CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flag Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Whittall, Wagner, Burns, Larson, Roland, Brothers, and Kurle. Staff members in attendance included Police Chief Jake Evans, Police Captain Ray Sherman, Fire Chief Bob Johnson, Parks & Recreation Director Len Chapman, Personnel Director Gretel Sloan, Finance Director Pat Dugan, Public Works Director Frank Currie, Planning Director Steve Lancaster, Acting City Attorney Mike Reynolds, and City Clerk Robin Wohlhueter. C. Announcements and Anoointments Announcements Sister City Comune di Forli. Italy A1.13 The City of Auburn Council recently authorized the Mayor to establish a sister-city relationship with Comune di Forli, Italy. Airport and city representives from the Comune Di Forli will be visiting the United States looking at airports in Chicago and Dallas Ft. Worth areas, and will visit Auburn on September 12 and 13, 1990. Mayor Roegner invited Councilmembers to participate in activities surrounding their visit. 1991 Centennial History Book A5.2.5 Mayor Roegner announced he had a chance to preview the City of Auburn's Centennial History Book "A Look Down Main Street" being published in conjunction with the 1991 Centennial celebration. City Hall Plaza Benches A5.2.7 Mayor Roegner stated there was a brief dedication ceremony prior to the Council meeting this evening dedicating two benches currently occupying our plaza outside of Auburn City Hall. Mayor Roegner announced on behalf of Eunice Beierlein Ryan and Norma Beierlein CITY OF AUBURN COUNCIL MEETING September 4, 1990 Stoltz, and their families the donation of two benches in memory of J. Eddie Ryan, and W.J. "Joe" Beierlein. Mayor Roegner stated both gentlemen came to Auburn because of the Northern Pacific Railroad; they both spent many years in the business community on Main Street; and both gave hundreds of hours of time and energy to the City of Auburn. Joe Beierlein came in the early 20's, and after a few years of railroading became a partner in a neighborhood grocery store on East Main Street. Mr. Beierlein became interested in city politics and in the early 30's was appointed to fill the unexpired City Council term of Dr. Merritt, after which, he was elected to a four year Council term. He left the Council when he was elected to the State Legislature and served the citizens of Auburn and South King County for twenty-six consecutive years as a member of the House of Representatives, while all this time operating a men's clothing store on Main Street that served as his office when not in Olympia. Of all of his accomplishments while a State Representative from the (old) 30th (now 31st) District, four prominent projects impact the people of Auburn everyday. The Howard Hansen Dam, a flood control dam on the Green River; Highway 18--the Echo Lake Cutoff; Highway 167-- the Valley Freeway; and last but not least, Green River Community College. It was no coincidence that he was the Chairman of the House Roads and Bridges Committee when the funds and route designs were planned for these state highways. Mr. Beierlein introduced the bill that brought a two-year college to Auburn. Eddie Ryan was raised and educated in Auburn, and after serving in World War II, left Northern Pacific Railroad and went to work with his father-in-law, Joe Beierlein in the largest and finest men's shop in the valley. He was appointed to the Auburn Planning Commission in 1947. Mr. Ryan served consecutive terms until 1985. Mr. Ryan's tenure influenced much of what surrounds you today. Notably, he fought to keep City Hall at this location, and spearheaded the free downtown off-street parking. Both men complimented each other. Eddie Ryan ran the store and worked in city government while Joe was in Olympia watching out for Auburn and the surrounding areas. On behalf of the families, we feel it is only fitting these permanent remembrances are here at City Hall on Main Street. Concluding his comments, Mayor Roegner introduced those family members in attendance this evening in memory of Eddie Ryan, and Joe Beierlein. Those in attendance include: Norma Beierlein Stoltz and Fred Stoltz, Joe Beierlein's daughter and husband from Fremont, California; Eunice Beierlein Ryan, Joe Beierlein's daughter and Eddie Ryan's wife; Joan Ryan Mason, Eddie and Eunice Ryan's daughter and Joe Beierlein's PAGE 2 CITY OF AUBURN COUNCIL MEETING September 4, 1990 granddaughter, and Mike Mason husband of Joan Ryan Mason; Michael Ryan Mason, Joe Mason's son, Eddie & Eunice Ryan's grandson, and Joe Beierlein's great-grandson, and Tracey Mason, wife of Michael Ryan Mason; and Mackenzie & Reid Mason, sons of Michael and Tracy Mason. Boy Scout Troop 330 A3.6.4.1 Boy Scouts Zack and Ashley Shepherd were in the audience tonight observing the Council meeting as part of earning their communications badge. 