' . . . . , 1 ~ RESOLUTION NO. 2 7 5 8 - 2 3 A.RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE CITY OF AUBURN MUNICIPAL AIRPORT 4 SUPERVISOR TO SELL AT PUBLIC AUCTION ONE AIRCRAFT DESCRIBED AS 5 ONE CESSNA 152 II, REGISTRATION N69189, SERIAL NUMBER 15282539 FOR OUTSTANDING' RENTAL, TITLE SEARCH FEE, AIRCRAFT APPRAISAL 6. FEE AND PUBLIC NOTICE EXPENSE TOTALING THREE THOUSAND NINE HUNDRED SEVENTY-THREE DOLLARS AND FORTY-ONE CENTS ($3,973.41). 7 , 8 WHEREAS, the City of Auburn established the Auburn. 9 10 Municipal Airport by Ordinance No. 2396 in 1969; and 11 WHEREAS, the City of Auburn Municipal Airport provicles 12 aircraft tie-downs space on a lease basis pursuant to RCW - 13 14.08.122 as adopted by City of Auburn Ordinance No. 4731; and 14 WHEREAS, that Dale Giddings and the City of Auburn 15 16 Municipal Airport entered in to an aircraft tie-down lease 17 agreement on August 1, 1985 for the purpose of payment by Dale 18 Giddings of a tie-down fee in exchange for the City of Auburn 19 Municipal. Airport providing to Dale Giddings tie-down space 20 AT-19 for one aircraft; and 21 ' 22 WHERE.AS, that as of June 7, 1995 the tie-down lease fee - 23 owed by Dale Giddings on tie-down space AT-19 was in exce,ss of 24 60 days delinquent; and 25 26 Resolution No. 2758 November 22, 1996 - - Page 1 L ' 1 WHEREAS, the City of Auburn Municipal Airport Supervisor 2 began the statutory 180 day waiting period before instituting 3 . 4 legal proceedings to hold a public auction for sale of one 5 aircraft belonging to Dale Giddings for satisfaction of 6 delinquent lease payments on tie-down space AT-19 and 7 , reasonable costs incurred; and 8 , WHEREAS, the City of Auburn. Municipal Airport Supervisor 9 10 has provided notice to Dale Giddings pursuant to RCW 14.08.22 11 and Auburn City Code 12.56.048; and 12 WHEREAS, the City of Auburn Municipal Airport Supervisor 13 has not received a response from Dale Giddings to the notice 14 provided to Dale Giddings pursuant to RCW 14.08.122 and Auburn. 15 16 City Code 12.56.048. 17 NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL 18 OF THE CITY OF AUBURN, WASHINGTON AS FOLLOWS: 19 Section 1. The Supervisor of the City of Auburn 20 Municipal Airport is hereby authorized to commence proceedings 21 22 to hold a public auction of one Cessna 152 II, Registration 23 N69189, Serial number 15282539 by taking the following action 24 before the aircraft is sold: 25 26 Resolution No. 2758 November 22, 1996 Page 2 ~ . 1 A. Provide the owner of the aircraft at least 2 twenty days' notice of sale by registered 3 , 4 mail,.return receipt requested and notice 5 of sale shall be published at least once, 6 more than ten but less than twenty days 7 before the sale, in a_ newspaper of general 8 circulation utilized by the City of Auburn 9 10 as its method of legal publication; and ~ 11 B. That notice shall include the name of the 12 aircraft, if any, its aircraft 13 identification number; the last known 14 owner and address, the time and place of 15 16 the sale, a reasonable description of the 17 aircraft to be sold and that the airport 18 operator may bid all or part of its 19 airport charges at the sale and may become 20 21 a purchaser at the sale. Additionally, 22 that the minimum bid that can be accepted ; 23 is Three- Thousand Nine Hundred Seventy- 24 three Dollars and Forty-one Cent.s 25 26 Resolution No. 2758 November 22, 1996 Page 3 1 ($3,973:41) U.S. currency, and that the 2 successful,bidder must submit payment by 3 - 4 cash or cashier's check within 24 hours of 5 the bid award to the City of Auburn 6 Finance Department. , Possession of the 7 . Cessna 152 II, Registration N69189, Serial g , Number 15282539 will only be provided upon 9 10 full payment by the successful bidder 11 having been received by the City of Auburn 12 Finance Department. 13 Section' 2. The proceeds of the sale shall first be 14 " applied to payment of airport charges owed, then title search 15 - 16 fee, aircraft appraisal fee and public notice expenses. The 17 balance; if any, sha11 be deposited with the Department of ig Revenue to be held in trust for the owner or owners and 19 . lienholders for a period of one year. 20 Section 3.
