CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flap. Salute Led by Leader Wayne Cofer, Camp Fire Group "Wahecado" posted the colors of the flag, and led those in attendance in the pledge of allegiance. Camp Fire girls are Andrea Cofer, Cheryl Harper, Fawn Scar, Libby Espe, Laura Schrag, and Maria Hoffman. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Whittall, Burns, Larson, Roland, Brothers, and Kurle. Staff members in attendance included Police Chief Jake Evans, Fire Chief Bob Johnson, Personnel Director Gretel Sloan, Parks & Recreation Director Len Chapman, Finance Director Pat Dugan, Public Works Director Frank Currie, Acting Planning Director Rob Chave, City Attorney Marguerite Schellentrager, Police Captain Ray Sherman, and Deputy City Clerk Gayle Butcher. C. Announcements and Appointments Mayor Roegner requested that a full Council compliment be in place for the retirement recognition of Lt. Miller. This evening's agenda order of announcements and appointments was reversed. Council Position #3 A3.10.8 Motion by Councilmember Larson to approve the appointment of Richard E. Wagner to the City Council to fill the vacancy of Position #3, second by Councilmember Kurle. MOTION CARRIED UNANIMOUSLY. 6-0. Mayor Roegner called upon City Attorney Schellentrager to perform the Oath of Office. Mayor Roegner welcomed Councilmember Wagner to the Auburn City Council, and Councilmember Wagner joined the Council. CITY OF AUBURN COUNCIL MEETING February 5, 1990 2. Ernie Miller Retirement A4.3.5 The Auburn City Council, Mayor Roegner, Police Chief Evans, and staff members, honored retiring Lieutenant Ernie Miller for his twenty-five years of service with the City of Auburn. 2. Appointments - None D. Agenda Modifications Mayor Roegner announced agenda modifications to this evening's agenda are under IV.B.1, adding claim vouchers, and under VII.B.7, Resolution 2039. II. CITIZEN INPUT PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings - None. B. Audience Participation - None. C. Correspondence - None. III. COUNCIL COMMITTEE REPORTS A. Municipal Services A3.6.4.4 Chairman Whittall reported the Municipal Services Committee did not meet on February 1, 1990, and announced the next meeting of the Municipal Services Committee is February 15, 1990 at 5:30 p.m. B. Planning & Community Development A3.6.4.4 Chairman Burns stated the Planning & Community Development Committee met on January 22, 1990 and the minutes are of public record. Chairman Burns requested support for the number of items on this evening's agenda. The next meeting of the Planning & Community Development Committee will be February 12, 1990 at 7:30 p.m. C. Public Works A 3.6.4.4 Chairman Kurle reported the Public Works Committee met this evening prior to the Council meeting and the minutes would be of public record when published. He requested support for the number of items on this evening's agenda. The next Public Works Committee meeting is prior to the next Council meeting on February 20, 1990 at 5:30 p.m. D. Finance A3.6.4.4 Acting Chairman Bud Larson stated the Finance Committee met prior to the Council meeting tonight, and items are listed under this evening's consent agenda. The minutes will be of public record when published. The next Finance Committee meeting will be prior to the next Council meeting of February 20, 1990 at 7:00 p.m., and Councilman Brothers will assume his chairman duties at that time. C. Out of State Travel F4.1.1 I. Public Works Request approval for Mike Browne, Brent Berntson, Brian Herridge, Jeff McIntyre, and Pete Deraitus to attend a two day seminar in Portland, Oregon on February 8 and 9, 1990. 2. Personnel Request approval for Gretel Sloan to attend NPELRA meeting March 18 - 23 in San Diego, and IPMA Virginia Chapter Symposium April 18 and 19 in Virginia. D. Interfund Loans F4.7 1. Request interfund loan for Fund 434 (Solid Waste) from 430 (Water) in the amount of $150,000.00 at 8.4% interest from 12-31-89 to 2- 28-90. 2. Request to renew the following interfund loans at 8.4% interest for the period 12-31-89 to 12-31-90: For LID 338 Fund No. 738 from Water Fund No. 430 in the amount of $8,000.00. For Solid Waste Fund No. 434 from Sewer Fund No. 431 in the amount of $75,000.00. 3. Request interfund loan for LID 339 (Hidden Valley Road) from Fund No. 431 (Sewer Fund) in the amount of $15,000.00 at 8.4% interest from December 31, 1989 to December 31, 1990. E. Contract Administration Street Improvement No. 266 04.9.1 Recommend approval of Change Order Number 1 which approves a lump sum increase of $1,665.00 to Signal Electric, Inc., on the West . Street Improvement, Water Improvement 184 04.9.1, 04.11.1 Request permission to call for bids for Street Improvement No. 265 and Water Improvement 184 - Contract No. 90-02. Stuck River Bridge project. 3. LID 33 04.9.1 Approve Final Pay Estimate No. 9 - Final, to M.A. Segale, Inc., for LID 339, Hidden Valley, Contract 88-17 in the amount of $4,924.85. 