CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flag Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Whittall, Wagner, Burns, Roland, Brothers and Kurle. Councilmember Larson was excused. Staff members in attendance included Police Chief Jake Evans, Fire Chief Bob Johnson, Parks & Recreation Director Len Chapman, Finance Director Pat Dugan, Public Works Director Frank Currie, Acting Planning Director Rob Chave, Senior Planner Al Hicks, Library Director Mary Stanton, City Attorney Marguerite Schellentrager, Construction Manager Larry Dahl, Lieutenant Marion Dukes, and City Clerk Robin Wohlhueter. C. Announcements and Appointments 1. Announcements a. Centennial Logo A5.2.5 Mayor Roegner displayed the City's 1991 centennial logo designed by the Centennial Commission. The centennial logo depicts those things asssociated with the Auburn community. b. Spring Clean-up A1.12 Mayor Roegner announced Dick Scobee Elementary submitted the winning slogan for Auburn's 1990 Spring clean-up campaign. The winning slogan "Join the Team--Make Auburn Gleam!" was submitted by a sixth grade class. In conjunction with the spring clean-up, Mayor Roegner announced at Gildo Ray elementary School on April 21st and 22nd a kick-off to the annual spring clean-up campaign with a litter challenge. Mayor Roegner directed attention to the Annual Spring Clean-up newspaper advertisement showing days scheduled to pick up trash and garbage designated by colored areas. Mayor Roegner encouraged participation by all. CITY OF AUBURN COUNCIL MEETING c. Proclamations April 16, 1990 1. Volunteer Week A1.8 Mayor Roegner presented a proclamation naming the week of April 22, 1990 through April 28, 1990 as "Volunteer Week". Accepting the proclamation on behalf of all volunteers were; Audra Porter, Senior Center volunteer hostess; Marilyn McDaniels, Parks Department preschool class helper and office task assistant; Jim Williams, Parks Department youth baseball coach; and Paul Koenig, Auburn General Hospital volunteer. Mayor Roegner announced a luncheon is scheduled for 11:30 a.m. on April 24, 1990 honoring the volunteers. The luncheon will be held at the Auburn Senior Center. 2. Appointments a. Planning & Community Development Director A4.5.2 Motion by Councilmember Burns to concur in the appointment of Steve Lancaster as the City's new Planning & Community Development Director. Second by Councilmember Wagner. MOTION CARRIED UNANIMOUSLY. 6-0. The Mayor and Councilmembers congratulated Steve Lancaster on his appointment, and welcomed him and his wife Karen. D. Agenda Modifications Agenda modifications include I.C.I.c transmitting a proclamation Mayor Roegner is to present proclaming April 22 through April 28, 1990 as "Volunteer Week" to community volunteers; II.C. tranmitting a letter dated April 16, 1990 from Fred W. Poe regarding LID 338, and an inter- department memo dated April 16, 1990 from Frank Currie regarding LID 338; and VII.A.2 transmitting Exhibit "A" to Ordinance No. 4421 inadvertently left out of the packet. Ordinance No. 4421 adopts the Community Development Block Grant objectives, and recommends the use of block grant funds. Il. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings Local Improvement District 338 F2.4.9 LID338 The request of the City of Auburn to finalize the assessment roll for Local Improvement District 338 according to Ordinance No. 4219 passed April 20, 1987 for construction and installation of an 8-inch waterline and appurtenances in 4th Street N.E. and Riverview Drive PAGE 2 CITY OF AUBURN COUNCIL MEETING April 16, 1990 N.E., Auburn, Washington. Those persons wishing to be heard may do so at this time. Mayor Roegner opened the public hearing. Joann Martin 1818 4th Place N.E., Auburn, WA Joann Martin, participant in the LID 338, stated she is here on behalf of her neighbors. Ms. Martin slated Mr. Greeley should pay his entire assessment. Ms. Martin questioned how final assessments were computed, and expressed concern regarding the increase in assessments since 1987. Mark Weinstein 7702 16th Ave. N.W., Auburn, WA Mark Weinstein questioned how and when payment is made. Mayor Roegner referred him to Finance Director Pat Dugan. Motion by Councilmember Kurle to close the public hearing on LID 338. Second by Councilmember Burns. MOTION CARRIED UNANIMOUSLY. 