ADJOURN Page 1 AUBURN FIRE DEPARTMENT FIRE MARSHAL'S OFFICE Date: October 12, 2006 To: Deputy Chief Gerber From: Jeff Stottlemyre, Fire Marshal Re: Draft Fireworks Ban Ordinance Chief, Attached are comments relating to Director Heid's draft Fireworks ordinance. The general intent of the draft ordinance is to ban ALL Fireworks. This intent was confirmed verbally and is apparent by virtue of eliminating Fireworks stands from the Business License Ordinance, 5.20.030. These are the stands that we have licensed for years and sold "Consumer Fireworks", anything that DIDN'T go up or blow up. The following is a technical review of the draft ordinance comparing existing ordinance language, International Fire Code, WAC 212-17 and RCW 70.77, latest editions. Section 8.24.010 - I believe the intent here was to ensure that the City ordinance referenced the listed definitions within RCW 70.77.120 through 70.77.230. The suggested change also eliminates the reference of RCW 35A.12.140 (Adoption of Codes by Reference). RECOMMENDATION: From a technical standpoint, I have no concerns with suggested changes. Section 8.24.020 -Obviously the intent here was to eliminate any reference of sale, purchase and discharging of consumer Fireworks within Auburn and simply state "Possession of Fireworks unlawful". The suggested language references "any dangerous fireworks" which is not defined within the listed definitions of RCW 70.77.120 through 70.77.230 noted within the previous section 8.24.010. Though there is no definition of "dangerous fireworks" within the RCW, suggested language indicates that any firework that DOES NOT meet the State of Washington Fire Marshal's approval shall be deemed as dangerous. RECOMMENDATION: Simplify language and state: It is unlawful for anv person to sell, possess, use or explode "ALL FIREWORKS" within the Cit Supporting reasons for suggested change are bulleted below: • This covers the entire spectrum of Fireworks. There is no doubt as to what is illegal, simply all fireworks are illegal. The Cities of Renton and Tacoma utilize this language for clarification within their ordinances. • By virtue of allowing the State Fire Marshal to approve what is legal or not by stating that anything not approved by the State Fire Marshal would be considered "dangerous fireworks" could possibly allow certain fireworks thatwere previously banned in Auburn to be allowed, such as State approved devices like Roman Candles, Multi Aerial devices and Helicopters. These devices would be allowed because they would not meet the dangerous fireworks definition proposed within section 8.24.020. • Since there is no State definition of "dangerous fireworks", providing statistical documentation would be very difficult to track for supporting reasons. • Burden of proof that a confiscated firework is legal or illegal would again be required of field staff. • Utilizing the term "ALL FIREWORKS" is very clean and defendable to the Fireworks lobby who will certainly fight any total ban. Section 8.24.040(D) and (E) -There was no proposed changes within this section but from a technical review standpoint, now would be a great time to make some changes to the transportation, storage and Operations of Fireworks as they relate to Public Displays. RECOMMENDATION: Change existing language as follows: D. Transportation ~a-~ Storage, Preparation of Site, Crowd Control, Installation of Mortars and Operation of Display 1. All fireworks shall be transported within the city in accordance with 49 CFR Part 177 and 397.9(b) prior to reaching the display site. 2. A number of distance requirements have changed and by just referencing the appropriate WAC these site distances are maintained. Referencing the appropriate WAC, Public Displays conform to State requirements which maintain uniformity for State wide displays. Below are some examples of needed changes. Exception of None 212-17-310(3) electrically ignited shells Spectator Distance 200 feet (general) Up to 840 feet based Re uirements on mortar size Crowd Monitors None General requirements WAC 212-17-330 (1- 12) Though the existing Auburn City Coder language does a pretty good job on addressing public displays, pyrotechnic advances, fireworks manufacturing processes and other issues has required a more conclusive list of requirements, such as those found within WAC 212-17-295 through 212.17.345 Section 9.26.045 -This suggested change states that application for a Public Fireworks display be done through the Auburn Fire Department at least 14 days prior to scheduled event. RECOMMENDATION: Historically public fireworks displays have gone through the City "Conditional Use" permitting process. I recommend that the process remain within that format and increase the application period from 14 to 30 days for City staff review. Substantiation for recommendation are: • Fire Department has no provisions for the collection