Background Summary: In November 2006, the Pierce County Regional Council (PCRC) requested proposals to develop countywide affordable housing implementation plan and recommend new countywide affordable housing policies. Pacific Municipal Corporation (PMC) was the selected consultant to work with Pierce County on developing these policies. Pierce County received a grant from Department of Commerce (formerly CTED) to update the affordable housing distribution and the Countywide Planning Policies (CPPB) for the cities and towns and the County. Affordable housing policies have been part of initial CPPs. PMC worked with the Growth Management Coordinating Committee (GMCC), a staff level committee in which Auburn is involved, in developing recommended amendments to the CPPs to address affordable housing. This work began in December 2006 and continued through month 2007. During March 2007, PCRC held three workshops on affordable housing and took feedback on how the policies should be shaped. The GMCC continued work on the draft policy amendments to the CPP and provided a recommendation to the PCRC August 2008. The PCRC. began their review of the draft policy amendments September 2008. On May 21, 2009 the PCRC recommended adoption of the proposed amendments to the CPPs with a technical amendment made on July 16, 2009. The Pierce County Council took action on the amendments to the CPPs on February 16, 2010. The proposed amendments revise the definitions; state that jurisdictions should consider meeting affordable housing needs through innovative techniques, availability of services, and incentives; and jurisdictions should explore various opportunities. Jurisdictions do not have the ability to make line item modifications; this is a pass or fail policy choice. B.2 AUBURN MORE THAN You IMAGINED RESOLUTION NO. 14 6 4 2 A RESOLUTION OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND AUTHORIZING EXECUTION OF AN INTERLOCAL AGREEMENT WITH PIERCE COUNTY, THEREBY AMENDING THE PIERCE COUNTY COUNTYWIDE PLANNING POLICIES WHEREAS, on July 1, 1990, the Growth Management Act (the GMA) became effective (Chapter 36.70A Revised Code of Washington); and WHEREAS, on January 31, 1995, the Pierce County Council passed Resolution R95-17 affirming the commitment of the County to continue discussions with other local jurisdictions to resolve Implementation of the Growth Management Act; and WHEREAS, the Growth Management Act requires Counties, Cities and Towns to plan for housing affordable to all economic segments of the population; and WHEREAS, the Pierce County Countywide Planning Policies are written policy statements which are to be used solely for establishing a countywide framework from which the County and Municipal comprehensive plans are developed and adopted; and WHEREAS, Pierce County initially adopted its initial Countywide Planning Policies on June 30, 1992 and affordable housing policies are a component of the initial Pierce County Countywide Planning Policies; and WHEREAS, in November 2006, the Pierce County Regional Council solicited proposals to formulate countywide affordable housing implementation plan and recommend new countywide affordable housing policies; and WHEREAS, a series of public workshops were conducted over a three-day period in March 2007, soliciting input for the countywide affordable housing strategy; and Resolution No. 4642 September 7, 2010 Page 1 of 3 WHEREAS, recommendations for a countywide affordable housing strategy from the consulting firm of Pacific Municipal Consulting (PMC) was published on June 15, 2007; and WHEREAS, the City participated in the amendment process and helped develop the proposed Pierce County Countywide Planning Policies through participation in Pierce County's Growth Management Coordinating Committee (GMCC); and WHEREAS, the GMCC is a staff level committee that reviews amendments to the Pierce County Countywide Planning Policies and makes recommendations to the Pierce County Regional Council; and WHEREAS, the Pierce County Regional Council recommended adoption of the proposed amendments to the Pierce County Countywide Planning Policies on July 16, 2009; and WHEREAS, amendments to the Pierce County Countywide Planning Policies must be adopted. through amendment of the original interlocal agreement or by a new interlocal agreement ratified by 60 percent of member jurisdictions in Pierce County representing 75 percent of the total population; and WHEREAS, an interlocal agreement titled "Amendments to the Pierce County Countywide Planning Policies " was developed for this purpose, and attached to the recommended amendments. