CITY. COUNGIL MEETING MINUTES

~ I. CALY. TO ORDER
The regular meeting of the City of Aubum Council was called to order by
Mayor Bob Roegner at 7c30 p:m. in the City of Aubum Council Chambers. A. Flag Salute
Mayor Roegner led those in attendance in the pledge of allegiance.
B. R0l 1 Call
Those in attendance included Mayor Bob Roegner and
Councilmembers Whittall, Wagner, Burns, Larson, Roland, Brothers,
and Kurle. Staff inembers. in attendance included Police Chief Jake
Evans, Fire Chief Bqb Johnson, Parks & Recieation Director Len
Chapman, Personnel Director Gretel Sloan, Finance Director Pat
Dugan, Planning Director Steve Lancaster, Acting City Attomey
Mike Reynolds, and City Clerk Robin Wohlhueter. Other staff in
attendance included Police Lieutenant Bob Almy.
C. Announcements and Annointments
1. Announcements

Mayor Roegner introduced Steve Shelton, the top candidate for
the new city attome,y. position replacing M. Schellentrager. Mr.
Shelt_on is currently employed as a member of the Pierce
County Prosecuting Attomey's staff specializing in land use.
Mayor Roegner will ask the council to coafirm Mr. Shelton's
appointment at the December 17, 1990 regular Council meeting.

Item VII.A.3 (Ordinance No: 4467) will not be considered tonight.due
to an extension to December 11, 1990 in subinitting 1991 Property
Tax Levies to King County. -

Mayor Roegner acknowledged the letter dated November 6, 1990
from Mrs. Peggy Vonfeldt regarding the udlity billing System which
has been refened to the Finance Committee for review.
III. COUNCII. COMMITTEE REPORTS
A3.7.6
A. Municinal Services
Cliairman Pete Whittall reported the Municipal Services Committee
met on November I3, 1990 and the minutes are of public record.
Chairman Whittall noted their discussion centered around Building &
Fire Code Ordinances, and the proposed recycling program.
Chairman Whittall announced Councilmember Wagner will replace Councilmember Roland to represent the Municipal Services
Committee on the Local Emergency Services Planning and Advisory
Committee (LESPAC). The next Municipal Services Committee
meeting is scheduled for December 10, 1990 at 4:30 p.m.
B. Planning & Communitv-Develonment
Chairman Burns reported the Planning 8c Community Development
Committee has not met since the last Council meeting. The next
meeting of the Planning & Community Development Committee is
scheduled for November 26, 1990 at 7:30 p.m.
C. Public Works
Chairman Kurle reported the Public Works Committee met earlier
this evening at 5:00 p:m. to discuss the proposed recycling plan,
water and sewer rate study recommendations.including 1991 Metro
sewer rates, Airport office space lease with Car-Temps, Inc., storm
utility system development charge in rural azeas, and two utility bill
adjustments. The minutes will be of public record when published.
The next meeting of the- Public Works Committee is scheduled for
December 3, 1990 at 5:30 p.m.
D. Finance
Chairman Brothers reported the Finance Committee met prior to the
Council meeting this evening at 7:00 p.m. to discuss Ordinance No.
4467 which has been refened back to committee, utility rate and
billing, and claims and payroll. The next meefing of the Finance
Committee is scheduled for Monday, December 3, 1990 at 7:00 p.m.
Due to committee members attending the 1990 Congress of Cities in
Houston, Texas, Chairman Brothers stated Councilmembers Roland
and Burns will serve as temporary committee members with
' Councilmember Roland chairing the committee at the December 3,
1990 regular scheduled meeting.

Request approval to call for a public 'hearing to be held on December
3, 1990 in order to receive public input on the 1991 Budget.

1. Recommend approval of utility adjustment fo account 308-4110
in the amount of $140.94 and account #460-1740 in the amount
of $483.72.
' 2. Recommend approval of utility adjustment to account 303-3030
in the amount of $428.28.
Motion by Councilmember Larson, second by Councilmember
Kurle to approve Consent Agenda Items IV.A.1 through IY.E.2:

A. Annlication No. 60A-90 _ _
03.4.2.1.2 Zoning Code Amendment
Council consideradon on the request to amend Chapters 18.04
(Definitions) and 18.74 (Adult Motion Picture Theaters) of the
Auburn Zoning Ordinance No. 4229 to provide a more
comprehensive approach with regard to adult uses.
Motion by Councilmember Bums to.approve the amendments to
Chapter 18.04. (Definitions) and 18.75 (Adult .Motion Picture
Theaters) and to instruct the City Attorney to prepaze the necessary
ordinance. Second by Councilmember Brothers.

