CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flag Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Whittall, Wagner, Burns, Roland, Brothers, and Kurle. Councilmember Larson was excused. Staff members in attendance included Police Chief Jake Evans, Fire Chief Bob Johnson, Parks & Recreation Director Len Chapman, Personnel Analyst Ruth Moore, Finance Director Pat Dugan, Public Works Director Frank Currie, Planning Director Steve Lancaster, Acting City Attorney Mike Reynolds, and City Clerk Robin Wohlhueter. Other staff members in attendance include Library Director Mary Stanton, Fire Marshall Ken Partridge, and Cultural Program Coordinator Josie Emmons Vine. C. Announcements and Appointments Announcements Hemlock Street S.E. 04.9.6 Chairman of the Public Works Committee Don Kurle briefly reported the Public Works Committee met prior to the Council meeting this evening to discuss the speeding problems on Hemlock Street. Mr. Kurle stated the Public Works Committee decided to study the issue further by sending out questionnaires not only on Hemlock but on Fir, Dogwood, Gingko, and other surrounding streets to determine how other citizens perceive the speeding problem on Hemlock to be, and what kind of solution the citizens residing in the area would like to see. A decision on the problem will come later. Appointments Proclamation A 1.8 Mayor Roegner read and presented a proclamation to Executive Director Marilyn LaCelle and Agnes Farr from Valley Cities Mental Health Center proclaiming August 20 through August 27, 1990 as Valley Cities Mental Health Center Week. r CITY OF AUBURN COUNCIL MEETING August 20, 1990 Mayor Roegner thanked Valley Cities Mental Health Center for their contributions made to the many resident of our community, and also announced their 25th Anniversary Open House on Friday, August 24, 1990 from 11:30 a.m. to 1:30 p.m. National League of Cities A5.3.9 Motion by Councilmember Kurle to appoint Councilmember Larson as the voting delegate for the City of Auburn, and Councilmembers Whittall and Brothers as alternates to represent the City's interest at the National League of Cities Conference. Councilmember Whittall seconds the motion. The National League of Cities Conference will be held from December 1, 1990 through December 5, 1990 in Houston, TX. MOTION CARRIED UNANIMOUSLY. 6-0. Executive Session Mayor Roegner announced there would be an executive session later this evening to discuss matters of personnel and land acquisition. D. Agenda Modifications A3.6.6 Agenda modifications are noted under Council agenda item III.A., VII.A.3, and VII.B.5. II. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings Application No. V0309* (Kurle/Currie) 03.9 VO309 For record keeping purposes the staff reports reflect a different application number of V-3-90, and legal notices associated with the vacation reflect V0309. Both applications numbers are included with the record. Mayor Roegner opened the public hearing. A petition has been filed by the owners of more than two-thirds of the property located for vacation of a street right of way known as 2nd Street N.E. between "A" Street and Division Street, within the City of Auburn, Washington. Mike Gherardini - 20 2nd Street, Auburn, WA Mike Gherardini is the Managing Director of Auburn General Hospital. While briefly discussing the history of Auburn General Hospital Mr. Gherardini directed attention to a slide projector showing the historical and present size of Auburn General Hospital. PAGE 2 CITY OF AUBURN COUNCIL MEETING August 20, 1990 After sixty-nine years of service to the Auburn community, Auburn General Hospital has evolved to a 149 bed full service acute care hospital with some of the most sophisticated equipment in the county. Mr. Gherardini stated Auburn General has had to be creative in design and space while expanding the Auburn General Hospital facility. Relative to the activity at Auburn General Hospital, the property has been landlocked for expansion. The vacation will enable expansion of services at Auburn General Hospital and relieve overcrowded conditions. Steve Manthev - 2616 4th Avenue, Suite 190, Seattle, WA 98121-1233 Once again, attention was directed to the slide projector while Mr. Manthey, Architect, explained the portion of Second Street Northeast between North Division Street and A where additions are planned for emergency services, parking, and building expansion. Motion by Councilmember Burns, second by Councilmember Kurle to close the public hearing. MOTION CARRIED UNANIMOUSLY. 