BETWEEN 22nd AND 18th STREETS N.E., WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-2 WITH A CONDITIONAL USE PERMIT TO R-2 WITH AN AMEtiDED CONDITIONAL USE PE RMIT. WHEREAS, a petition dated February 10, 1977, together with plot plans and exterior elevations therefor, has been submitted to the Council of the City ~ of Auburn, by DOPd KIRKMAN, DAVID HENSEL and SILL BELLES, requesting an R-2 with Q an Amended Conditional Use Permit, which would allow for the construction of a ~ ~ retirement home and day care facility situated on "M" Street N.E. between 22nd ~ and 18th Streets N.E., within the City of Auburn, Washington, which property hereinafter described in Section 1 of this ORdinance and which property presently carries an R-2 (Residential) with a Conditional Use Permit classification; and WHEREAS, said request above referred to was referred by the City Council to the City Planning Commission for study and public hearing thereon; and WHEREAS, the Planning Commission held a public hearing to consider the request in the City Hall of the City of Auburn, at 7:30 P.M. on March 8, 1977, and subsequent thereto the City Planning Commission approved the issuance of the rezoning from R-2 with a Conditional Use Permit to R-2 with an amended Conditional Use Permit, finding that the proposed use illustrated by the site development plans of the petitioners would not be unduly detrimental to the adjacent and surrounding properties and the enjoyment thereof; and WHEREAS, the City Council of the City of Auburn held a public hearing to consider said petition in the City Hall of the City of Auburn at 8:00 P.M. on April 4, 1977, at the conclusion of which the City Council concurred with the recommendations of the Planning Commission as hereinabove stated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Ordi nance No. 3172 4-6-77 Page One , _ . . . . _ Section 1. That an R-2 with an amended Conditional Use Permit be granted for the purpose of constructing a retirement home and day care facility located on "M" Street N.E. between 22nd and 18th Streets N.E., situated within the City of Auburn, and legally described as follows: PARCEL 2: The N 158.58' of the S 347.16' of the property beg at a pt in Sec 7, Twp 21 N, R 5 EWM, which is 50 rds (825') W of the iVE cor of the S 1/2 of the DLC of the heirs at law of William H. That "M" Street Northeast abutting the site be improved to a 44 foot roadway including curbs, sidewalk, street lighting, etc. A11 constructed to City standards by L.I.D. or other means. , Section 3. That if the vacant area lying in the northwest corner of the site is developed beyond what is shown on the site plan, additional right-of- ~ way will have to be dedicated to provide a 50 foot right-of-way for 21st St. ~ ~ N.E. This street will have to be improved by L.I.D. or other means. ~ ~ Section 4. That only the buildings and future expansions as shown on ~ the plot plan be constructed. Any additional buildings and/or additions will require an amendment to the existing permit after public hearing thereon by the Planning Commission and the Auburn City Council. Section 5. That the City Clerk of the City of Auburn is hereby authorized and directed to file a certified copy of this Ordinance with the King County Auditor's Office. Section 6. That this Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