6-0. Mayor Roegner asked for questions from the Council, and noted a letter submitted from Fred Poe regarding LID 338. Prior the Council questions, Frank Currie explained there was a 9% increase in costs for completion of this project. One-third increase in interest, and two-thirds construction costs. Some of the Councilmembers questioned how interest was computed over the delay of two and one-half years on LID 338, and how the interest was spread over all the assessments. Frank Currie explained due to financing costs of bonding such a small local improvement district, the City decided to combine bonding with Local Improvement District No. 339 for street improvements to Hidden Valley, and estimates for financing both local improvement districts were divided accordingly. Mr. Currie explained what the costs would have been if LID 338 was financed on its own. Mr. Currie further explained how the assessments were figured when combined with Local Irliprovement No 339. Motion by Councilmember Kurle, second by Councilmember Burns to to refer Local Improvement District No. 338 back to the Public Works Committee. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Local Imnrovement District 339* (Kurle/Currie) F2.4.9 LID 339 The request of the City of Auburn to finalize the assessment roll for Local Improvement District No. 339 according to Ordinance No. 4279 passed April 4, 1988 for acquisition, paving and related work to 53rd PAGE 3 CITY OF AUBURN COUNCIL MEETING April 16, 1990 Street S.E., etal vicinity Hidden Valley tracts, in Auburn Washington. Those persons wishing to be heard may do so at this time. Prior to opening the public hearing, Councilmember Wagner excused himself from the Council chambers due to his participation as a resident in the formation of Local Improvement District No. 339. At the formation of Local Improvement District No. 339 Councilmember Wagner was not a member of the Auburn City Council. Mayor Roegner opened the public hearing. Joan Brooke 5501 Bridget Avenue S.E., Auburn, WA Joan Brooke, participant in Local Improvement District No. 339, expresed concern with some assessments being higher than others when originally they were to pay the same amount. Ms. Brooke said the City's contractor for LID 339 is a litterbug, and the City should require appropriate disposal of construction materials. George Dubeck 4921 55th Street S.E., Auburn, WA George Dubeck, participant in Local Improvement District No. 339, complimented Rich Wagner, who at the time was not on the Auburn City Council, for his work in forming this local improvement district. Mr. Dubeck stated the Council should be proud of this development because it is one of the best in Auburn. Motion by Councilmember Kurle, second by Councilmember Burns to close the public hearing. MOTION CARRIED UNANIMOUSLY. 6-0. Mayor Roegner requested questions from the Council. The Council noted Mr. & Mrs. Baier's letter objecting to Local Improvement District No. 339, and stated staff had responded to the Baier's concerns. Some of the Council questioned how assessments were arrived at. Frank Currie responded by explaining assessments are based on the number of shares, a share being a five acre parcel. Frank Currie noted corner lots fronting on two streets, where only one street is built, are charged a 1/2 share. In one area within Hidden Valley, a property owner agreed to do some of the work himself, and has a lesser share accordingly. In another area, additional work was required resulting in higher shares. City Attorney Marguerite Schellentrager read Ordinance No. 4227 approving and confirming the assessments and assessment roll of Local Improvement District No. 339 for the improvement of various streets within King County, Washington, as provided by Ordinance No. 4279, and levying and assessing the cost and expense thereof against confirms the final assessment roll on Local Improvement District No. 339. PAGE 4 CITY OF AUBURN COUNCIL MEETING April 16, 1990 Motion by Councilmember Kurle, second by Councilmember Burns to introduce and adopt Ordinance No. 4227. MOTION CARRIED UNANIMOUSLY. 6-0. 3. 