6-0. Some of the Councilmembers raised questions regarding the street vacation, and City staff or Auburn General Hospital staff responded. Motion by Councilmember Kurle, second by Councilmember Burns to approve Application No. V0309 (V-03-90) providing for vacation of a portion of Second Street northeast between North Division Street and "A" Street Northeast, and to instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Application No. V0509« (Kurle/Currie) 03.9 VO509 For record keeping purposes the staff reports reflect a different application number of V-05-90, and legal notices associated with the vacation reflect V0509. Both application numbers are recorded with this application for an alley vacation. Mayor Roegner opened the public hearing. A petition has been filed by the owners of more than two-thirds of the property located for a vacation of a alley right of way located between Second Street Northeast and First Street Northeast, within the City of Auburn. Steve Manthev - 2616 4th Avenue, Suite 190, Seattle, WA 98121-1233 Steve Manthey, Architect representing Auburn General Hospital, explained briefly the location of the proposed vacation of an alley located between First and Second Street Northeast for the purpose of expansion of the existing emergency wing building. PAGE 3 CITY OF AUBURN COUNCIL MEETING August 20, 1990 Motion by Councilmember Kurle, second by Councilmember Burns to close the public hearing. MOTION CARRIED UNANIMOUSLY. 6-0. Motion by Councilmember Kurle, second by Councilmember Burns to approve the requested vacation under Application No. V00509 (V-05- 90), and to instruct the City Attorney to prepare the necessary public hearing. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Application No. REZ0004-90 03.8 REZ0004-90, 03.4.4 The request of Lone Properties to rezone from M-1 (Light Industrial) to C-3 (Heavy Commercial) along with a Comprehensive Plan Map amendment from Light Industrial to Heavy Commercial on property located on the north side of 16th Street N.W. between "A" and "B" Streets N.W. Mayor Roegner opened the public hearing. Dennis Holt 505 South Washington Avenue, Kent, WA Dennis Holt, representative for Lone Properties, explained the location of the proposed rezone property located on the north side of 16th Street N.W. between "A" Street N.E. and "B" Street N.W. Dennis Holt noted through discussions with staff there is some concern about permitted uses as they exist within the zoning code that are less than desirable given a C-3 permitted use designation. In negotiations with staff with Planning Commission concurrence, the proposal is for a contract C-3 zoning which provides certain restriction on certain uses that might otherwise be permitted in C-3, and staff and Planning Commission declarations of non-significance suggest what we might call a limited C-3 use. Motion by Councilmember Burns, second by Councilmember Brothers to close the public hearing. MOTION CARRIED UNANIMOUSLY. 6-0. Discussion centered around Councilmembers questions regarding wetlands, and potential uses. Motion by Councilmember Burns to approve the rezone and Comprehensive Plan Map amendment based upon the Findings of Fact, Conclusions and Conditions as outlined. MOTION CARRIED UNANIMOUSLY. 6-0. B. Traffic 04.9.6 Mayor Roegner distributed a letter dated August 20, 1990 from Yolonda C. Fall, 2105 Hemlock Street S.E., Auburn, WA 98002 regarding speeding problems on Hemlock Street S.E. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chairman Pete Whittall reported the Municipal Services Committee met on August 13, 1990 and the minutes are of public record. Mr. Whittall requested Council support of Ordinance No. 4453, and announced the next meeting of the Municipal Services Committee will be on August 27, 1990. B. Planning & Community Development Chairman Burns reported the Planning & Community Development Committee met on August 13, 1990 and the minutes are of public record. Chairman Burns urged support of items appearing on tonight's agenda. Chairman Burns moved for adoption of Resolution No. 2117 authorizing the Mayor and City Clerk to execute a Museum Services Agreement between the City and the White River Valley Historical Society. Councilmember Brothers seconds the motion. MOTION CARRIED UNANIMOUSLY. 6-0. The next meeting of the Planning & Community Development Committee is scheduled for August 27, 1990 at 7:30 p.m. C. Public Works Chairman Kurle reported the Public Works Committee met earlier this evening at 5:30 p.m. The Committee discussed Hemlock Street problems, fuel discount contracts, segregation of LIDS, and an underground electrical system contract. Chairman Kurle recommended approval of those items appearing on tonight's agenda. The next meeting of the Public Works Committee is scheduled for September 4, 1990. D. Finance Chairman Brothers reported the Finance Committee met prior to the meeting this evening at 7:00 p.m. Claims and payroll were reviewed and reported. The next meeting of the Finance Committee is scheduled for Tuesday, September 4, 1990 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes A 3.6.2 1. August 6, 1990 regular Council meeting minutes. B. Library F4.1.1 Council