4. Storm Improvement No. 39 Sanitary Sewer No. 74 04.9.1, 04.8.1 Approve Final Pay Estimate No. 4 - Final, to Shoreline Construction, Inc., for Sewer Improvement No. 74 and Storm Improvement 39, Contract 88-19, 1988 Sanitary Sewer Replacement Program, in the amount of $17,951.15. 5. Centerline and Lane Line Paintin¢ 04.9.1 Approve Pay Estimate No. I - Final, to Select Contracts, Inc., in the amount of $19,761.56, for the 1989 Centerline and Lane Line Painting Project, Contract 89-05. F. Right-of-Way Use Permit 03.10.9 Approve a Right-of-Way Use Permit for the Auburn Education Association to march on Main Street using public sidewalks on February 13, 1990. Motion by Councilmember Larson, second by Councilmember Kurle, to approve Consent Agenda items, including agenda modification, IV.A through IV.F. MOTION CARRIED UNANIMOUSLY. 7-0. V. OLD BUSINESS -None. VI. NEW BUSINESS A. Application No. CUP0008-89 Application No. REZ0013-89 03.8 REZ0013-89, 03.10.1 CUP0008-89 The request of Wildwood Income Property for approval of a rezone from R- MHP to R-3 and Conditional Use Permit to allow five 4-plexes on property located on the north side of Auburn Way South in the 4000 block. PAGE 4 CITY OF AUBURN COUNCIL MEETING February 5, 1990 Motion by Councilmember Burns, second by Councilmember Kurle to approve the rezone and conditional use permit based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions; and to instruct the City Attorney to prepare the necessary Ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. B. ADDlication No. CUP0009-89 03.10.1 CUP0009-89 The request of Bruce Courtright for approval of a Conditional Use Permit for a professional office to be located at 1315 "M" Street S.E. Councilmember Larson directed a question to Acting Planning Director Rob Chave concerning conditional use permit procedures. Acting Planning Director Chave responded conditional use permits can be used to bring businesses into compliance, and that conditional use permit applications are reviewed on their merits when staff becomes aware that a conditional use is required. Motion by Councilmember Burns, second by Councilmember Kurle to approve the conditional use permit based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions; and to instruct the City Attorney to prepare the necessary Ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances Ordinance No. 4403 F5.2.7, 03.4.1.7 An Ordinance of the City Council of the City of Auburn, Washington, approving an appropriation of Grant Funds in the Amount of Ten Thousand Dollars, ($10,000), and Authorizing the Mayor to accept the grant from the State of Washington Department of Ecology to Develop a Wetlands Inventory for the City of Auburn. Motion by Councilmember Burns, second by Councilmember Kurle to introduce and adopt Ordinance No. 4403. MOTION CARRIED UNANIMOUSLY 7-0. 2. Ordinance No. 4404 03.8 REZ0006-89, 03.10.1 CUP0004-89 An Ordinance of the City of Auburn, Washington, Amending Section 2 of Ordinance No. 4380 passed November 20, 1989, relating to the legal description in Application No. CUP0004-89 and REZ0006-89. Ordinance No. 4405 03.8 REZ00IO-89 An Ordinance of the City of Auburn, Washington, amending Section 2 of Ordinance No. 4385 passed December 4, 1989, relating to the legal description in Application No. REZ0010-89. Motion by Councilmember Burns, second by Councilmember Kurle, to introduce and adopt Ordinance No. 4405. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Ordinance 4406 05.3, F4.3 An Ordinance of the City of Auburn, Washington, authorizing the Director of Parks and Recreation to set reasonable fees and charges and establishing policies upon which fees and charges are set for use of city parks and recreation facilities and for participation in city parks and recreation programs. Motion by Councilmember Burns, second by Councilmember Brothers, to introduce and adopt Ordinance No. 4406. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Ordinance No. 4407 F4.3, 03.4.1.17 An Ordinance of the City Council of the City of Auburn, Washington, amending Codified City Ordinance Section 2.78.010 (Fees Designated), to add costs of advertising. Motion by Councilmember Burns, second by Councilmember Kurle, to introduce and adopt Ordinance No. 4407. MOTION CARRIED UNANIMOUSLY 7-0. 6. Ordinance No. 4408 03.8 REZ00II-89 An Ordinance of the City of Auburn, Washington, providing for the rezoning of property located on the South side of 52nd Street N.E.(SO. 277TH) and East of "7" Street N.E. (if extended), within the City of Auburn, Washington, changing the zoning classification thereof from R-4 (Multi-Family) to R-2 (Single Family). Motion by Councilmember Burns, second by Councilmember Brothers, to introduce and adopt Ordinance No. 4408. MOTION CARRIED UNANIMOUSLY 7-0. 7. Ordinance No. 4409 03.8 REZOOIIA-89, 03.4.4 PAGE 6 CITY OF AUBURN COUNCIL MEETING February 5, 1990 An Ordinance of the City of Auburn, Washington, providing for the rezoning of property located in the South Side of 52ND Street N.E.(S. 277TH) and East of "P" Street N.E. within the City of Auburn, Washington, changing the zoning classification thereof from R-4 (Multi-Family) and R-2 (Single Family) to P-1 (Public Use District) and Comprehensive Plan Map Amendment From High Density Residential and Single Family to Public and Quasi Public. Motion by Councilmember Burns, second by Councilmember Kurle, to introduce and adopt Ordinance No. 4409. MOTION CARRIED UNANIMOUSLY. 7-0. 8. Ordinance No. 4410 F3.2 1989 Amendments An Ordinance of the City of Auburn, Washington, authorizing the Mayor to accept schedule "A" which relates to the City of Auburn 1989 Budget reallocation of funds in the beginning and ending working capital accounts in the Solid Waste Fund to RCW 35A.33.120. Motion by Councilmember Larson, second by Councilember Whittall, to introduce and adopt Ordinance No. 4410. MOTION CARRIED UNANIMOUSLY 7-0. Resolutions Resolution No. 2033 03.3.9,A3.13.7.2,03.13.8,03.13.1.3 Resolution of the City Council of the City of Auburn, Washington, approving and accepting a conveyance of property along with extinguishment of easements from the owners of certain property and also authorizing the Mayor and City Clerk to execute a street improvement delay agreement and an agreement for developer public facility extension to allow for the development of property owned by Fournier Construction, Incorporated. Motion by Councilmember Kurle, second by Councilmember Brothers to introduce and adopt Resolution No. 2033. MOTION CARRIED UNANIMOUSLY. 7-0. Resolution No. 2034 04.4.2 A Resolution of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute an agreement between the City of Auburn and Kent Travel to serve as travel agent for the Senior Center Hawaiian Cruise Tour Package. Resolution No. 2035 03.5 PLT0007-89 A Resolution of the City Council of the City of Auburn, Washington, approving the preliminary plat of Riverbend Estates located on the South Side of 52nd Street N.E. (SO. 277TH) And East of "P" Street N.E. (if Extended), within the City of Auburn, Washington. Motion by Councilmember Burns, second by Councilmember Brothers, to introduce and adopt Resolution No. 2035. MOTION CARRIED UNANIMOUSLY 7-0. 4. Resolution No. 2036 03.4.1.17 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a mutual agreement to amend agreement for services with Otto Rosenau and Associates. Motion by Councilmember Kurle, second by Councilmember Brothers, to introduce and adopt Resolution 2036. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution 2037 04.5.1.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an assignment agreement between the City of Auburn and Burlington Northern Railroad Company. Motion by Councilmember Kurle, second by Councilmember Burns, to introduce and adopt Resolution 2037. MOTION CARRIED UNANIMOUSLY 7-0. 6. Resolution No. 2038 A3.13.2 A Resolution of the City Council of the City of Auburn, Washington, approving an easement to Pacific Northwest Bell for communication line and equipment. Motion by Councilmember Kurle, second by Councilmember Brothers, to introduce and adopt Resolution 2038. MOTION CARRIED UNANIMOUSLY 7-0. 7. Resolution 2039 A3.7.1 A Resolution of the City Council of the City of Auburn, Washington, repealing Resolution 1920 passed January 3, 1989, and creating a new PAGE 8 CITY OF AUBURN COUNCIL MEETING Resolution relating to Council Committees members, powers and duties of all standing Council of the City of Auburn. February 5, 1990 and designating the committees of the City Councilmember Brothers questioned if there were any changes to committee areas of responsibility. Councilmember Larson responded the changes involved Councilmember committee assignment only. Motion by Councilmember Larson, second by Councilmember Kurle, to introduce and adopt Resolution No. 2039. MOTION CARRIED UNANIMOUSLY 7-0. VIII. OTHER A. Application No. CUP0008-89 Application No. REZ0013-89 03.8 REZ0013-89, 03.10.1 CUP0008-89 Councilmember Kurle requested a clarification involving the preservation of trees concerning the Wildwood Income Property considered under this evening's agenda item VI.A, Application No. CUP0008-89, REZ0013-89. Acting Planning Director Chave responded that the clearing plan review process will attempt to protect as many trees as possible. B. Resolution 2039 A3.7.1 Councilmember Whittall pointed out that there appeared to be committee responsibility changes on Resolution 2039. Councilmember Whittall indicated it was his understanding that responsibilities for the cemetery and golf course had been transferred from the Municipal Services Committee to the Planning and Community Development Committee during January, 1989. Mayor Roegner directed Parks and Recreation Director Len Chapman to verify the intent of Council Committee jurisdictions, and to request the City Attorney amend Resolution 2039 as needed for the next Council meeting. C. Announcement (FA.1.1) Mayor Roegner announced this week is City Legislative Week in Olympia, Washington, and several City of Auburn Councilmembers will attend the Association of Washington Cities Legislative Conference. IX. MAYOR'S REPORT A Executive Session - None X.