1990-1991 Community Development Block Grant F5.4.3 The City of Auburn expects to receive $229,000 in Community Development Block Grant Funds for the 1990-1991 program year. The Auburn City Council encourages all interested citizens to voice an opinion prior to the Auburn City Council determining the use of Community Development Block Grant Funds. Mayor Roegner opened the public hearing. Lynn Roberts 11219 SE 323th Street, Auburn, WA Lynn Roberts spoke in support of Washington Women's Employment Education (WWEE). Ms. Roberts stated WWEE is an organization estalished in Washington in 1982 that assists very low income and welfare single parents in becoming self-sufficient through employment and education. Soroptimist International of Auburn and WWEE will co-support funding of this program. Ms. Roberts cited national and local statistics with regard to services to low-income, single heads of households. WWEE targets low income, single heads of households for recruitment, and provides skills training for job placement and professional development; counseling; and support services such as childcare, transportation, clothing and emergency needs. Ms. Roberts concluded her comments by requesting City support of this program in the amount of $5,000. Jean Sails 640 L Street N.E. Jean Salls, Director of the South King County Emergency Housing Program of YWCA, located at Green River Homes in Auburn, thanked the Council for the original funding to make the project possible in Auburn. Currently, they are operating ten units. Jean Sails reported the program has housed nine families in the transitional program; and six families through the emergency shelter unit. She stated demand far exceeds facilities and urged continued support. Dick BrupRer - 11244 SE 322nd Street, Auburn, WA Dick Brugger, Director of Auburn Youth Resources, requests #2 & 3 for social services facilities. These two proposals include painting the outside of Auburn Youth Resources facility at 816 F Street S.E., in Auburn, and having eight windows tinted to provide privacy. Tinted windows would also provide shading on the west side of building. Dick Brugger said the primary request is to extend the emergency use shelter at 1425 Auburn Way South. Mr. Brugger thanked the city for PAGE 5 CITY OF AUBURN COUNCIL MEETING April 16, 1990 providing forty-five percent of the funding to establish the facility. Auburn Youth Resources is now asking that they enlarge it to one thousand square feet. The facility currently turns away fifteen young people every month. Dick Brugger said they would like the capability of six to eight beds instead of five. Motion by Councilmember Burns, second by Councilmember Brothers to close the public hearing. MOTION CARRIED UNANIMOUSLY. 6-0. Prior to the city attorney reading the proposed ordinance, Mayor Roegner asked if there were questions from the Council. Councilmember Whittall asked for clarification on the amount of the ACAP funding request, and further questioned sidewalk improvements and program administration. A] Hicks responded the correct funding amount is $8,000 for ACAP Frank Currie clarified under neighborhood revitalization that the sidewalk repair program offers a lower income area an opportunity to make improvements to sidewalks instead of using a local improvement district process. The City identifies areas requiring improvements and repairs the sidewalk within the area. Al Hicks said the Block Grant Program administration is used to fund administration within the department. HUD allows twenty percent to be used for administration, and the City of Auburn uses approximately ten percent. City Attorney Marguerite Schellentrager read Ordinance No. 4421 approving community development objectives and proposed projects and approving the appropriation of approximately $229,000 in 1990-91 Community Development Block Grant Funds. Motion by Councilmember Burns to introduce and adopt Ordinance No. 4421. Second by Councilmember Brothers. MOTION CARRIED UNANIMOUSLY. 6-0. B. Audience Participation James Hill - 4602 Bridget Avenue, Auburn, WA James Hill, resident of Hidden Valley, stated people coming down Stuck River Drive are shooting against a gravel hill. Somtimes the weapons create a hazard by ricochetting overhead. Mr. Hill stated he has asked these people to stop shooting, and one of them took a shot at him. Mr. Hill pointed out the City should be concerned about this before there is a tragedy near this area. Mr. Hill requested the City put signs up to deter the shooting within this area. Corresoondence Local Improvement District No. 339 F2.4.9 LID339 Letter dated April 2, 1990 from Mr. and Mrs. Herbert Baier objecting to Local Improvement District 339, Assessment No. 15. 