CITY COUNCIL MEETING MINUTES
May 21, 1990 7:30 p.m.
1. CALL TO ORDER
The regular meeting of the City of Auburn Council was called to order by Mayor
Bob Roegner at 7:30 p.m, in the City of Auburn Council Chambers.
A. Flap Salute
Mayor Roegner led those in attendance in the pledge of allegiance.
B. Roll Call
Those in attendance included Mayor Bob Roegner and Councilmembers
Whittall, Wagner, Burns, Roland, Brothers and Kurle. Councilmember
Larson was excused. Staff members in attendance included Police Chief
Jake Evans, Fire Chief Bob Johnson, Parks & Recreation Director Len
Chapman, Finance Director Pat Dugan, Personnel Director Gretel Sloan,
Public Works Director Frank Currie, Planning Director Steve Lancaster,
Senior Planner Lynn Rued, City Attorney Marguerite Schellentrager, Deputy
City Clerk Gayle Butcher, and City Clerk Robin Wohlhueter.

2. Appointments

Motion by Councilmember Kurle, second by Councilmember Burns to
confirm the appointments of Mayor Roegner, Councilmember Burns,
Councilmember Whittall, and alternate Councilmember Brothers as
voting delegates for the Association of Washington Cities convention
being held in Wenatchee on June 12 through June 15, 1990.
MOTION CARRIED UNANIMOUSLY. 6-0.

Frank Miles, owner of Miles Sand & Gravel, commented on proposed
Ordinance No. 4411 appearing in tonight's agenda under VII.A.1. which

establishes interim zoning of R-1 (Single Family Residential) on all
properties located within the Lakeview Special Planning Area. Mr. Miles
requested the Council consider maintaining current zoning as M-2 (Heavy
Industrial District). Mr. Miles noted his investment of ten million dollars
provides work for one hundred people in Auburn. Mr. Miles feels the
zoning changes would impair his operation.
Mr. Miles expressed concern of the public process used in preparing for
Council review of Ordinance No. 4411, even though he spoke with Steve
Lancaster two weeks ago regarding the Lakeview Special Planning Area.

III. COUNCIL COMMITTEE REPORTS
A. Municipal Services

Chairman Pete Whittall reported the Municipal Services Committee met on
May 17, 1990 to discuss an appeal of a Private Investigator's License,
Resolution No. 2082 regarding Local Hazardous Waste Management Plan,
Auburn Solid Waste Management Plan, and out-of-state travel for the Fire
Department. The next Municipal Services Committee Meeting is tentatively
scheduled for May 30, 1990 at 5:30 p.m.
B. Planning & Community Development

Chairman Burns reported the Planning & Community Development
Committee met on May 14, 1990 at 7:30 p.m., and the minutes are of public
record. The next meeting of the Planning & Community Development
Committee is May 29, 1990 at 7:30 p.m.
C. Public Works

Chairman Kurle reported the Public Works Committee met this evening prior
to the Council meeting and the minutes will be of public record when
published. Chairman Kurle noted items discussed were Ordinance No. 4425
in which minor changes to the Ordinance will be recommended, a potential
resolution related to city wide truck routes, a contract with CH2MHill for
Comprehensive Storm and Surface Water Plan, a proposed amendment to the
metro agreement for sewage, proposed passenger loading zone, and three
requests for permission to advertise for construction. The next meeting of
the Public Works Committee is scheduled for June 4, 1990 at 5:30 p.m.
D. Finance

Chairman Brothers reported the Finance Committee met prior to the Council
meeting tonight at 7:00 p.m. Items discussed included the City Hall Space
Study, biennial budget for 1991 budget preparation process, and claims and
payroll vouchers. The next meeting of the Finance Committee will be prior
to the next Council meeting of June 4, 1990 at 7:00 p.m.