2. Appointments A3.8 Human Resources Board A3.8.11 Motion by Councilmember Larson, second by Councilmember Kurle to confirm the appointment of Bill Donais to the Human Resources Board filling a vacant position which will expire December 31, 1994. MOTION CARRIED UNANIMOUSLY. 7-0. D. Agenda Modifications A3.6.6 Agenda modifications are noted under Council agenda item IV.C.3 adding a bid award for Street Improvement No. 286. II. CITIZEN INPUT PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. 1991-1996 Six Year Street Program 04.9.3 Six Year Street Plan The Auburn City Council annually conducts a public hearing for the adoption of a Six Year Street Plan, and to review the work accomplished under the Six Year Street Program to determine current City street needs. All persons interested may be heard at this time to voice an opinion prior to the City Council making a determination regarding the Six Year Street Plan for 1991-1996. Mayor Roegner opened the public hearing. Katherine Smith 5519 Lakeland Hills Way S.E., Auburn, WA Katherine Smith commented on the intersection of Oravetz Road and Kersey Way. Ms. Smith stated this intersection has been dangerous in the past two years due to fast traffic and gravel trucks. Due to the work on the Stuck River Bridge there is now a detour, and Ms. Smith asked the Council to consider installing a street light as soon as possible. Bill Morchin 1345 East Main Street, Auburn, WA PAGE 3 CITY OF AUBURN COUNCIL MEETING September 4, 1990 Bill Morchin commented it has been hard keeping track of all the street modifications in the newspaper, but felt the following streets need admission to the street plan. The first street is immediately east of Massey's Grocery Store which is a concrete road that is fairly broken up, and forms a narrow north south bypass to Auburn Way South. The second street in need of repair due to parking problems and traffic flows, located on Henry Road off of "O" Street N.E. Mayor Roegner mentioned the Public Works Director has taken note of comments related to street problems in Auburn which will be taken under consideration. Mr. Morchin commended the Council for preserving open space in the City Park by not expanding the building. Dan Bosch 6109 35th Way S.E., Auburn, WA Dan Bosch commented on the condition of the street that forms the Muckleshoot Grade, and the portion of the Cabby Drive S.E. This street leads people down the hill from the Academy Drive into the Green River Valley and Highway 18 bypassing downtown Auburn. Mr. Bosch stated the street is used by a number of people, and is unsafe due to the number of potholes. Mr. Bosch requested the Council consider street repairs to this street. Motion by Councilmember Kurle, second by Councilmember Burns to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. B. Audience Participation - None. C. Correspondence - None. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chairman Pete Whittall reported the Municipal Services Committee has not met since the last Council meeting. The next Municipal Services Committee meeting is scheduled for Monday, September 10, 1990 at 4:30 p.m. B. Planning & Community Development Chairman Burns reported the Planning & Community Development Committee has not met since the last Council meeting. The next meeting of the Planning & Community Development Committee is schedule for September 10, 1990 at 7:30 p.m. C. Public Works Chairman Kurle reported the Public Works Committee met earlier this evening at 5:30 p.m. The Committee discussed bid awards on three road contracts, and two utility bill adjustments. Chairman Kurle recommended approval of those items appearing on tonight's agenda. The next meeting of the Public Works Committee is scheduled for September 17, 1990. Finance Chairman Brothers reported the Finance Committee met prior to the Council meeting this evening at 7:00 p.m. Claims and payroll were reviewed and reported, and the committee reviewed and recommends approval of Ordinance No. 4459. The next meeting of the Finance Committee is scheduled for Tuesday, September 17, 1990 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes A3.6.2 1. August 20, 1990 regular Council meeting minutes. B. D. 1991 Preliminary Budget F3.5 Request approval to call for a public hearing to be held before the City Council on Monday, September 17, 1990 in order to receive public comments, proposals, and suggestions for consideration during the preparation of the City of Auburn 1991 Budget. Recommend approval of utility adjustment to account # 112-0120 in the amount of $702.96 and account # 360-1650 in the amount of $182.82. 