Background Summary: Kendall Lee Ridge LLC, applicant, made application to King County in April 2007 for the Final Plat of "Kendall Ridge" (County file no. L07FR021).rThe City of Auburn has assigned this project a File No. of PLT08-0008 for record keeping purposes. Kendall Ridge received preliminary plat approval from King County for the subdivision of a 30.17-acre site into 106 single-family lots (County File No. L04P0035). The subdivision request also includes sixteen tracts for access (Tracts F-N and X), recreation (Tract D and E), and a sensitive area (Tract A, B, C, and Y). The property is located east of 132"d Avenue SE and west of SR 18 within the portion of Lea Hill annexed January 1, 2008 (King County Parcel Numbers: 1021059006, 1021059032, 1021059044, 1021059074, 1021059063, and 1021059022). The King County Hearing Examiner approved the preliminary plat on May 3, 2006. The plat has been developed i n. accordance, with King, County R-6 (6.du/acre) and R-1 (one.du/acre) zoning standards. The City of Auburn'granted'a water/sewer certificate (WSC03-0024) in 2004 for the project and all conditions associated with that development agreement have been satisfied. The City of Auburn approved a facility extension agreement'(FAC06-0019) for extension of city water and sewer in 2007. The FAC.is now in the one-year- maintenance period. An assignment of funds in lieu of.completion of all of the plat improvements has been provided to the City. For each of these post-preliminary review phases, the County shall prepare a recommendation for the City's designated decision maker. All final decisions on any of the post-preliminary review phases shall be rendered by the City. At the request of the City, County staff shall appear before the City Council to discuss analysis set forth in the County's final plat approval recommendation." The final plat application for Kendall Ridge is vested to and therefore required to meet King County standards. King County staff has notified the City of Auburn that the final plat of Kendall Ridge has met all applicable regulations and conditions of approval and recommends the final plat be approved and signed by the City. Tract Y, which is a sensitive area tract with a slope area and standing timber, still resides in King County. When SR 18 was constructed it split the parcels and then upon annexation into the City of Auburn a portion of the property remained in King County. These split parcels were identified during the annexation process. Given that the plat resides in two jurisdictions, the City of Auburn will take action on the final plat then the document will be forwarded to the King County Council for action. Tract Y is the projects tree retention credit and therefore cannot be developed in the future. Staff is proposing to revise Note 23 to read as follows: School fees for Lots 1 through 106 inclusive within the City of Auburn are subject to Auburn City Code 19.02.070. The school impact fee and any administration fee shall be imposed concurrent with the issuance of the building permit. Lot 90 contains an existing residence to remain and is therefore is exempt. With this note change, it will allow the school impact fees to be collected at once with the building permit rather than half the fee paid now and then half collected at building permit which is a tracking issue for the City. King County staff did not have an objection to the note change. Exhibit List: Exhibit 1 - Certificate of Improvements, dated July 18, 2008 Exhibit 2 - Kendall Ridge Final Plat (13 sheets) Exhibit 3 - Aerial photo of Project Site Page 2 of 2 ORDINANCE NO.6 3 5 8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, APPROVING THE FINAL PLAT OF KENDALL RIDGE WHEREAS, the Plat of Kendall Ridge, Application No. PLT08-0008 was filed with King County, Washington, while it was unincorporated territory in the County, prior to the premise being annexed into the City of Auburn; and WHEREAS, the Preliminary Plat for this plat was by the King County Hearing Examiner on May 3, 2006 with identified conditions and requirements; and WHEREAS, the premises of the Plat of Kendall Ridge was annexed into the City of Auburn, effective January 1, 2008; and WHEREAS, in connection with the annexation, the City and King County entered into an Interlocal Agreement, pursuant to Resolution No. 4113, whereby the two jurisdictions identified a cooperative process for handling pending plat activity; and WHEREAS, in accordance with that cooperative process, the City of Auburn received a recommendation of approval from King County on the final plat application for the Plat of Kendall Ridge; and WHEREAS, insofar as the plat meets the requirements of applicable codes and plans, and the conditions and requirements of the preliminary plat, it is incumbent on the City Council to approved the final plat, as no new conditions or requirements can be added at this point. Ordinance No. 6358 March 28, 2011 Page 1 of 3 NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Approval. Kendall Ridge, a subdivision involving property located within the City of Auburn, Washington, which plat is legally described on Sheet 2 of the Final Plat and set forth in Exhibit "A", attached hereto and incorporated herein by reference, is hereby approved, and deemed to conform to the applicable requirements for Plat approval. Section 2. Constitutionality or Invalidity. If any section, subsection clause or phase of this Ordinance is for any reason held to be invalid or unconstitutional such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance, as it is being hereby expressly declared that this Ordinance and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed adopted and approved and ratified irrespective of the fact that nay one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 3. King County Approval. As a portion of the Kendall Ridge Final Plat lies under King County jurisdiction, the final plat shall be recorded once the King County Council takes action on the final plat. Section 4. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. Effective Date. This ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