of permits and monies associated with permits. • The "Conditional Use" process allows for comment from other City Departments such as Police, Public Works and Community Development. • 30 days vs the proposed 14 days allows time for departmental review. Historically, the two main shows in Auburn, Auburn Senior High and Emerald Downs, are known well in advance where applicants can apply with plenty of time to spare. I would be happy to meet with City staff regarding this proposal. The amendments to the Auburn City Code restricts the use and possession of fireworks necessary to address problems of fires, police and emergency calls, noise, injury and property damage, as well as, the impacts on pets and animals. The danger posed to individuals and property by irresponsible use of fireworks cause residents to feel confined in their own homes, fearful of leaving for fear of damage to their property or trauma to their pets. The City, wishing to enhance the quality of life and safety of its residents, is proposing a ban of fireworks in the city limits of Auburn. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. Amendment to City Code. That section 5.20.030 of the Auburn City Code be and the same hereby is amended to read as follows: 5.20.030 License required -Fee -Term -Notices -Exemptions. A. It is unlawful for any person, firm or corporation to engage in any business as provided in this chapter within the city limits without first obtaining a license pursuant to the provisions of this chapter. A duplicate license shall be issued by the business license clerk, as designated by the mayor, to replace any license previously issued which has been lost, stolen, defaced or destroyed, upon the filing of an affidavit attesting to such fact and the paying to the business license clerk of a fee of $1.00. D. Any notice required by this chapter to be mailed to any licensee shall be sent by ordinary mail, addressed to the address of the licensee shown by the records of the business license clerk or, if no such address is shown to such address as the business license clerk is able to ascertain by reasonable effort. Failure of the licensee to receive such mailed notice shall not release the licensee from any fee or penalties thereon, nor shall such failure operate to extend any time limit set by the provisions of this chapter. E. This section grants an exemption from paying a fee for any licenses required under the provisions of this chapter to bona fide nonprofit, charitable, religious, or philanthropic persons or organizations. 1. Any person or organization claiming the exemptions of this section shall file with the business license clerk an affidavit setting forth facts sufficient to show the application of this section and the right to such exemption. 2. Persons or organizations required to be licensed by the state of Washington, wherein the state has preempted the field of endeavor of any such persons or organizations, shall not be required to obtain a license from the city under the provisions of this title; provided however, any such persons or organizations doing business within the city limits of the city shall carry the state license on his or her person at all times when doing business within the city, and shall exhibit such state license whenever he or she is requested to do so by any police officer or any person who asks to see the same. (Ord. 5897 § 2005; Ord. 4012 § 2, 1984.) Section 2. Amendment to City Code. That section 8.28.010 of the Auburn City Code be and the same hereby is amended to read as follows: 8.28.010 Noise control. Ordinance 6055 November 6, 2006 Page 4 A. General Prohibition. It is unlawful for any person to cause, or for any person who owns or occupies property to allow to originate from the property, sound that is a public disturbance noise. B. Public Disturbances. The following sounds are public disturbance noises in violation of this chapter: 1. The frequent, repetitive or continuous sounding of any horn or siren attached to a motor vehicle, except as a warning of danger or as specifically permitted or required by law; 2. The creation of frequent, repetitive or continuous sounds in connection with the starting, operation, repair, rebuilding or testing of any motor vehicle, motorcycle, off highway vehicle or internal combustion engine within a residential district, so as to unreasonably disturb or interfere with the peace and comfort of owners or occupants of real property; 3. Yelling, shouting, whistling or singing on or near public streets, particularly between the hours of 10:00 p.m. and 8:00 a.m. or at any time and place as to unreasonably disturb or interfere with the peace and comfort of owners or occupants of real property; 4. The creation of frequent, repetitive or continuous sounds which emanate from any building, structure, apartment or condominium, which unreasonably disturb or interfere