Ct1') N co WHEREAS, a petition dated May 4, 1977, together with plot plans and exterior elevations therefor has been submitted to the Council of the City of Auburn, by LLOYD ENTERPRISES, INC., requesting an amendment to an existing Special Property Use Permit for gravel rerboval to allow the installation and operation of a portable asphalt plant on a parcel of land 40 acres in size lying southerly and westerly of the end of 15th Street Northwest, Auburn, King County, Washington, which property hereinafter described in Section 1 of this Ordinance; and WHEREAS, said request above referred to was referred by the City Council to the City Planning Commission for study and public hearing thereon; and WHEREAS, the Planning Commission held a public hearing to consider the request in the Les Gove Park Community Center Building at 7:30 P.M. on June 7, 1977, and subsequent thereto the City Planning Commission approved the issuance of the amendment of the existing Special Property Use Permit, finding that the proposed use illustrated by the site development plans of the petitioner would not be unduly detrimental to the adjacent and surrounding properties and the enjoyment thereof; and WHEREAS, the City Council of the City of Auburn held a public hearing to consider said petition in the Auburn School District Board Room at 8:00 P.M. on July 5, 1977, at the conclusion of which the City Council concurred with the recommendations of the Planning Commission as hereinabove stated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: ' Ordinance No. 3791 Page One . . 7-26-77 . ~ . • . , Section 1. That an amendment to the existing Special Property Use Permit be granted for the purpose of gravel removal to allow the installation and operation of a portable asphalt plant on a parcel of land 40 acres in size lying southerly and westerly of the end of 15th Street Northwest, located on the following described property, to-wit: ~ NW 1/4 of the SE 1/4 of Section 11, Twp 21 N, R 4 Et~M, ~ situated in the City of Auburn, County of King, State ~ of Washington. ~ Section 2. That the permit for the operation of the asphalt plant expire ~ ~ on the same date as the permit to mine gravel (City Ordinance No. 2835). Section 3. That the location of the asphalt plant be subject to the approval of the City of Auburn's Planning & Community Development Committee. A request for location approval shall include the following: A plot plan showing the location of the following: 1. Asphalt plant. 2. Landscape berms. 3. Settling ponds. 4. Haul route from plant to public streets. 5. Crushing plant and other structures. Section 4. That certification from the Environmental Protection Agency, the Puget Sound Air Pollution Control Commission and the State Department of Ecology be submitted to the City of Auburn Planning Department within thirty (30) days after the plant is put into operation certifying that all local, state and federal environmental standards are met and that the operation remain in compliance with all local, state and federal environmental standards. Section 5. That approval from the Auburn Fire Department is secured regarding fire protection prior to operating the plant. Section 6. That the conditions as outlined under Section 2, Ordinance No. 2835 be complied with pertaining to hours of operation, sound pressure levels, inspections, haul routes, etc. Section 7. That the portable asphalt plant have a maximum output of not more than 125 tons per hour. Ordinance No. 3191 Page Two - 7-26-77 . . ~ - . Section 8. That if the plant site is moved on the site, the new location shall be subject to the approval of the City Council Planning & Community Development Committee. . 5ection 9. That the City Clerk of the City of Auburn is hereby authorized and directed to file a certified copy of this Ordinance with the King County Q4 Auditor's Office. ~ Section 10.
