Applicant's failure to comply with any provisions/conditions of this permit shall be terms for immediate termination. 2. Applicant shall maintain current insurance throughout the life of the permit and provide the City with proof that they are insured. 3. Applicant shall provide a signed and notarized Hold Harmless agreement. 4. Applicant shall comply with the City's nuisance code under ACC 8.12 5. The City reserves the right to adjust the terms and conditions or revoke this Right-of-Way Use Permit pending the following considerations: a. Public complaints involving perceived issues impacting public use of the ROW affected by the permit. b. Public comment or other community interest concerns. c. Any emerging issue or change in use of the ROW that may impact the public interest, as follows: i. The remaining capacity of the rights-of-way to accommodate other uses if the applicant's proposed use is granted. ii. The effect, if any, on public health, safety, and welfare if the authorization is granted. iii. Such other factors as may demonstrate that the grant to use the rights-of-way will serve the community interest. 6. During the construction and/or repair of the awning/canopy, the applicant shall incorporate sufficient safety measures to protect the traveling public in the vicinity of the working area. These safety measures are to include providing appropriate traffic control. If the awning/canopy is damaged, steps must be taken to protect public safety. For situations that pose a public safety hazard the applicant must repair the damage within 5 days. If the situation does not pose a public safety hazard then the applicant must repair the awning/canopy to an original or comparable appearance within 45 days. February 22, 2011 W0222-3A Page 1 of 2 8. The materials used for the awningslcanopies shall be kept in good appearance and maintained, not faded or torn, etc. 9. If the applicant is to add any auxiliary attachments to the awningslcanopies (i.e.: hanging baskets) then these shall be installed in such a way so as to leave a 7 foot high clear zone area for the safe movement of pedestrians. 10. Applicant shall control water run-offfrom awnings by gutter or other means acceptable to the City Engineer.
