Agency shall, in
addition to indemn'ifying and holding the Housing Authority
harmless from any liability, indemnify the Housing Authority for
any and a11 expenses incurred by tkie Housing Authority in
defending such claim or suit, including attorney's fees.
7. Insurance.
A. The Agency shall procure and maintain in full
force throughout the duration of this Agreement comprehensive
general liability insurance with a minimum coverage of $500,000.00 per occurrence/aggregate for personal injury and
property damage. Said policy shall name the Housing Authority of
the County of King as an additional named insured and shall:
include a provision prohibiting cancellation or reduction in the
amount of said policy except upon thirty. (30) days' prior written
notice to the Housing Authority. Cancellation of the required
insurance shall automatically result in termination of this
Agreement.

7. B. In addition to the insurance provided for in
Paragraph A above, the Agency shall maintain or insure, that its
professional employees or contractors maintain professional
liability insurance in the event that services delivered pursuant
to this Agreement, either directly or indirectly, involve
providing professional services. Such professional liability
insurance shall be maintained in an amount not less than
$500,000.00 combined single limit per claim/ aggregate. For the
purpose of this paragraph "professional services" shall mean any
services provided by a physician, licensed psychologist, or other
licensed professional.
C. Certification of coverage as required by
Paragraphs A and B above shall be delivered to the Housing
Authority within fifteen (15) days of execution of this
Agreement.
8. Record Keepina and Reportinct
A. The Agency shall maintain accounts and records,
including p.ersonal, property, financial and programmatic records
which sufficiently and properly reflect all direct and indirect
costs of any nature expended and services performed in the
performance of this Agreement and other such records as may be
deemed necessary by the Housing Authority to ensure proper
accounting for all funds contributed by the Housing Authority to
the performance of this Agreement and compliance with th,is
Agreement.
B. These records shall be maintained for a period of
seven (7) years after termination hereof unless permission to
destroy them is granted by the office of the archivist in
accordance with RCW Chapter 40.14 and by the Housing Authority.
C. The Ageney shall submit monthly program
accomplishment reports (Exhibit C) which compare actual vs.
projected accomplishments and expenditure rates. Projected
performance measures and expenditure are listed on Exhibit C.
This report shall be submitted monthly, along with the Agency's
request for reimbursement which shall be submitted on Agency
letterhead.

. , , . 9. Audits and Inspection. The records and documents with
respect to all matters covered by this Agreement shall be subject
at all times to inspection, review or audit by the Housing
Authority or any other government agency so authorized by law
during the performance of this Agreement. The P,gency shal.l
provide The Housing Authority with a copy of the Agency's year
end financial statement. The Housing. Authority shall have the
right to an annual audit of the Rgency's financial statement.and
condition.
10. Termination. This agreement may at any time be
terminated by the Housing Authority giving the Agency thirty (30)
days written notice of` the Housing Authority's intention to
-terminate the same. If the Agency's insurance coverage is.
canceled for,any reason, the Housing Authority shall have.the
right to terminate this Agreement.
11. Discrimination Prohibited. The Agency shall not
discriminate against any employee, applicant for employment, or
any person seeking the services of the Agency to be provieled
under this Agreeinent on the basis of race, color, religion,
creed, sex, age, national origin, mental status or the presence
of any sensory, mental or physical handicap.
12. Assianment and Subcontract. The Agency shall not
assign or subcontract any portion of the service contemplated by
this Agreement without the written consent of the Housing
Authority.
13. Entire Actreement. This agreement contains the entire
Agreement between the parties hereto and no other Agreements,
oral or otherwise, regarding the subject matter of the parties
hereto. Either party may request changes in the Agreement.
Proposed changes which are mutually agreed upon shall be
incorporated by written amendments to this Agreement.

EXHIBIT A-- SCOPE OF WORK .
Scope of Services to be Provided by Acrencv: The agency sri:all
furnish the residents of the Housing Authority of the County of
Kirig communities of Green River Homes; Burndale Homes, and.
Firwood Circle, drug elimination services including, but. not
liinited to, the following:
Law enforcement services provided by the City of Auburn Police-
Department to include:
A full-time Police Officer will be assigned to Green Riber Homes,
Burndale Homes, and Firwood Circle to be stationed at Green River.
Homes The substation will be staffed with visible police officer
p"resenee at least 40 hours per week. The officer's proposed work
schedule will be provided to the Housing Authority Area Manager
and the Officer will provide the Area Manager schedule revisions
as necessary.

Invoice: The Agency sliall submit an invoice to ihe I-iousing Authority ten days after the
close of each month. The invoice format is attached and labeled in Exhibit C-1.
Client Data Renort: For each service category as defined in this Agreement, the Agency
shall submit a"Client Data Report: within ] 0 working days after the end of each calendar

time to time to monitor contract progress.