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN HEREBY RESOLVES as follows; Section 1. The amendments to the Pierce County Countywide Planning Policies are attached as Exhibit A to this Resolution. Resolution No. 4642 September 7, 2010 Page 2 of 3 Section 2. The interlocal agreement is hereby acknowledged and accepted by the city of Auburn, thereby amending the Pierce county countywide Planning Policies in accordance with the requirements of the Interlocal cooperation Act of 1967, Chapter 39.34 RCW. Section 3. That a copy of the resolution and signed interlocal agreement authorizing approval shall be provided to Pierce county. Section 4. That the Mayor is authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 5. Exhibit A to Resolution No. 4642 Proposed Amendments to the Countywide Planning Policies. for Pierce County, Washington Exhibit A Resolution No. 4642 Page 1 of 8 COUNTYWIDE PLANNING POLICY ON THE "NEED FOR AFFORDABLE HOUSING FOR ALL ECONOMIC SEGMENTS OF THE POPULATION AND PARAMETERS FOR ITS DISTRIBUTION" ■ Background - Requirement of Growth Management Act The Washington Growth Management Act identifies as a planning goal to guide the development and adoption of comprehensive plans and development regulations that counties and cities encourage the availability of affordable housing to all economic segments of the population, promote a variety of residential densities and housing types, and encourage preservation of the existing housing stock. [RCW 36.76A.626(4)] The term "affordable housing" is not defined, but the context in which it appears suggests that its meaning was intended to be broadly construed to refer to housing of varying costs, since the reference is to all economic segments of the community. The Washington Growth Management Act also identifies mandatory and optional plan elements. [RCW 36.70A.070 and .0801. A Housing Element is a mandatory plan element that must, at a minimum, include the following [RCW 36.70A.070(2)]: Exhibit A Resolution No. 4642 Page 2 of 8 Since the Comprehensive Plan of every city and county must be an internally consistent document [RCW 36.70A.070] and all plan elements must be consistent with the future land use map prepared as part of the required land use element [RCW 36.70A.070], these other plan elements will, to a great extent, dictate what will be in the housing element. Thus, the land use element, relying upon estimates of future population, growth, average numbers of persons per household, and land use densities, will indicate how much (and where) land needs to be made available to accommodate the identified housing needs. The capital facilities, transportation and utilities elements will then indicate when and how public facilities will be provided to accommodate the projected housing, by type, density and location. ■ Countywide Planning Policy 1. 17 Authorizing the Pierce County Executive to Execute an 18 Interlocal Agreement(s) with the Cities and Towns of Pierce 19 County to Ratify the Proposed Amendment; and Adopting 20 Findings of Fact. 21 22 Whereas, the Pierce County Regional Council (PCRC) was created in 1992 by 23 interlocal agreement among the cities and towns of Pierce County and Pierce County, 24 and charged with responsibilities, including: serving as a local link to the Puget Sound 25 Regional Council, promoting intergovernmental cooperation, facilitating compliance with 26 the coordination and consistency requirements of the Growth Management Act and the 27 Regional Transportation Planning Organization (Chapter 47.80 Revised Code of 28 Washington [RCW]), and developing a consensus among jurisdictions regarding the 29 development and modification of the Pierce County Countywide Planning Policies; and Whereas, the Growth Management coordinating committee reviewed PMC's recommendation and forwarded its recommended modifications to the Pierce county Regional Council; and Whereas, the Pierce county Regional council conducted negotiations in open public meetings during 2007, 2003, and 2009 to address substantive policy changes necessary to respond to current issues related to the coordination and consistency with the GMA; and Whereas, the Pierce county Regional council subsequently recommended adoption of the proposed amendments to the Pierce county countywide Planning Policies on May 21, 2009, which address policy updates; and Whereas, on July 10, 2009 the Pierce county Regional council approved a technical amendment to its May 21, 2009 recommendation; and Whereas, amendments to the Pierce county Countywide Planning Policies must be adopted through amendment of the original interlocal agreement or by a new interlocal agreement ratified by 50 percent of member jurisdictions in Pierce county representing 75 percent of the total population; and Whereas, an Interlocal Agreement entitled "Amendments to the Pierce county Countywide Planning Policies" was developed for this purpose, and included the recommended amendments to the Pierce county countywide Planning Policies as an attachment; and Whereas, the Pierce County Planning Commission, at its September 22, 2009, regular public hearing, reviewed the proposed amendments to the Pierce County Countywide Planning Policies and recommended approval; and Whereas, an environmental review of the proposed amendments to the Pierce County Countywide Planning Policies was conducted pursuant to RCW 43.21 C and an Determination of Nonsignificance was issued on November 16, 20091 and Whereas, after a properly noticed public hearing, the Community Development Committee of the County Council considered oral and written testimony and forwarded its recommendation to the full Council; and Whereas, the County Council held a public hearing on February 16, 2010 where oral and written testimony was considered; and Whereas, the County Council finds that it is in the public interest to authorize the Pierce County Executive to execute the interlocal agreement; Now Therefore, BE IT ORDAINED by the Council of Fierce County: Section 1. The Pierce County Council hereby acknowledges its approval of the amendments to the Pierce County Countywide Planning Policies recommended by the Pierce County Regional Council, which are attached hereto as Exhibit A and incorporated herein by reference. Section 2. The Pierce County Executive is hereby authorized to execute the Interlocal Agreement, attached hereto as Exhibit B and by this reference incorporated herein, thereby ratifying the attached amendments to the Pierce County Countywide Planning Policies as recommended by the Pierce County Regional Council. [RCW 36.70A.020(4)] The term "affordable housing" is not defined, but the context in which it appears suggests that its meaning was intended to be broadly construed to refer to housing of varying costs, since the reference is to all economic segments of the community. The Washington Growth Management Act requires the adoptiM.of countywide planning policies for affordable housing in order to establish a consistent uptY-gide. framework from which county and city comprehensive plans are developed and adopted. These: policies are required to, at a minimum, `consider the need.four. affordable housing, : such as housing for all economic segments of the population and parameters for its distribution' [RCw 36.70A.210(3)(e)]. The Washington Growth Management Act also identifies mandatory and optional plan elements. [RCW 36.70A.070 and .080]. A Housing Element is a mandatory plan element that must, at a minimum, include the %]lowing [RCW 36.70A.070(2)1: (a) an inventory and analysis of existing and projected housing needs that identifies the number of housing units necessary to manage projected .:growth, (b) a statement of goals, policies and objectives and mandatory provisions for the preservation, improvement and development of housing, including single-family residences, (c) identification of sufficient land for housing, including, but not limited to, government - assisted housing, housing for low income families, manufactured housing, multi -family housing, group homes, and foster care facilities, QML.L.&&A^I%WI%J ? ` 13 A adequate provisions for existing and projected housing needs of all economic segments of the community. Since the Comprehensive Plan of every city and county must be an internally consistent document [RCW 36.70A.070] and all plan elements must be consistent with the future land use map prepared as part of the required land use element[RCW 36.70A.0701, these other plan elements will, to a great extent, dictate what will be in the housing element. This agreement is made pursuant to the provisions of the Interlocal Cooperation Act of 1967, Chapter 39.34 RCw. This agreement has been authorized by the legislative body of each urisdiction pursuant to formal action and evidenced by execution of the signature page of this agreement. BACKGROUND: �. The Pierce County Regional Council (PCRC) was created in 1992 by interlocal agreement among the cities and towns of Pierce County and Pierce County. The organization is charged with responsibilities, including: serving as a local link to the Puget Sound Regional Council, promoting intergovernmental cooperation, facilitating compliance with the coordination and consistency requirements of the Growth Management Act (Chapter 36.70A RCS') and the Regional Transportation Planning Organization (Chapter 47.80 RCW), and developing a consensus among jurisdictions g . regarding the development and modification of the Countywide Planning Policies. B. The Pierce County Countywide Planning Policies