AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF
A PARCEL OF LAND LOCATED AT 123 "L" STREET N.E., SITUATE WITHIN
~ THE CITY OF AUBURN, WASHINGTON, CHAWGING THE ZONING CLASSIFICATION
THEREOF FROM R=3 TO A CQNDITIONAL USE PERMIT.

U9 WHEREAS, a petition dated June 16, 1977, together with plot plans and
cu
~ exterior elevations therefor, has been submitted to the Council of the City of
Auburn, by ST. MATTHEW EPISCOPAL CHURCH, requesting a Conditional Use Fermit,
which would allow the operation of a child day care center in the existing St.
Matthew Episcopal Church located at 123 "L" Street N.E., within the City of
Auburn, Washington, which property hereinafter described in Section 1 of this
Ordinance and which property presently carries an R-3 (Duplex) classification; and
WHEREAS, said request above referred to was referred 6y the City Council
to the City Planning Commission for study and public hearing thereon; and
WHEREAS, the Planning Commission held a public hearing to consider the
request at the Les Gove Park Building in the City of Auburn, at 7:30 P.M. on
July 6, 1977, and subsequent thereto the City Planning Commission approved the
issuance of the rezoning of R-3 (Duplex) to a Conditional Use Permit, finding
that the proposed use illustrated by the site development plans of the petitioner
would not be unduly detrimental to the adjacent and surrounding properties and
the enjoyment thereof; and
WHEREAS, the City Council of the City of Auburn held a public hearing to
consider said petition in the temporary Council Chambers at the Auburn School
District Administration Building at 8:00 P.M. on August 1, 1977, at the conclusion
of which the City Council concurred with the recommendations of the Planning
Commission as hereinabove stated;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That a Conditional Use Permit 6e granted for the purpose of
operating a child day care center in the existing St. Matthew Episcopal Church

located at 123 "L" Street N.E., and legally described as follows:
Lots 1, 2, 3& 4, Blk 2 of Thomas G. Sutherland lst.
Add. to Auburn, Vol 42 of Plats, pg 41 and;
. Lots 1, 4, 5, 6, 7& E 1/2 of Lot 8, Blk 3 of David
ty A. Botting 2nd Add. to Auburn, Vol 41 of plats, pg 26;

Said above described property is situated in Section 18,
Twp 21 N, R 5 EWM, City of Auburn, County of King, State
of Wash.
~ in accordance with the plot plans and exterior elevations for said development
submitted with the request for Conditional Use Permit, a copy of which is attached
hereto, designated Exhibit "A" and by this reference made a part hereof as though
set forth in full herein.
Section 2. That a screen fence shall be installed around the play
area.
Section 3. That all state and local permits are secured and copies filed
, with the Building Department prior to opening of the day care center.
Section 4. That the City Clerk of the City of Auburn is hereby authorized
and directed to file a certified copy of this Ordinance with the King County
Auditor's Office.
Section 5. That this Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by law.
