COUNCIL MEETING MINUTES
January 5, 1987 7:30 p.m.
CALL TO ORDER

i. A. Flag Salute
The regular meeting of the City of Auburn Council
was called to order by Mayor Bob Roegner at 7:30 p.m. in the
City of Auburn Council Chambers. Mayor Roegner led those in
attendance in the pledge of allegiance.
B. Roll Call
Those in attendance included Mayor Bob Roegner, and
Councilmembers Whittall, Walters, Burns, Larson, Brothers,
Wisner, and Kurle. Staff inembers included City Attorney Jack
Bereiter, Planning & Community Development Director Mary
�,cCumber, Parks & Recreation Director Len Chapman, Public Works
Director Frank Currie, Finance Director Pat Dugan, Personnel
Director Gretel Sloan, Assistant Fire Chief Monroe Shropshire,
Police Chief Jake Evans, Senior Planner Lynn Rued, Library
Director Mary Stanton, and City Clerk Robin Wohlhueter.
C. Announcements and Appointments
1. Proclamation - Greg "MUtt" Haugen '
Mayor Roegner requested all Auburn citizens join in
honoring Greg "Mutt" Haugen as the City of Auburn top
1986 spor�s stars for his professional accomplishments as a
boxer.
2. Mayor Pro-Tem For Year 1987
Motion by Councilmember Kurle second by Councilmember
Larson to appoint Pat Burns to serve as Mayor Pro-Tem for
the year 1987.
MOTION CARRIED UNANIMOUSLY. 7-0.
3. Proclamation - Don Kurle
Mayor Roegner presented a proclamation for all citizens of
the City of Auburn to thank Don Kurle for serving as Mayor
Pro-Tem for the year 1986, and for his continued years of
service on the Auburn City Council.
- D. Agenda Modifications
Mayor Roegner stated the agenda modification is found under
VII. Ordinances and Resolutions on Resolution 1719 which rela-
tes to and calls for a public hearing before the City Council
on February 2, 1987 for the purpose of determining whether or
not a certain portion of 3rd Street N.E. should be vacated.

Citizen Input - None
Public Hearings
1. Lance Annexation Application No. Anx-3-86
The Council of the City of Auburn is to conduct a public
hearing regarding the annexation of approximately one acre
of land into the City of Auburn commonly known as 28421
85th Avenue South, Auburn, WA, and invites all interested
,persons to appear and voice approval or disapproval of the
annexation. �

Mary McCumber, Director of Planning & Community Development,
briefly highlighted the issues before the Council. Mary
McCumber stated an annexation petition and rezone applica-
tion had been received and is consistent with the City's
Comprehensive Plan policies. The parcel is located in an
area of transition to industrial uses with property deve-
loped as industrial to the west and a preliminary plat has
been approved for industrial development to the south. It
was noted as a condition of the rezone any change from
single family use to a use allowed by the M-1 zone shall be
required to provide the necessary infrastructure including
the dedication of 15 feet of right-of-way adjacent to the
property on 85th Avenue South.
Mary McCumber stated the owner/developer would have to work
out how they would obtain urban facilities if they want to
change too more intensive use than the existing single
family house, and the rezone would only come into effect if
the annexation is approved by the Boundard Review Board.
Mayor Roegner drew attention to agenda item under
correspondence pertaining to the letter and petition sub-
mitted to the City by Margaret Sheehan on December 19, 1986
protesting this annexation and rezone.
Mayor Roegner opened the public hearing.
Greu Sparkmen 8003 South 277th, Kent WA
Greg Sparken, Real Estate Representative, stated there is
no other way to market Margaret Lance's property for its
highest and best use, and requested the Council to approve
the annexation and re2one to M-1.
Marqaret Sheehan - 28307 85th Avenue South, Kent, WA
Margaret Sheehan stated 100 percent of the property owners
are against this annexation. Margaret Sheehan expressed
concern over the costs that wou�d be incurred for
neighboring property owners, and felt a majority of people
affected by annexation should have an impact on decision.
Dennis Sheehan - 28307 85th Avenue South, Kent, WA
Dennis Sheehan expressed concerns over reasons why rezone
should be M-1. Dennis Sheehan felt if 2D properties in
this area are zoned single family residential the Council
should consider leaving the proposed annexation at single
family zone. Dennis Sheehan indicated he was not informed
of this public hearing, and expresed concern regarding the
road access if annexation is approved.
Mary Hartman - 20301 353rd Avenue S.E., Rent, WA
Mary Hartman expressed concern over her six rental proper-
ties that are near the proposed annexation. Mary Hartman
pointed out there is extreme flooding conditions on her
property ever since "Dedicated Trucking" has maintained the
property to the south of hers. It was noted that Storm
Drainage Engineer Carey Roe has been working with Dedicated
Trucking to install a drainage system. Mary Hartman stated
traffic impacts is a concern if the proposed annexation is
approved.
Lester Williams - 28207 85th Avenue 'South, Rent, WA
Lester williams expressed concerns regarding an increase in
his taxes associated with new roads, sidewalks, and sewers.
Lester Williams stated he would vote no on this annexation.
Leonard Fenster - 28330 85th Avenue South, Kent, WA
Leonard Fenster stated he would not be able to incur the
costs associated with new roads, sidewalks, and sewers.