2. Recommend approval of utility adjustment to accounts #304-1230 in the amount of $166.92 and account #457-1620 in the amount of $267.24. Motion by Councilmember Larson, second by Councilmember Kurle to approve consent agenda items IV.A.1 through IV.E.2 including agenda modification IV.C.3. MOTION CARRIED UNANIMOUSLY. 7-0. V. OLD BUSINESS - None. VI. NEW BUSINESS A. Anolication No. REZ0005-90 03.8 REZ0005-90 City Council consideration on the request of Clifford and Cynthia Phillips for approval of a rezone from R-4 (Multi-Family) to C-3 (Heavy Commercial) located at 205 "C" Street S.W. Motion by Councilmember Burns, second by Councilmember Kurle to approve the rezone based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions, and to instruct the City Attorney to prepare the necessary Ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. B. Annlication No. CUP0004-87 A3.10.1 Council to consider the request of KBSG Radio for approval of a modification to Ordinance No. 4217 (Conditional Use Permit No. CUP0004- 87) to allow the existing towers to be painted orange and white on property located on the south side of Auburn-Black Diamond Road in the 3000 block. Motion by Councilmember Burns, second by Councilmember Brothers to approve the modifications to Ordinance No. 4217 (Conditional Use Permit No. CUP0004-87) based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions, and to instruct the City Attorney to prepare the necessary Ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances PAGE 6 CITY OF AUBURN COUNCIL MEETING September 4, 1990 The Acting City Attorney Mike Reynolds read the titles to each ordinance out loud. Ordinance No. 4456 03.8 REZ0004-90, 03.4.4 An Ordinance of the City of Auburn, Washington, providing for the rezoning of property located on the North side of 16th Street N.W. between "A" Street N.E. and "B" Street N.W., within the City of Auburn, Washington, changing the zoning classification thereof from M-1 (Light Industrial) to C-3 (Heavy Commercial) and Comprehensive Plan Map amendment from Light Industrial to Heavy Commercial. Motion by Councilmember Burns to introduce and adopt Ordinance No. 4456, second by Councilmember Brothers. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 4457` (Kurle/Currie) 03.9 V-05-90 An Ordinance of the City Council of the City of Auburn, Washington, approving the vacation of an alley right of way located between Second Street Northeast and First Street Northeast, within the City of Auburn, Washington, and retaining a utility easement for the City. Motion by Councilmember Kurle, second by Councilmember Wagner to introduce and adopt Ordinance No. 4457. MOTION CARRIED. 6-1 with Councilmember Larson voting no. 3. Ordinance No. 4458 03.9 V-03-90 An Ordinance of the City Council of the City of Auburn, Washington, approving the vacation of a street right of way known as Second Street Northeast between "A" Street and Division Street, within the City of Auburn, Washington, and retaining a utility easement for the City. Motion by Councilmember Kurle, second by Councilmember Burns to introduce and adopt Ordinance No. 4458. MOTION CARRIED. 6-1 with Councilmember Larson voting no. 4. Ordinance No. 4459 F4.1, A3.5.5.2 An Ordinance of the City of Auburn, Washington, amending Auburn Codified City Ordinance 2.54.080 (Ordinance No. 3448) relating to the Advance Travel Expense Revolving Fund. Motion by Councilmember Brothers, second by Councilmember Roland to introduce and adopt Ordinance No. 4459. MOTION CARRIED UNANIMOUSLY. 7-0. PAGE 7 CITY OF AUBURN COUNCIL MEETING B. Resolutions September 4, 1990 Acting City Attorney Mike Reynolds read each resolution title out loud. 1. Resolution No. 2122 04.9.3 Six Yr Street Plan A Resolution of the City of Auburn, Washington, adopting the 1991- 1996 biennial revisions and extensions of the Comprehensive Street Program of the City of Auburn, pursuant to R.C.W. Chapter 35.77 of the laws of the State of Washington. Motion by Councilmember Kurle to adopt Resolution No. 2122 with provisions that the Public Works Committee examine the issues raised during the public hearing tonight, and publish results of the examination. Councilmember Burns seconds the motion as amended by the Public Works Committee Chair. MOTION CARRIED UNANIMOUSLY. 7-0. VIII. MAYOR'S REPORT - None A. Executive Session - None. IX.