2. Local Improvement District No. 338 F2.4.9 LID338 Letter dated April 16, 1990 from Fred W. Poe regarding LID 338. 3. Local Improvement District No. 338 F2.4.9 LID 338 Inter-department memo dated April 16, 1990 from Frank Currie regarding LID 338. III. COUNCIL COMMITTEE REPORTS A. Municipal Services A3.6.4.4 Chairman Pete Whittall reported the Municipal Services Committee met on April 12, 1990 to discuss the 1990 Spring Clean-up, out-of-state travel requests from the Police and Fire Department, and Resolution No. 2040 clarifies that all solid waste issues are to come before the Municipal Services Committee rather than the Public Works Committee. The next Municipal Services Committee Meeting is May 3, 1990 at 5:30 p.m. B. Planning & Community Development A3.6.4.4 Chairman Burns reported the Planning & Community Development Committee met a week ago this evening at 5:30 and the minutes are of public record. The next meeting of the Planning & Community Development Committee is scheduled for April 23 at 7:30 p.m. C. Public Works A3.6.4.4 Chairman Kurle reported the Public Works Committee met this evening prior to the Council meeting and the minutes will be of public record when published. Chairman Kurle stated the Public Works Committee discussed Resolutions 2071, 2072, King County Local Hazardous Management Plan, and denial of a utility bill adjustment. The next meeting of the Public Works Committee is scheduled for May 7, 1990 at 5:30 p.m. D. Finance A3.6.4.4 Chairman Brothers reported the Finance Committee met prior to the Council meeting tonight at 6:30 p.m. Items discussed included possible adoption of a biennial budget, LIDS, Airport, Property and Boiler & Machinery insurance coverage, and claims and payroll. Police Department Recommend authorization for Police Chief J. D. Evans to attend the 1990 IACP (International Association of Police Chiefs) Conference in Tulsa, Oklahoma from October 6 - 11, 1990. Motion by Councilmember Kurle, second by Councilmember Brothers to approve Consent Agenda Items IV. A. through IV.G.2. MOTION CARRIED UNANIMOUSLY. 6-0. V. OLD BUSINESS -None. VI. NEW BUSINESS - None. VII. ORDINANCES AND RESOLUTIONS A. Ordinances City Attorney Marguerite Schellentrager read the titles of each ordinance aloud. Ordinance No. 4420 F 5.2.8 An Ordinance of the City Council of the City of Auburn, Washington, approving an appropriation of grant funds in the amount of twenty- two thousand three hundred fifty-four dollars ($22,354), and authorizing the Mayor to accept the grant from the Washington State Library Commission. Motion by Councilmember Kurle, second by Councilmember Burns to introduce and adopt Ordinance No. 4420. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Ordinance No. 4421 F5.4.3 An Ordinance of the City of Auburn, Washington, approving community development objectives and proposed projects and approving the appropriation of approximately two hundred and twenty-nine thousand dollars ($229,000) in 1990-91 Community Development Block Grant Funds. Ordinance No. 4422 03.10.1 CUP0002-90 An Ordinance of the City Conditional Use Permit to property located 123 feet within the City of Auburn April 16, 1990 of Auburn, Washington, providing for a allow construction of six duplexes on north of 14th Street N.E. in the 900 block, , Washington. Motion by Councilmember Burns, second by Councilmember Brothers to introduce and adopt Ordinance No. 4422. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Ordinance No. 4423 03.8 REZ0001-90 An Ordinance of the City of Auburn, Washington, providing for the rezoning of property located on the east side of "A" Street S.E., within the City of Auburn, Washington, changing the zoning classification thereof from R-3 (Duplex) to C-3 (Heavy Commercial). Motion by Councilmember Burns, second by Councilmember Brothers to introduce and adopt Ordinance No. 4423. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Ordinance No. 4426 F2.4.9 LID338 An Ordinance of the City of Auburn, Washington, approving and confirming the assessments and assessment roll of Local Improvement District No. 338 for the installation of waterlines, as provided by No. 4219 and levying and assessing the cost and expense thereof against the several lots, tracts, parcels of land other property as shown on the assessment roll. Ordinance No. 4426 was referred to the Public Works Committee under II.A.1 of these minutes. Ordinance No. 4427 F2.4.9 LID339 An Ordinance of the City of Auburn, Washington, approving and confirming the assessments and assessment roll of Local Improvement District No. 339 for the improvement of various streets within King County, Washington, as provided by Ordinance No. 4279, and levying and assessing the cost and expense thereof against confirms the final assessment roll on Local Improvement District No. 339. Ordinance No. 4427 was adopted by the Council under II.A.2. of these minutes. B. Resolutions PAGE 10 CITY OF AUBURN COUNCIL MEETING April 16, 1990 Mayor Roegner stated the Council is empowered to adopt resolutions as a whole. Resolution No. 2064 03.11 Authorizes contract City of Auburn and Child and Family Resource Referral to provide daycare telephone information and referral to Auburn residents seeking childcare assistance. Councilmember Whittall asked a question regarding Resolution No. 2064. Councilmember Whittall remembered discussions that occurred in the past where a request had been made for the Council to receive an inventory of social services in terms of availability in the Auburn area. Councilmember Whittall wondered if there were other results available. Senior Planner A] Hicks responded that regional and local inventories have been done and an indication of perceived priorities have been established. Rob Chave added the Planning Department has a draft Human Services Plan that is to be brought to Council at a later date where the Human Services Roundtable served as a background to the plan. The draft Human Services Plan will provide more conclusions specifically related to Auburn. Councilmember Burns amplified Councilmember Whittall's comments, and recalled the purpose of the Human Services Roundtable was to get a feeling for what social services were available in the south end, not just the City of Auburn, and what the majority of social issues were. For example, Councilmember Burns remembered specifically questioning the nature and extent of the homeless issue not just in Auburn but in South King County, and how should the City deal with it? How are other cities dealing with it? Councilmember Burns requested the information prepared address what social services are needed not only in Auburn, but also in the South King County area, be added as the first agenda item at the next Planning & Community Development Committee. Councilmember Whittall is to receive a copy of the agenda. 2. Resolution No. 2069 A I.3.4 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an interlocal agreement with King County containing provisions required for distribution and use of the Open Space Bond Fund. 3. Resolution No. 2070 03.5 PLT0001-90 PAGE 11 CITY OF AUBURN COUNCIL MEETING April 16, 1990 A Resolution of the City Council of the City of Auburn, Washington, approving the preliminary plat of Lakeland Hills, Divisions #6, #7 and #8 located on the east side of Lakeland Hills Division #2 and #3, extending south to the King-Pierce county line within the City of Auburn, Washington. 4. Resolution No. 2071 04.9.1 Street Improvement No. 265, 04.11.1 Water Improvement No. 184 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a supplemental agreement with Sverdrup Corporation for design services for the Stuck River Bridge project. 5. Resolution No. 2072 A3.13.4 A Resolution of the City Council of the City of Auburn accepting a conveyance of real property from King County. 6. Resolution No. 2073 A3.12.5 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a contract for public defense services between the City and Tucker & Stein, P.S. Motion by Councilmember Burns to approve Resolutions 2064, 2069, 2070, 2071, 2072, and 2073. Second by Councilmember Kurle. MOTION CARRIED UNANIMOUSLY. 6-0. VIII. MAYOR'S REPORT Steve Lancaster Mayor Roegner invited everyone to a coffee being held in honor of Steve Lancaster on April 27 at 3:00 p.m. in the Mayor's Office. A. Executive Session Mayor Roegner announced there would be a brief Executive Session to discuss litigation, and negotiations. Mayor Roegner anticipated there would be action as a result of the Executive Session, and recommended the Council recess at 8:30 p.m. The Council reconvened at 8:55 p.m. Firefighters Local 1352 Motion by Councilmember Brothers to authorize the Mayor and City Clerk to sign the contract with Fire Local 1352 subject to the local's ratification as summarized herein.
