AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING
FOR THE VACATION OF STREET RIGHT-OF-WAY SITUATED 12 FEET IN
FRONT OF 1635 8TN STREET iVORTHEAST, SITUATE WITHIN THE CORPORATE
LIMITS OF THE CITY OF AUBURN, WASHINGTON.

~ WHEREAS, the City Council of the City of Auburn, have passed and adopted
~ Resolution No. 805, resolving that a public hearing shall be had for the purpose
f.,. of determining whether or not the hereinafter described street right-of-way
f*-
located 12 feet in front of 1635 8th Street Northeast, within the corporate
limits of the City of Auburn, shall be vacated, said portion to be vacated
being hereinafter legally described in Section 1 of this Ordinance; and
WHEREAS, notice of public hearing to vacate the portion of a certain
street right-of-way located in front of 1635 8th Street Northeast, lying within
the corporate limits of the City of Auburn, in the time and manner provided by
law, giving notice that the hearing on said Resolution No. 805 was to be held on
the lst day of August, 1977, at 8:00 P.M. in the temporary Council Chambers at
the Auburn School District Administration Building, in the City of Auburn, no
objections thereto were filed with the City Clerk or presented to the City Council
at said hearing;.and
WHEREAS, the City Council, having deemed that the petition for vacation was
proper and that no vested rights would be affected by the same;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That the following described portion of a certain street right-
of-way located in front of 1635 8th Street Northeast, within the corporate limits
of the City of Auburn, Washington, and more particularly described as follows:
That portion of Reserve No. 1 in the plat of C.D. Hillman's
Auburndale Division No. 1 as recorded in Volume 13 of Plats,
page 62, Records of King County, described as follows:
Be.ginning at the S.W. corner of Section 8, Township 21 North,
Range 5 EWM; thence east along the south line of said Section
30.00 feet; thence north parallel to the east line of said
Section 30.00 feet to the true point of beginning; thence

continuing north 12.00 feet; thence east parallel to the
south 7ine of said Section 95.00 feet; thence south parallel
- to the east line of said Section 12.00 feet; thence west to
the true point of beginning; situated in the City of Auburn,
King County, Washington.
, be and the same is hereby vacated, and the property lying in said portion of
. a certain street right-of-way described hereinabove, shall be returned and
belong to the abutting property owners of said portion of a certain street

~ right-of-way located 12 feet in front of 1635 8th Street Northeast, lying
~ : within the corporate limits of the City of Auburn.
Section 2. That the request for vacation of street right-of-way be granted
subject to a public utility easement to be retained over and across, upon and
underneath the entire site for ingress and egress for the purpose of installing,
laying and maintaining all public utilities and that no perm anent structures be
constructed upon the portion of righ.t-of-way vacated.
' Section 3. Upon the passage, approval and publication of this Ordinance,
the City Clerk shall cause a certified copy of this Ordinance to be recorded in
the 'office of the King tounty Auditor.
Section 4. That this Ordinance shall take effect and be in force five
(5) days from and after its passage, approval and publication, as provided by law.