VI. NEW BUSINESS

Council consideration on the request of Mountain View Properties for final
plat approval of "West Beverly Hill Division IP" for an 18 lot single family
subdivision located south of 316th Street South and east of "W" Street N.W.
Motion by Councilmember Burns, second by Councilmember Kurle to
approve the final plat of "West Beverly Hill Division No. II", and instruct the
City Attorney to prepare the necessary ordinance.
MOTION CARRIED UNANIMOUSLY. 6-0.
VII. ORDINANCES AND RESOLUTIONS
A. Ordinances
City Attorney Marguerite Schellentrager read the titles of each ordinance
aloud.
Ordinance No. 4411
03.4.1.27,
An Ordinance of the City of Auburn, Washington, establishing interim
zoning of R-1 (Single Family Residential) on all properties located
within the Lakeview Special Planning Area, as defined within this
ordinance, within the City of Auburn, Washington.
Motion by Councilmember Burns, second by Councilmember Kurle to
introduce and adopt Ordinance No. 4411 applying interim zoning to
the Lakeview Special Planning Area.
Councilmember Whittall questioned staff on why the City is
considering interim zoning to the Lakeview Special Planning Area,
what effect this ordinance has on Mr. Miles current gravel operation,
and has Mr. Miles been allowed due process.
Planning Director Steve Lancaster stated a portion of the Lakeview
Special Planning Area is in conflict with the Comprehensive Plan
currently zoned for industrial use, and adopting interim zoning for the
Lakeview Special Planning Area will preserve a broad range of options
with regard to future Council actions. Ordinance No. 4411 would be
in effect while preparing Lakeview Special Planning Area as an
element of the Comprehensive Plan, and regulations would be
established for a period not to exceed two years.

Steve Lancaster said Ordinance No. 4411 covers Mr. Miles entire
gravel operation, and would not interfere with his current operation.
Mr. Lancaster noted Mr. Miles' permits for existing surface mining
operations are due to expire in April of 1991, and the interim zoning
will not effect review of Mr. Miles' permit.
Steve Lancaster noted Mr. Miles and his attorney had met with the city
two weeks ago and he was informed an ordinance would be before the
City Council regarding interim zoning for the Lakeview Special
Planning Area. Since that time, Mr. Miles has not offered any
opposition regarding interim zoning to the City.
Councilmembers Brothers and Kurle questioned whether or not Mr.
Miles would, under the proposed ordinance, be able to enhance his
operations. Steve Lancaster stated Mr. Miles could enhance his
operation by 25% of current assessed valuation of industrial property
subject to approval by the Hearing Examiner, and Council.
MOTION CARRIED UNANIMOUSLY. 6-0.
2. Ordinance No. 4425* (Kurle/Currie)

An Ordinance of the City of Auburn, Washington, which amends
Auburn City Code Chapter 10.28 entitled "Street Use Restrictions"
contained in Auburn City Code Title 10 entitled "Vehicles and Traffic"
in order to restrict all vehicles rated in excess of 30,000 pounds gross
weight to designated truck routes except for local deliveries numbering
less than ten per day and to provide authority to the City Engineer to
restrict vehicles making local deliveries numbering ten or more trips
per day under certain circumstances to designated routes.
Prior to Council action, Councilmember Kurle noted changes to
Ordinance No. 4425. The changes are as follows: 1.) Page four, line

"A ,St--&E-)); 2.) Page four, line 6, 12th Street S.E. - "M" S.E. to ((SR

S.E. to ((Pierce-C-o-Aine)) South City limits.
Councilmember Kurle commented C Street S.W. is a street convenient
to truck travel, but due to the condition of the street, improvements
would have to be made to make it adequate to handle heavy trucks.
Councilmember Kurle stated the Public Works Committee would be
looking at options to repair C Street S.W. in order to make it adequate
to handle heavy truck travel, and would be preparing a resolution
addressing truck travel on C St. SW, and a resolution addressing R St
SE when Stuck River Bridge is closed. These resolutions are to be
heard at the next Council meeting.
Motion by Councilmember Kurle to introduce and adopt Ordinance
No. 4425 as corrected. Second by Councilmember Wagner.

"Low Income Fee Policy".
Motion by Councilmember Burns, second by Councilmember Brothers
to introduce and adopt Ordinance No. 4428.

Ordinance No. 4431 amends Section 10.36.500 entitled "Passenger
Loading Zones" of Chapter 10.36 entitled "Stopping, Standing and
Parking" to provide a passenger loading zone at 100 "N" Street
Southeast.
Motion by Councilmember Kurle, second by Councilmember Wagner
to introduce and adopt Ordinance No. 4431.

An Ordinance of the City of Auburn, Washington, providing for the
rezoning of property located on the east side of "I" Street N.E. (if
extended) in the 3200 block, within the City of Auburn, Washington,

Motion by Councilmember Burns, second by Councilmember Brothers
to introduce and adopt Ordinance No. 4432.

authorizing the Mayor and City Clerk to execute a lease agreement
between the City of Auburn and Jeffrey David Weir, to provide
caretaker services at Game Farm Wilderness Park.
Motion by Councilmember Burns, second by Councilmember Kurle to

approving an amendment of the Comprehensive Plan, to add a Local

under SEPA pursuant to RCW 43.21C.060.
Motion by Councilmember Whittall, second by Councilmember Roland
