HomeMy WebLinkAbout4423 CITY CLERK'S OFFICE CITY OF AUBURN 25 West Mein Auburn, WA 08001 9()z()6/22 #L1E:r • RECD P 1 ORDINANCE NO. 4 4 2 3 RECFEE 2.00 CASHSL -+:-+:-+:10.00 2 S5 3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED ON THE EAST SIDE OF "A" STREET S.E., WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING 4 CLASSIFICATION THEREOF FROM R-3 (DUPLEX) TO C-3 (HEAVY 5 COMMERCIAL). 6 WHEREAS, Application No. REZ0001-90 has been submitted to 7 the Council of the City of Auburn, Washington, by WALTON & ~L? ~ 8 ASSOCIATES, requesting the rezoning of the real property co O 9 hereinafter described in Section 2 of the Ordinance; and C\J CIQ O 10 WHEREAS, said request above referred to, was referred to CD ON 11 the Hearing Examiner for study and public hearing thereon; and 12 WHEREAS, the Hearing Examiner, based upon staff review, 13 held a public hearing to consider said petition in the Council 14 Chambers of the Auburn City Hall, on March 20, 1990, at the 15 conclusion of which the Hearing Examiner recommended the 16 approval of the rezoning of said property, based upon the 17 following Findings of Fact and Conclusions, to-wit: 18 FINDINGS OF FACT 19 1. The applicant, Walton & Associates, through Robert Zanoni, agent, requests a rezone from R-3 (Duplex) to 20 C-3 (Heavy Commercial). 21 2. The subject property is located on the east side of "A" Street S.E. in the 900 block and is 11,900 square 22 feet in size. The Comprehensive Plan designates the site for heavy commercial uses although the existing 23 land use is that of a single family home. 24 3. Surrounding zoning includes R-3, Duplex, to the north and east; C-3, heavy commercial, to the south; and M- 25 1, industrial, to the west. 26 Ordinance No. 4423 April 6, 1990 Page 1 1 4. The applicant owns a 5600 square foot parcel that 2 abuts the proposed rezone's south line which is 3 already zoned C-3 (Heavy Commercial). There are three older single family residential homes existing on the 4 property. 5 5. The applicant has submitted a site plan illustrating a 3800 square foot office building and a 22 space 6 parking lot encompassing both parcels. 7 6. The site plan shows the parking lot accessed from "A" Street S.E. and the alley to the east. Currently the 8 alley is 16 feet wide and is unimproved and runs between 9th and 10th Streets for a distance of 230 110 9 feet. M. co 7. The proposal abuts 9th Street S.E. on the north and is N 10 70 feet away from 10th Street S.E. on the south. In C\J the event that the applicant anticipates utilizing the 11 alley for access, it should be paved. (IN 12 8. The subject property abuts "A" Street S.E. which is a 13 5 lane arterial capable of providing adequate services to a commercial use. Uses along the east side of "A" 14 Street have been converting to commercial uses. The rezone as proposed would be consistent with this 15 trend. 16 9. The staff report, with its recommendation of conditional approval, is incorporated herein by 17 reference as though set forth in full. 18 CONCLUSIONS OF LAW 19 1. The rezone as proposed is consistent with the 20 Comprehensive Plan Map and the Comprehensive Plan text for the vicinity. 21 2. The rezone as proposed is consistent with the trend of 22 establishing commercial uses on "A" Street S.E. 23 3. The rezone, if properly conditioned so that the alley is improved if it is used for access s hould be granted. 24 25 ~ r E0 0 26 Ordinance No. 4423 April 6, 1990 Page 2 AVG S HI ~~~!;3037c 1 2 For each of the above referenced reasons, the 3 recommendation of the Hearing Examiner to the Auburn City 4 Council on this rezone from R-3 (duplex) to C-3 (Heavy 5 Commercial) is approved and affirmed. 6 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 7 WASHINGTON, DO ORDAIN AS FOLLOWS: 8 Section 1. The above cited Hearing Examiner's Findings of 9 Fact and Conclusions, are herewith incorporated in this 110 10 Ordinance. cn Section 2. A rezone from R-3 (Duplex) to C-3 (Heavy 00 11 C\j CV 12 Commercial) located on the east side of "A" Street S.E. in the ,,D CD 900 block, situate in the City of Auburn, County of King, State ~ 13 14 of Washington, and legally described as follows: 15 Lots 1, 2, and 3, Block 3, Harts First Addition to Auburn as recorded in Plats, Vol. 20, pg. 23, Records of King 16 County, Washington, situated in NW 1/4 of Section 19, Twp 21 N, Range 5 EWM, City of Auburn, County of King, State of 17 Washington. 18 Section 3. If the alley is used for access, it shall be 19 paved to a width of 16 feet between 9th and 10th Streets S.E. to 20 the standards approved by the City Engineer. Section 4. Upon the passage, approval and publication of 21 22 this ordinance as provided by law, the City Clerk of the City of 23 Auburn shall cause this Ordinance to be recorded in the office 24 of the King County Auditor, Division of Records and Elections. 25 26 Ordinance No. 4423 April 6, 1990 Page 3 i 1 2 Section 5. The Mayor is hereby authorized to implement 3 such administrative procedures as may be necessary to carry out 4 the directions of this legislation. 5 Section 6.
