CALL 'I'O ORDER The regulaz meeting of the City of Aubum Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flag Salute Mayor Roegner led those in attendance in tNe pledge of allegiance. B. Roll 11 Those in attendance included Mayor Bob Roegner and Councilmembers Wagner, Whittall, Burns, Larson, Roland, Brothers, and Kurle. Staff members in attendance included Police Chief:Jake Evans, Assistant Fire Chief Steve Shropshire, Parks & Recreation Director Len Chapman, Personnel Director Gretel Sloan, Finance Director Pat Dugan, Planning Director Steve Lancaster, Senior Planner Lynn Rued, Acting City Attorney Mike Reynolds; City Attorney Steve Shelton, Deputy City Clerk Gayle Butcher and City C1erk Robin Wohlhueter. Other staff inembers in attendance -included Librar:y D'uector Mary Stanton, Fire Marshall Wayne Senter, Building/Land Use Code Enforcement Manager Alice Conrad, Utilities Engineei Carey Roe, and Captain Sherman. C. Announcements and Annointments 1. Announcements Auburn Honors Elected' Officials A19 Seated in the front row of the Council Chambers, Mayor Roegner directed attention to State. Representatiyes Ernie Crane and Mike Todd, and Washington State Senator Frank Warnke. A reception was held prior to the Council meedng honoring all three elected officials of the State of Washington for their devoted service in our community. Mayor Roegner read and presented a proclamation honoring each official for their many accomplishments state-wide, and city-wide. In addition, Mayor Roegner presented a key to the city to each in appreciation o€ their hard work. 2. Annointments a. Citv Attornev A4.5.3 Motion by Councilmember Larson, second by Councilmember Kurle to confirm the appointment of Steve Shelton as Auburn's new City Aftorney. MOTION CARRIED UNA1vIMOUSLY. 7-0: Planning Commission On -behalf of the Council, Mayor Roegner extended a formal , expression of sorrow at the death of Linn Burnsworth who served on the City of Auburn's Planning Commission. AP,enda Modifications 03.8 REZ0008-90, F3.3 90 Amendments Agenda mqdifications include a letter dated December 17, 1990 from Teresa Watts regarding Application No. REZ0008-90 which appeazs under agenda item II.A.1, and memorandum dated December 13, 1990 from Parks & Recreation Director Len Chapman regazding the 1990 Budget Adjustments appearing under agenda item ; VII.A.17. H. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings 1. Annlication No. REZ0008=90 03.8 Application No. REZ0008-90 The request of Roger D. Sohn to rezone from R-2 (Single Family) to C-2 (Central Business District) property located at, 114 "D" Street S.E. Prior to opening the public hearing, Mayor Roegner asked Planning Director Steve Lancaster to give a brief overview of the proposed rezone application. _ Steve Laneaster stated the rezone request before the Council this evening lies in an area downtown where commercial uses converge with single family. Mr. Lancaster pointed out by recommending approval of the rezone request subject to condidons it provides an opportunity for a smooth transition from other surrounding zoning and laad uses. Directing attention to the overhead projector, Mr. Lancaster identified where zoning and land use changes occur: _ Mayor Roegner opened the public hearing. Mvron Massev - 340 East Main Street, Auburn, WA Myron Massey questioned the Council with regard to parking and traffic issues within the surrounding area of the proposed rezone. . PAGE 3 CITY OF AUBURN COUNCIL MEETING December 17, 1990 ' Michael Bocatch - 111 8th Street S.E.,. Aubum, WA Michael Bocatch resides near the area of the proposed rezone. Mr. Bocatch.raised questions with regard to the intent of policies established for land use, the City's Comprehensive Plan and zoning, and the City's Comprehensive Plan Map. Mr. Bocatch did not feel the Hearing Examiner's recommendations, Findings of Fact and. Conclusions of law aze consistent with established policies. Wilson Esterlv - 117 D Street S.E., Aubum, WA Wilson Esterly is a resident near the proposed rezone property. Regarding the proposed rezone, Mr. Esterly's questions centered around actual location of the dental lab in the home, sfaff levels, parking allocations, and code enforcement. Yvonne Kilburn - 115 E St S.E., Aubum, WA Yvonne Kilburn expressed concern of large trucks accessing Dr. Sohn's property for deliveries, and increases in traffic. Joe Brown - 202 D St S.E., Auburn, WA Joe Brown. expressed concem of parking in the proposed rezone area. Mr. Brown mentioned there are two alleys made of gravel and oil and expressed concern that additional traffic would adversely affect the area. Alex Kim- 114 D St S.E., Auburn WA Alex Kim, , resident of proposed property and currently Dr. Sohn's Lab Technician. Mr. Kim briefly explained the benefit of having a dental lab located in the basement of his home. Mr. Kim stated he and his wife have two cars which they park in the garage. The garage will remain a garage. Dr. Sohn - 110 D Street S.E., Auburn, WA Dr. Sohn is the applicant.on Application No. REZ0008-90. Dr. Sohn encouraged the Council to approve his rezone request on the basis the current dental 1_ab is pa.rt of his dental practice which not only services his office, but bther dental offices as well. Upon approval of the proposed rezone, Dr. Sohn stated the dental lab would move to the basement of 114 D St S.E. and would also be utilized as a lab technician's residence.. Dr. Sohn addressed the issue of parking, and commented on other cities who have issued permits establishing dental labs in homes. Motion by Councilmember Burns, second by Councilmember Brothers ' to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. Mayor Roegner requested questions from the Council. PAGE 4 CITY OF AUBURN COUNCIL