,� The regular meeting of the City of Auburn Council was called to order by Mayor Bob
Roegner at 7:30 p.m. in the City of Auburn Council Chambers. Mayor Foegner led
those in attendance in the pledge of allegiance.

B. Roll Call
Those in attendance included Mayor Bob Roegner, and Councilmanbers Whittall,
Walters, Burns, Larson, Brothers, Wisner, and Kurle. Staff inenbers included City
Attorney Jack Bereiter, Planning & Cartnunity Developnent Director Mary McCinnber,
Parks & Recreation Director Len Chap�n, Public Works Director Frank GUrrie,
Finance Director Pat Dugan, Personnel Director Gretel Sloan, Fire Chief Bob
Johnson, Police Chief Jake E�ans, and City Clerk Robin Wohlhueter.
C. Announcenents and Appointments
Arts Caimission Appointment
Mayor Roegner's appointr�nt of Reverend Bob Ward and Bonnie Egbert to the Arts
Crnmission for a term to expire on December 31, 1988.
Motion by CounciLnanber Larson second by Councilmanber Walters to confirm the
appointments of Reverend Bob Ward and Bonnie D3bert to the Arts Ccamission for a
term to expire on Decenber 31, 1988.
Ca�munication Badge - B�y Soout Troop 401
Councilmenber Kurle welcarted Rob Bird fran Boy Soout Troop 401. I�b Bird is in
attendance this evening because he is working on his oartnunication badge.
D. Aqenda Modifications
Mayor Rnegner stated the modification is included under III. A. which aze minutes
of the January 29, 1987 M�micipal Services Cartnittee meeting.

II. A. Public Ha3rings
1. A�plication No. V-2-86/Vacation
A public hearing shall. be conducted by the City Council for the purpose of
hearing and deternuning whether or not the street right-of-�.ay situated on that
portion of land designated as a public street located on a portion of 3rd
Street N.E., approximately 320 feet east of "E" Street N.E., with the crorporate
' limits of the City of Auburn, shall be vacated.

Mayor Roegner opened the public hearing.
Jeffrey Grase - 915 4th Street N.E., Auburn, wA
Jeffrey Grose, Auburn School District Official, stated the School District is
requesting a portion of 3rd Street N.E. approximately 320 feet east of "E"
Street N.E. be vacated for the purpose be of better access wntrol and
security.
Motion by Councilmenber Larson second by Councilmenber Burns to close the
public hearing.
MOTION CARRIED

Motion by Councilmanber Larson seeond by Council.manber 'Burns to delay action
until a site plan has been prepared which illustrates proper access to the fire
hydrant, the location of the utilities and whether these will be relocated or
easements provided for.

2. LID 337
The City Council of the City of Auburn is to cronduct a public hearing on the
final assessment roll for LID 337 which provides for construction and
installation of pavenent, curb and gutter, and sidewalks, street lighting and
stocm drainage along Lund Road and storm drain along West Main Street within
the crorporate limits of the City of Auburn.
Mayor Roegner opened the public hearing.
No one spoke for or against LID 337.
Motion by Councilmember Larson seoond by Councilmanber Burns to close the
public hearing.
MOR'ION CARRIED ONANIIdOUSLY. 7-0.
Motion by CounciLnanber Iarson second by Councilmanber Burns to approve Final
Assessment Roll on LID 337 as presented.