approval of out-of-state travel for Library Assistant Dixie Lish to San Jose, California from September 24 through September 28, 1990 in order to complete Hewlett-Packard hardware training for the Library. ORDINANCES AND RESOLUTIONS A. Ordinances The Acting City Attorney read the titles to Ordinance No. 4451 and Ordinance No. 4453 out loud. Ordinance No. 4451 03.5 PLT00036-88 An Ordinance of the City Council of the City of Auburn, Washington, approving the final plat of Braunwood Estates subdivision located on the west side of Bridget Avenue S.E. (if extended) in the 4700 block, within the City of Auburn, Washington according to the plat on file with the Clerk of the City of Auburn. Motion by Councilmember Burns, second by Councilmember Kurle to introduce and adopt Ordinance No. 4451. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Ordinance No. 4453 F4.6.1 Unclaimed Property, A3.5.53 An Ordinance of the City of Auburn, King County, Washington, amending Chapter 3.36, Auburn City Code, "Unclaimed Property" to PAGE 6 CITY OF AUBURN COUNCIL MEETING August 20, 1990 add a provision authorized by RCW 63.32.050 for disposition of certain unclaimed property by donation to non-profit charitable organizations. Motion by Councilmember Whittall, second by Councilmember Roland to introduce and adopt Ordinance No. 4453. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Ordinance No. 4454 04.9.1 Street Improvement 246 An Ordinance of the City of Auburn, Washington, authorizing the acquisition of certain property and property rights by eminent domain providing for the payment thereof; authorizing the City Attorney to prepare a petition for condemnation in the superior court in and for the Council of King and for the prosecution thereof for the acquisition of such property and property rights for roadway purposes (improvement of Harvey Road) and amending Ordinance No. 4361 by adding additional property to the condemnation. This Ordinance is considered by the Auburn City Council under VI11.A. as a result of an Executive Session. B. Resolutions Acting City Attorney Mike Reynolds read each resolution title out loud. Resolution No. 2116 04.4.9.1.2 Resolution No. 2116 authorizes an extension of Auburn Flight Service's fuel discount agreement with Auburn Airport through August 2, 1991. Motion by Councilmember Kurle, second by Councilmember Wagner to adopt Resolution No. 2116. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Resolution No. 2117 A3.8.20, A5.2.7 A Resolution of the City Council of the City of Auburn, King County, Washington, authorizing the Mayor and City Clerk to execute a museum services agreement between the City and the White River Valley Historical Society. This Resolution was adopted by the Auburn City Council under III.B of these minutes. 3. Resolution No. 2118 A3.13.2, 05.1.2 Resolution No. 2118 authorizes the Mayor and City Clerk to execute an easement for underground electric system between the City of Auburn and Puget Power for the power line that powers the City Well at Fulmer Field. PAGE 7 CITY OF AUBURN COUNCIL MEETING August 20, 1990 Motion by Councilmember Kurle, second by Councilmember Wagner to adopt Resolution No. 2118. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Resolution No. 2119 F2.4.1, F2.4.9 Resolution No. 2119 orders the Finance Director to make segregation on the original assessment roll of Local Improvement District (LID) 332 assessments 2B and as directed herein. Motion by Councilmember Kurle, second by Councilmember Wagner to adopt Resolution No. 2119. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Resolution No. 2120 04.4.9.1.2 A Resolution of the City Council of the City of Auburn, King County, Washington, authorizing the Mayor and City Clerk to execute a fuel discount agreement with Auburn Aviation Center Limited to expire August 2, 1991. Motion by Councilmember Kurle, second by Councilmember Wagner to adopt Resolution No. 2120. MOTION CARRIED UNANIMOUSLY. 6-0. VI11. MAYOR'S REPORT A. Executive Session Mayor Roegner announced there would be an Executive Session for approximately 15-20 minutes regarding property acquisition and personnel Mayor Roegner anticipated action as a result of the Executive Session. The Council recessed to Executive Session at 8:20 p.m The Council reconvened at 8:40 p.m. In order for the Council to take action on Ordinance No. 4454, Acting City Attorney Mike Reynolds read the title of Ordinance No. 4454 out loud as it appears under VII.A.3 of these minutes. Ordinance No. 4454 04.9.1 Street Improvement 246 Motion by Councilmember Kurle, second by Councilmember Burns to introduce and adopt Ordinance No. 4454. MOTION CARRIED UNANIMOUSLY. 6-0. ADJOURNMENT There being no further business to come before the Auburn City Council, the meeting adjourned at 8:41 p.m. A notation is made due to a typographical error on Ordinance No. 4453.