Katherine Parker - 28222 85th Avenue South, Kent, WA
Katherine Parker stated the traffic increase would be a
detriment to this area, and she would not be able to incur
the costs associated with development.
Larry Lance - 11719 159th Avenue South, Renton, WA
� Larry Lance noted the current road is old and will need to
be improved. Larry Lance recommended the Council approve
the annexation and rezone because the property would be at
its highest and best use at the M-1 zone since the proposed
property borders the City of Auburn land which is zone M-1.
Motion by Councilmember Burns second
Walters to close the public hearing.
MOTION CARRIED UNANIMOUSLY. 7-0.

Discussion centered around various solutions to the con-
cerns of property owners near the proposed annexation such
as forming ao LID, long range planning of the proposed
site, how the City can protect neighborhoods, and traffic
concerns in proposed area.
Motion by Councilmember Burns second by Councilmember
Walters to approve annexation and instruct the Planning
staff to prepare a notice of intention to be forwarded to
the State Boundary Review Board at King County, and to
instruct the City Attorney to prepare the necessary resolu-
tion indicating the Council's action.
MOTION CARRIED. 6-1 with Councilmember Brothers voting no.
2. Lance Rezone Application No.44-86
The Council of the City of Auburn is to conduct a. public
hearing regarding the request to rezone from SR (County
Residential) to M-1 (Light Industrial) in conjunction with
the proposed annexation of property located on the north
city limits on the west side of 85th Avenue South.
Mayor Roegner opened the public hearing.
Mayor Roegner stated the public testimony. received
for or against agenda item II.B.1 has been made part of the
record as testimony received on the rezone of application
no. 44-86.
Motion by Councilinember Burns second by Councilmember
Wisner to close the public hearing.
MOTION CARRIED UNANIMOUSLY. 7-0.
Councilmember Iturle questioned if the Council would take
further action on this plat if the property is approved for
annexation and rezone, if a Li� could be formed in order to
improve roads, and what protection the property owners in
order to maintain their neighborhood.
Mary McCumber pointed out the Council will take action on
the final plat to the south of the proposed rezone, and
requirements for the infrastructure will be met prior to
issuance of building permits.
It was noted an agreement to annex would provide the pro-
perty owners protection in maintaining their neighborhood.
Some of the Councilmembers expressed concern over
"Dedicated Trucking" completing their requirements per-

taining to landscaping. Frank Currie stated the property
has been landscaped, but "Dedicated Trucking"
has not met their requirement for a site obscuring fence.
There is a performance bond which the City can use in order
to complete the project.
Councilmember Wisner requested a report back to the
Council regarding "Dedicated Trucking" property.
Motion by Councilmember Burns second by Councilmember
Walters to approve the M-1, Light Industrial, zone based
upon the Findings of Fact and Conditions as outlined, and
to instruct the City Attorney to prepare the necessary
ordinance.
MOTION CARRIED UNANIMOUSLY. 7-0
The meeting recessed at 8:20 p.m.
The meeting reconvened at 8:25 p.m.

29, 1986 in protest to proposed annexation and rezone of
property located at 28421 85th Avenue South.
COUNCIL COMMITTEE REPORTS

Municiaal Services
Linda Wisner; Chairman, stated the Municipal Services Committee
did not meet, and the next regularly scheduled meeting will be
held on January 15, 1987. �
Planninq & Community Development
Chairman Burns stated the Planning & Community Development
Committee did not meet, and the next regularly scheduled meeting
wil be held on January 13, 1987.
Public Works
Chairman Larson reported the Public Works Committee did not
meet, and the next regularly scheduled meeting will be January
22, 1987.
Finance
Chairman Kurle indicated the Finance Committee met at 6:30 p.m
before the Council meeting this evening. The Finance Committee
recommends approval of claims and vouchers on tonight's consent
agenda.
Councilmember Kurle introduced Tony Small, First Class Boy
Scout from Troop 401. Tony Small is attending tonight's Council
meeting because he is working on his Communication Merit Badge.
The members of the Council extended their welcome.

Los Angeles area from January 6 through January 8, 1987 for
the purpose of on-site inspection of control data systems
in Ontario, Whittier, West Covina, and Hawthorne,
Californi3 Police Departments.

Motion by Councilmember Larson second by Councilmember Wisner

1. Ordinance 4196
An ordinance of the City of Auburn adding a new sub-section
to chapter 10.36 of the codified ordinances of the City of
Auburn relating to prohibited parking areas - Southeast
Auburn.
Motion by� Councilmember Larson second by Councilmember
Whittall to introduce and adopt Ordinance 4196.
MOTION CARRIED UNANIMOUSLY. 7-0.
B. Resolutions
0
1. Resolution 1718
A resolution of the City Council of the City of Auburn
adopting the 1987.1egislative package and requesting that
the Mayor of the City of Auburn transmit said package to
the Washington State.Legislature.
Motion by Councilmember Larson second by Councilmember
Wisner to approve.Resolution 1716.
MOTION CARRIED UNANIMOUSLY. 7-0.
2. Resolution 1719
A resolution of the City Council of the City of Auburn
relates and calls for a public hearing before the City
Council on February 2, 1987, for the purpose of determining
whether or not a certain portion of 3rd Street should be
vacated.
Councilmember Larson stated that due to a possible conflict
� of interest he would abstain from the action being taken on
Resolution 1719.
Councilmember Larson excused himself from the Council
meeting.
Motion by Councilmember Burns second by Councilmember
Whittall to approve Resolution 1719.�
MOTION CARRIED UNANIMOUSLY. 6-0.