Audience Participation
Debbie Bird - 1106 3rd Street S.E., Auburn, WA
Debbie Bird's concern was centered around the traffic congestion parking probleas,
and site problens at the wrner of 2nd Street S.E. on Main Street and N Street S.E.
Debbie Bird felt the Council should consider the hazardws oorner of 2nd Street
S.E. and Main Street.
D�bie Bird expressed ooncern regarding the no parking sign located at the
intersection of 'M' Str�et S.E. and 12th Street. Debbie Bird felt the proposed no
parking zones wnu].d not alleviate the problem on 'M' Street S.E. during rush hour,
but stated a traffic liqht might be a better solution rather than a no parking
restriction.
Mayor Roegner requested the Public Works Departrnent look at the situation at 2nd
Street S.E. and Main Street, and report back to the Council.
Frank Miles - P.O. Box 130, Auburn, WA
Frank Miles subnitted a petition in favor of Council action regarding the no
parking zones on 'M' Street S.E for safety reasons. Frank Miles stated the current
parking condition creates a hazardous situation.
Don Bird - 1106 3rd Street S.E., Auburn, WA
Don Bird questioned whether or not the problen facing the M Street Parking issue
centered around the labor dispute with Miles Sand ar has the parking issue been a
proble� in the past. Don Bird asked if the site problem was with the trucks that
are entering or exiting Miles Sand and Gravel, or is it a problen with the traffic
turning fran 12th Street onto 'M' Street.
Arthur Church�,*ard - 1225 22nd Street S.E., Auburn, WA
Arthur Churchward protested the proposed Ordinance 4167 regarding 'M' Street S.E.
no parking zones. Arthur Churchvrard stated cutting dcHm the tall trees would
alleviate the site distant problsn. Arthur Churchward suggested the Cwncil
wnsider putting up a traffic light, or Miles Sand & Gravel Ca�any could utilize
another entrance.

Harold Olster - 33408 33rd Place South, Auburn, � �
Harold Olster stated the petition has been sukmitted for the full purpose of safety
and nothing else. Harold Olster noted the traffic on 'M' Street S.E. has bec.�ane so
heavy that it makes the intersection of 'M' Street S.E. and 12th Street S.E. very
dangerous. �
Jim Sprenger - 230 Auburn Way North, Auburn, WA
Jim Sprenger noted the hazardous c,ronditions that currently exist on 'M' Street S.E.
Jim Sprenger stated, because of his profession as an Insurance Agent, the City has
a potential liability problan.

� Linda Wisner, Chairrtian, did not attend the last Municipal Services Caimittee
meeting. Don Kurle, Vice Chairnian, reported the Municipal Services Camiittee met
on January 29, 1987. The next regularly scheduled meeting will be February 12,
1987.

B. Planning & Cannunity Developnent
Chairnian Burns stated the Planning & Cannunity Develog�nt Camiittee did not meet,
but the minutes sutmitted for the January 13, 1987 meeting are of public record.
The next regularly scheduled rt�eting will be on February 10, 1987.
C. Public Works
Chairnan Larson reported the Public Works C.rnmittee met on January 22, 1987 and the
minutes are of public record. 'It�e next regularly scheduled meeting is February 5,
1987.
D. Finance
Chairman Rurle indicated the Finance Cartnittee met at 6:30 p.m before the Council
meeting this evening. 7he Finance Grnmittee will meet on F�ruary 17, 1987.

C. Interfund Loan/Sctlid waste
Request approval to correct an interfund loan �nount that csas apprwed by the
Council at their January 19, 1987 regular Council meeting under wnsent agenda itan
IV.C.2.b. 'Itie total amount of the interfund loan should be$125,000 fran the Water
Fund to the Solid Waste Fluid (F1md 434) effective Decanber 31, 1986 until Decenber
31, 1987 at a 6.208 intex�est rate.
D. Utility Bill Adjustrnents
1. Request approval of a utility bill adjustment to account # 196-330 located at
4040 Auburn Way South in the �nount of $630.32.
2. Request approval of utility bill adjust�nent to accrount #460-5020 located at 333
15th Street N.E. in the amount of $465.45.
E. Street Iitq�rovanent 267
1. Request approval to award bid to Northwest Cascade, Inc. for intersection
imprwanents at West Valley Highway and Peasley Canyon in the amount of
$294,399.75.
2. Request approval to apply to the state for an additional $140,000 fran the }C
Gas Tax Fiutd in order to fund this project.
F. Out of State Travel
Request authorization for Fire Chief Hob Johnson to participate in the IInergency
Planning course in Boise, Idaho scheduled for February 9, 1987 through February 13,
1987.
G. Surplus Property
R�uest apprwal to surplus six vehicles fran the Police Depart�nent as listed

II. Ordinances and Resolutions
A. Ordinances
1. Ordinance No. 4167
An ordinance of the City Council of the City of Auburn, Washington, adding two
new sections to Auburn Codified City Ordinance 10.36.310 Prohibited Parking
areas - "M" