Background Summary:
The Boeing Company has applied for an amendment to their existing five year Right-of-Way Use Permit
to place five additional monitoring wells in the right-of-way at various locations in the city. Boeing is
conducting an investigation of off-site groundwater impacts. The proposed monitoring wells are to be
located in the right of way on O Street SW just north of Boundary Rd SW, 8th Street SW west of C Street
SW, E Street SW just north of 3rd Street SW and two wells on Lund Road SW south of West Main Street.

An Amendment to the existing permit issued on January 26, 2010 allows the well previously placed on
Industry Drive under this permit and the five new wells to be managed and tracked for insurance and
expiration date under the same permit number. The original permit expires on January 26, 2015

Right-of-Way Use Permit # 09-45 Special Conditions
The special conditions of this ROW Use Permit are:
1) Applicant's failure to comply with any special provisions/conditions of this permit will
be terms for immediate termination.
2) Applicant shall maintain current insurance throughout the life of the permit and
provide the City with proof that they are insured. Proof of insurance shall be sent to
City of Auburn, Amber Mund, Engineering Aide, 25 West Main Street, Auburn, WA
98001.
3) Applicant is to provide a signed and notarized Hold Harmless agreement.
4) Applicant shall notify the City 24-hours in advance of performing monitoring
operations by calling the Construction Manager at 253-804-5082.
5) Applicant shall perform monitoring on Monday, Tuesday, Wednesday, Thursday or
Friday only, between the hours of 9 am and 3 pm.
6) Applicant shall provide the City of Auburn's Water Quality Program Coordinator,
Chris Thorn (25 West Main Street, Auburn, WA 98001, 253-804-5065) with copies
(1 paper, 1 CD) of all monitoring data concurrent with applicant's submittal to the
Washington State Department of Ecology.
Applicant shall upon expiration of this permit either:
a) Apply for a new permit following the then current permit process if wells are to
be used for continued monitoring or
b) Provide documentation that the monitoring wells have been properly
abandoned if no longer needed.
8) Applicant shall maintain at least one lane of travel off of the private easement road on
8th Street SW during installation and monitoring of the well. Access at this location
shall be controlled by a flagger.
9) The City reserves the right to adjust the terms and conditions or revoke this Right-of-
Way Use Permit pending the following considerations:
a) Public complaints involving perceived issues impacting public use of the
ROW affected by the permit.
b) Public comment or other community interest concerns.
c) Any emerging issue or change in use of the ROW that may impact the public
interest, as follows:
• The remaining capacity of the rights-of-way to accommodate other uses if
the applicant's proposed use is granted.
• The effect, if any, on public health, safety, and welfare if the authorization
is granted.
• Such other factors as may demonstrate that the grant to use the rights-of-
way will serve the community interest.