Under discussion, some Councilmembers questioned the effect this
ordinance would have on cunent businesse"s offering adult
entertainment, and~ where the aumber of feet, "within one thousaad
" feet" was derived.
- Planning Director Steve Lancaster responded as far as the city knows
most businesses selling adult books and videos in. Auburn do not have ,
twenty percent: or more- of the value of their stock as defined in the
amendment; and current establishment5 having more than twenty
percent of their trade stock selling adult books and videos are
entitled to non-conforming use rights according to city code. .
Acting City Attorney Mike Reynolds verified the courts have ruled
that the one thousand feet requirement is appropriate.
MOTION CARRIED UNANIMOUSLY. 7-0.
B. Annlication No. 61A-90
03.4.2.1.2 Zoning Code .Amendment
Council consideration~ on the request to amend Chapter 18.48
(Supplemental Development Standards) of the Auburn Zoning
Ordinance No: 4229.to provide for the ability for awnings, marquees,
etc. to project from the building, into the setback areas and over
sidewalks. Motion by Conncilmember Burns, second by Councilmember Kurle
to approve the amendment to Chapter 18.48 based upon the
recommendation of the Planning Commission and to instruct the City .
Attorney to prepare the necessary Ordinance. MOTION CARRIED iTNANIMOUSLY. 7-0.

03.5 .PLT0003=89 An Ordinance of the City Council of the City of Auburn,
Washington, approving the Final Plat of York's Division No. 1
located on the south side of 33rd S.E. in the 1400 block, within
the City of Aubum, according to the plat on file with the
Clerk of the City of Auburn.
. Motion by Councilmember Burns, second by Councilmember .
Brothers to introduce and adopt Ordinance No. 4465.

An Ordinance of the City of Auburn, Washington, approving
extension of a Non-Conforming Surface Mine which will allow .
the ¢ontinuation of mining of a 46.28 acre parcel of property
located on the easterly side of "M'-' Street S.E. between 12th.
Street and Highway.18.
Motion by Councilmember Burns, second by Councilmember
Kurle to introduee and adopt.Ordinance No. 4466.
MOTION CARRIED UNANIMOUSLY. 7-0.
3. Ordinance No. 4467
An Ordinance of the City of Aubum, Washington, determining
and fixing the amount to be raised by ad valorem taxes for
fiscal yeaz 1991 for the City of Aubum, Washington, pursuant
to the provisions of R.C.W. 35A.33.135.
Ordinance No: 4467 was referred back to the Finance
Committee under agenda modifications for, review by the
Council at its December 3, 1990 regular meeting.

Acting City Attorney Mike Reynolds read the tide of Resolution No.
2135 out loud.

04.4.9.1.3 .
A Resolution of the City Council of the City of Aubum,
Washington, authorizing the Mayor and City Clerk of the City
of Aubum to enter into a lease agreement with Car-Temps
Rent-A-Car for office space located in the Auburn Flight
Center building sifuated at the Auburn Munic.ipal Airport.
Motion by Councilmember Kurle, second by Councilmember
Wagner to approve an office lease to Car-Temps, Inc., as
provided in Resolution No. 2135.
MOTION CARRIED UNAIVIMOUSLY. 7-0.
VIII. MAYOR'S REPORT
Christmas Tree/Luncheon
As in the past, Mayor Roegner announced the City Council. would be
piding a Christmas tree for City Hall. This year staff will decorate the
tree instead of the Councilmembers and their spouses due to some
Councilmembers attending the 1990 Congress of Cides meeting in Houston,
Texas.
Mayor Roegner invited Councilmembers to attend the annual Christmas _
luncheon on December 5, 1990.

Mountain View Cemeterv's IOOth Anniversarv

Mayor Roegner commented on the dedication held on November 8, 1990 at
Mountain View Cemetery in celebration of its IOOth year in serving the
needs of the Aubum community.
