Approve Right-of-Way Use Permit 10-25 for Girl Dog Inc hotdog cart.
Background Summary:
Girl Dog Inc. has applied for a One-Year Right-of-Way Use Permit to be able place and operate a mobile
hotdog cart in the right-of-way on Main Street. The applicant plans to operate the cart and sell a variety
of gourmet hotdogs with assorted condiments as well as soda, coffee and an assortment of chips. The
cart hours would be Tuesday - Friday from 11:00 am to 2:00 pm year round in one permitted location.
The cart would be towed to and from the approved location each day with the applicant's personal vehicle
and then manually pushed into place. The applicant's vehicle would be parked in an appropriate garage
or lot during the cart's operation.
City staff has worked with the applicant to identify four possible locations, shown on the attached map, for
the placement of the cart that will accommodate the applicant's requests as well as maintain ADA
requirements for pedestrians. The applicant would be pleased with approval to operate at any one of
these locations.
Letters of support from local businesses near the four possible locations and statistical information in
support of the proposed permit have been submitted by the applicant and are attached.

Right-of-Way Use Permit #10-25 Girl Dog Inc.
Special Conditions for Use of Sidewalk Area
The special conditions of this ROW Use Permit are:
1. Applicant is to maintain a current insurance policy and business registration on
file with the City.
2. Applicant is to maintain a current King County Health Permit on file with the City.
3. Applicant is to provide a signed and notarized Indemnification and Hold Harmless
Agreement.
4. Applicant is to comply with any special provisions/conditions of the permit.
5. Applicant is to comply with the City's nuisance code under ACC 8.12.
6. Applicant shall maintain a two foot clear zone from the face of the curb.
Applicant is to keep the public ROW free of obstructions that impede free use of
sidewalks by pedestrians and provide a minimum of a 5 foot wide clear
pedestrian path by the cart plus comply with the Americans with Disabilities Act
for pedestrian access.
8. Applicant shall provide and maintain a private waste receptacle near the cart and
keep the public ROW free of litter and drink or food waste.
9. The City reserves the right to adjust the terms and conditions or revoke this
Right-of-Way Use Permit pending the following considerations:
a. Public complaints involving perceived issues impacting public use of the
ROW affected by the permit.
b. Public comment or other community interest concerns.
c. Any emerging issue or change in use of the ROW that may impact the
public interest, as follows:
i. The remaining capacity of the rights-of-way to accommodate other
uses if the applicants proposed use is granted.
ii. The effect, if any on public health, safety, and welfare if the
authorization is granted.
iii. Such other factors as may demonstrate that the grant to use the
rights-of-way will serve the community interest.

This is a follow-up to our conversation this morning regarding the concession stand proposal by Lisa
Harmon, dba Girl Dog, Inc.
I am in favor of Ms. Harmon's proposal to establish a cart at any of the possible locations that have
been explored in the downtown area. As a fellow businessman, I encourage any additional retail
establishment that would bring commerce and vitality to the core area.
Her product appears to be unique, which will be a welcome addition to the merchant mix of our
downtown. With the economic challenges that face us all and the competition that we have with
neighboring shopping centers, more assertive merchants with her enthusiasm and confidence is
exactly what our downtown needs.

Girl Dog,Inc.
In 2008, the Urban Vitality Group and the City of Portland's Bureau of Planning
conducted several studies on the impact of food vendors and carts. Similar studies
and conclusions were conducted and reached by our neighboring Tacoma, who acted
upon those findings by creating a food cart pilot program in 2009 to encourage new
food carts into their downtown. And in a recent phone conversation with Mike
Branch of the King County Health department, he indicated Seattle would also be
following in Portland and Tacoma's footsteps, by revisiting their food cart laws.
Here are a few statistics pulled from the UVG's findings from 2008. Based on the
results of the surveys, inventories, interviews, and the overall population, UVG
found the following:
• 58% of businesses strongly agreed or agreed with the statement: The presence
of food carts has increased foot traffic on the street.
• 92% of downtown vendors strongly agree or agree that the cart has been a
good wav to support themselves and their families.
• 69% of restaurants and 94% of other businesses ranked their overall
impression of food carts positive or very positive.
• 65% of respondents in the public survey stated that there is a noticeable
smell from food carts and 86% say the smell is pleasant.
• 90% of respondents in the public survey and 74% in the business survey
indicated that there was no noticeable noise from food carts.
• 51% of food cart vendors surveyed plan to move into a storefront in the
future. Many vendors enter the food cart business as a steppingstone for
opening their own restaurants.
The UVG's findings indicate that food carts have significant community benefits to
neighborhood livability by fostering social interactions, walk-ability, and by
providing interim uses for vacant parcels. Additionally, carts provide good
employment opportunities for immigrants and low-income individuals to begin their
own businesses. UVG's recommendations advance sustainability- socially through the
personal interactions common at food carts; environmentally as they are usually
accessed by non-automobile uses; economically by promoting local businesses and
neighborhood retail areas; and culturally in their reflection of diversity.
At a community service event about a year ago, Mayor Pete Lewis shared his thoughts
on revitalization. He told the group about his efforts NOT to do what Kent had
done to it's downtown, but rather, bring together a seamless community, where
historic Auburn meets progress, meshing community, commerce and growth. He
mentioned his desire to keep Main Street on board with the city's progress, rather
than fracture the city's expansion. The beautiful One Main complex is proof that
his vision is beginning to take shape.
In the spirit of Mayor Pete Lewis's vision towards revitalizing Auburn, I would ask
you to consider these statistics as you make your decision on the issuance of an
ROW permit to Girl Dog, Inc.