with the peace and comfort of owners or occupants of real property, such as sounds from musical instruments, audio sound systems, band sessions or social gatherings; 5. Sound from motor vehicle audio sound systems, such as tape players, radios and compact disc players, operated at a volume so as to be audible greater than 50 feet from the vehicle itself; 6. Sound from portable audio equipment, such as tape players, radios and compact disc players, operated at a volume so as to be audible greater than 50 feet from the source and not operated upon the property of the operator, and if operated on the property of the operator, then so as to be audible greater than 50 feetfrom the boundary of the property; The squealing, screeching or other such sounds from motor vehicle tires in contact with the ground or other roadway surface because of rapid acceleration, braking or excessive speed around corners or because of such other reason; provided, that sounds which result from actions which are necessary to avoid danger shall be exempt from this section; 8. Construction noise shall be regulated as follows: a. Except as provided for in subsection (B}(8)(b} of this section, sounds originating from construction sites, including but not limited to sounds from construction equipment, power tools and hammering before 7:00 a.m. and after 10:00 p.m. on any day of the week except Sunday and before 9:00 a.m. and after 10:00 p.m. on Sundays; b. For construction on property in the R1, R2, R3, LHR1, LHR2, LHR3 and PUD zones, sounds originating from construction sites, including but not Ordinance 6055 November 6, 2006 Page 5 limited to sounds from construction equipment, power tools and hammering before 7:00 a.m. and after 7:00 p.m. and on weekdays, before 9:00 a.m. and after 6:00 p.m. on Saturday and Sunday; c. Construction activity may be permitted outside the hourly limits set forth in subsections (B}(8)(a} and (b) of this section only upon application and approval by the city planning, building and community director. Criteria for approval shall include project remoteness, undue hardship or other reasonable standards. Approval may only be for specific dates and times and other compelling reasons. In order to be entitled to receive approval, the applicant must show the city that the need for expansion of the hours is caused by circumstances of an unforeseen and emergency nature or circumstances where there are no other reasonable alternatives other than the relief requested. Approval may only be for specific dates and times and under terms that the approving official deems appropriate under the circumstances; d. The request for the expansion of the hours for construction related noise shall be made in writing to the planning, building and community director, on forms available from the planning, building and community department. Decisions of the planning, building and community director on such requests may be appealed by a party affected by the decision to the city's hearing examiner. Appeals of decisions of the planning, building and community director shall be based solely on the above criteria; e. It is further provided that the mayor or designee shall be entitled to exempt from the provisions of this subsection (B}(8) public agency projects involving work in public rights-of-way, right-of-way agreements and right-of-way permits, where noise is addressed as a condition of approval or agreement; 9. Sounds originating from residential property relating to temporary projects performed by the homeowner for the maintenance or repair of homes, grounds and appurtenances, including but not limited to sounds from lawnmowers, powered hand tools, snow removal equipment and any other power motorized equipment before 7:00 a.m. and after 10:00 p.m. on any day of the week except Sunday and before 9:00 a.m. and after 10:00 p.m. on Sundays; 10. Continuing andlor ongoing sounds from nonemergency motor vehicles audible more than 25 feet away from the vehicle located on or in the vicinity of residential property, which sounds reasonably cause the annoyance or disturbance of two or more neighbors not residing at the same address, due to the ongoing or repetitive nature of the sounds, or the very early or very late hours of the sounds. For the purposes hereof, sounds coming from motor vehicles, including but not limited to engine sounds, horn sounds, hydraulic or air break sounds, or other equipment located on the motor vehicle or attached trailer, that are audible more than 25 feet away from the vehicle located on or in the vicinity of residential property, after 10:00 p.m. at night or before 7:00 a.m. on any day of the week except Sunday and after 10:00 p.m. at night or before 9:00 a.m. on Sundays, shall be presumed to be a public disturbance noise. Such presumption shall only Ordinance 6055 November 6, 2006 Page 6 be rebutted upon a showing before the