provide for amendments to be adopted through amendment of the original interlocal agreement or by a new interlocal agreement. The Pierce County Countywide Planning Policies may be amended upon the adoption of amendments by the Pierce County Council and ratification by 60 percent of the jurisdictions in Pierce County (13 of 20) representing 75 percent of the total Pierce County population as designated by the State Office of Financial Management at the time of the proposed ratification. C. Substantive policy amendments are based on a comprehensive review and update to the Affordable Mousing Countywide Planning Policies by the Pierce County Regional. Council. D. The Pierce County Regional Council conducted discussions in open public meetings in 2007, 2008, and 2009, to address the amendments. On January 31, 1995, the Pierce County Council passed Resolution No. R95-17 21 affirming the commitment of the County to continue discussions with other local 22 jurisdictions to resolve implementation of the Growth: Management Act. 23 24 3. The Growth Management Act required Pierce County to adopt a county -wide 25 planning policy in cooperation with the cities and towns located within the 28 County. 27 28 4. The Countywide Planning Policies are to be used for establishing a county -wide 29 framework from which the comprehensive plans for Pierce County and the cities 30 and towns within Pierce County are developed and adopted. 31 32 5. On June 30, 1992, the Pierce County Council passed Ordinance No. 92-74 33 adopting the Pierce County Countywide Planning Policies. 34 35 5. The Pierce County Countywide Planning Policies include provisions addressing 35 the "Need for Affordable Housing for all Economic segments of the Population 37 and Parameters for its Distribution.,, 38 39 7. The Pierce County Countywide Planning Policies include provisions addressing 44 procedures for amending the Countywide Planning Policies. 41 42 8. The Pierce County Countywide Planning Policies require amendments to the 43 Countywide Planning Policies to be adopted through an amendment of the 44 original Inter -Local Agreement or by a new inter -local agreement. The 45 amendment will become effective when sixty percent (60%) of the cities, towns 46 and County government representing seventy-five percent (75%) of the total 47 population as designated by the state office of Financial Management at the 48 time of the proposed ratification become signatories to the agreement. The Pierce County Countywide Planning Policies states the policies may be 2 initiated by the County, any city or town, or by the Pierce County Regional 3 Council. 4 5 10. Median home prices in Pierce County, from 1999 through the second quarter of 6 2009, increased by over 09 percent or approximately $90,000, while median 7 annual family income rose by about 40 percent or less than $20,000 per year. 8 9 11. The Pierce County Housing Affordability Task Force and the Pierce County 10 Housing and Community Development Consolidated Plan, using data provided 11 by HUD, have identified a shortage of approximately 30,000 units of affordable 12 housing for all economic segments of Pierce County's population. 1.3 14 12. The Pierce County Regional Council, through Pierce County Planning and Land 15 Services, received a grant from the Washington state Department of Community, 16 Trade, and Economic Development to develop a countywide affordable housing 17 implementation plan. 18 19 13. The Pierce County Regional Council, in November 2000, solicited proposals to 20 formulate a countywide affordable housing implementation plan and recommend 21 new countywide affordable housing policies. 22 23 14. The Pierce County Regional Council sponsored a series of public workshops in 24 March 2007 soliciting input for the countywide affordable housing strategy. 25 26 15. Recommendations for a countywide affordable housing strategy from the 27 consulting firm of PMC were published on June 15, 2007. 28 29 15. The Growth Management Coordinating Committee reviewed the consultant's 36 recommendation and forwarded its recommended modifications to the Pierce 31 County Regional Council. 32 33 17. The PCRC conducted negotiations in open public meetings during 2007, 2008, 34 and 2009 to address the proposed amendments to the Affordable Housing 35 section of the Countywide Planning Policies. 36 37 18. The PCRC recommended adoption of proposed amendments to the Pierce 38 County Countywide Planning Policies on May 21, 2009. 39 40 19. An environmental review of the proposed amendments to the Pierce County 41 Countywide Planning Policies was conducted pursuant to RC's 43.21 C and a 42 Determination of Nonsignificance (DNS) was issued on November 10, 2009. 43 44 20.