MEETING December 17, 1990 The Council deliberated oyer the issues surrounding the proposed rezone, and addressed concerns of the residents and the applicant. Some of the issues included traffic, zoning, boundaries established in the Comprehensive Plan, staff levels, and enforcement of the ordinance. Motion by Councilmember Burns to approve the rezone based upon the Hearing Examiners Findings of Fact, Conclusions and Conditions and to instruct the City Attomey to prepare the necessary Ordinance with the exception of the following amendment to the recommendations of the Hearing Examiner at line three. Conversion of the garage and/or the house to an accessory dental use shall be dependent upon the Planning Director approving the site plan that .meets the requirement of the Zoning Ordinance, and the remainder of the site shall remain residential in character and use. Councilmember Larson seconds the motion. Discussion centered around where the lab technician's work will be generated from if the rezone is approved, if the dental lab is moved from its existing location, and what requirements there are limiting the number of employees, Mayor Roegner requested the Council vote on the amended motion. MOTION DEFEATED. 1-6 with Councilmembers Whittall, Wagner, Larson, Brothers, Roland, and Kurle voting no. Motion by Councilmember Kurle to approve the rezone based on the following amendments to the Hearing Examiner's recommendation. " Condition #1 is amended to read: The house addressed as 114 "D" _ Street S.E. and situated on Lot 7, Block 1, Truitt's First Addition shall only be used as an accessory use to the dental office located on lots #5 and #6 of Block 1, Truitt's First Addidon. The house is not to be used as a dental office or la6oratory independent from the existing dental office. Any expansion of the existing dental office will be considered on its own merits. No portion of lot 7 shall be used to meet the developinenf §tandaids associated with the existing dental office. Employees of the dental laboratory will be limited to two residents of the home. Condition #2 is deleted, and Condidon #3 is amended to read~ Conversion of the basement to an accessory dental use shall be dependent' upon the Planning Director approving a site plan that meets the requuements of the Zoning Ordinance. The remainder of ttie site shall remain residential in character and use. Second by Gouncilmember WhittalL MOTION CARRIED. 5-2 with Councilmembers Burns and Brothers voting no. Storm Water Management Plan Anolication No. COM0004-90 04.8, 03.4.3, 03.4.1:10 ?he request of the Mayor and City Council to receive public comments : prior to adoption and implementation of the proposed Comprehensive Drainage Plan which includes policies providing guidance to the City's Storm Drainage Utility, and provides environmental review of development-related impacts as an element of the Comprehensive Plan. Mayor Roegner opened the public hearing. No one spoke for or against the Storm Water Management Plan. Motion by Councilmember Wagner, second by. Councilmember Burns to close the public hearing. III: COUNCIL COMMITTEE REPORTS A3.7.6 , A. Municibal Services . Chairman Pete Whittall reported the Municipal Services Committee met on December 10; 1990 and the: minutes are of public record: The next Municipal Services Committee meeting is scheduled for January 14, 1991. B. Plannink Communitv Develonment , Chairman Burns reported the Planning & Community Development Committee has not met since the last Council meeting. Chairman Burns . Public Works Chairman Kurle reported the Public Works Committee met prior to the Council meeting this evening to discuss Resolution No. 2143, . a supplemental agreement with Bell-Walker Engineers for increased work scope, and utility bill adjustments. The next meeting of the Public 'Works Committee is scheduled for January 7, 1991. D. Finance Chairman Brot}iers repoited the Finance Committee met prior to the Council. meeting this evening at 6;30 p.m. to discuss an interfund loan, Ordinance No. 4471, Ordinance No. 4472, Ordinance No. 4476, Ordinance No. 4478, Ordinance No. 4477, and claims and payroll. MAYOR'S REPOYtT Councilmember Roland Resienation A3.10.8 - Councilmember Roland read and submitted her letter of resignation dated December 17, 1990 of her Council position Number One. Councilmember Roland is leaving her Council position effective January 1, 1991 in order to continue her representation in the community as a member of the Washington State House of Representatives. Councilmember Roland extended thanks to the Mayor, Council, and Citizens of Auburn. - Mayor Roegner accepted Councilmember Roland's letter of resignation, and indicated the process for appointing a replacement would begin in January. A. Executive Session 1Vlayor Roegner announced there would be a brief executive session for approximately fifteen minutes to discuss personnel issues. Mayor Roegner anticipated the Council will take action as a result of the executive session, and recommended a recess at 9:10 P.M. ~ The meeting reconvened at 9:30 p.m. Councilmember Brothers moved that, 01, the Council authorizes approximately 596 cost of living increase to be applied to all unaffiliated employees with a restructuring of the salary schedule consistent with the Mayor's recommendation (the first step of each range would increase by 5%; and each step would increase from that first step by a rate of 3.596).. #2, an average of 7.296 for all department heads. #3, the Mayor's base salary be set at $69,383,60. In addition to this base salary, and in addition to other _ benefits afforded unaffiliated employees, the Ciry Council authorizes payment by the City of the maximum amount allowable under the deferred compensation program.