adjudicatory body that the noise was caused by circumstances of an unforeseen and emergency nature. C. It is also unlawful, and a violation of this chapter, for the owner or other person having control or custody of any dog, cat, or other animal to allow such dog, cat, or other animal to habitually howl, yelp, bark, or make other noises which unreasonably disturb another person. D. Exclusion. This chapter shall not apply to community events such as parades or regularly scheduled events at parks, such as public address systems for baseball games or park concerts between the hours of 9:00 a.m. and 11:00 p.m. This chapter shall not apply to public displays of fireworks lawfully discharged within the city. This chapter shall also not apply to public safety training activities between the hours of 7:00 a.m. and 11:00 p.m. (Ord. 6017 § 1, 2006; Ord. 6010 § 1, 2006; Ord. 5899 § 1, 2005; Ord. 5658 § 1, 2002; 1957 code § 9.10.010.} Section 3. Amendment to City Code. That section 15.36A.011 of the Auburn City Code be and the same hereby is amended to read as follows: 15.36A.011 Adoption. The International Fire Code, 2003 Edition, as published by the International Code Council, as amended in Chapters 51-44 and 51-45 WAC, effective July 1, 2004, together with amendments, additions, and deletions adopted in this chapter, including Appendix B, "Fire Flow Requirements for Buildings," Appendix C, "Fire Hydrant Locations and Distribution," and Appendix E, "Hazard Categories." The provisions of Chapter 15.07 ACC together with Chapter 15.38A ACC and this chapter shall be controlling within the jurisdiction of the city. It is unlawful for any person to hold, conduct or engage in any public display of fireworks within the city without first having obtained and being the holder of a valid permit under the provisions of this chapter. The annual fee fora "public display" permit for the public display of fireworks shall be set by Council resolution and included in the city's fee schedule. A. Every public display of fireworks shall be handled by a competent operator approved by the f.r° phi°fmavor or his,.., or her designee and shall be of such character, and so located, discharged, or fired, that, in the opinion of the fire oh-i~fmavor or his or her designee, after proper investigation, it will not constitute a hazard to property or endanger any person. Should the fire chef---mayor or his or her designee deny a permit for public display of fireworks, the applicant therefor shall have the right to appeal that denial to the appropriate Auburn city council committee, which shall consider such application, recommendation and denial, and in its discretion shall either uphold the denial or grant the permit applied for. B. A state pyrotechnics license is required for operators of a public display of fireworks. C. A bond or certificate of insurance must be furnished to the fir° ^"i°fCty before a permit is issued. The bond shall be in the amount of $1,000,000 VI IIVI and shall be conditioned upon the applicant's payment of all damages to persons and property resulting from or caused by such public display of fireworks, or by any negligence on the part of the applicant or its agents, servants, employees or subcontractors in the presentation of the display. The certificate of insurance shall evidence a comprehensive general liability, including automobile coverage, insurance policy providing limits of $1,000,000 combined single limit, per occurrence and annual aggregate, no deductible, and naming the city of Auburn as an additional insured. D. Transportation unu, Storage, Preparation of Site, Crowd Control, Installation of Mortars and Operation of Display. 1. All fireworks shall be transported within the city in accordance with 49 CFR Part 177 and 397.9(b} prior to reaching the display site. 2. A. A person is guilty of a separate offense for each separate and distinct violation of any provisions of this chapter, and a person is guilty of a separate offense for each day during which he/she commits or allows to continue any violation of the provisions of this chapter. Any fireworks which are illegally sold, offered for sale, used, discharged, possessed or transported in violation of the provisions of this chapter or of Chapter 70.77 RCW shall be subject to seizure by any police officer or by the city's fire marshal or his designee. (Ord. 5679 § 1, 2002.} 8.24.060 Severability. If any provision of this chapter or Chapter 70.77 RCW adopted by reference in this chapter and effective from and after five days from publication following adoption by the city council or its application to any person or circumstance is held invalid, the remainder of this chapter or its application of the provisions to other persons or circumstances shall not be affected. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 6. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances.
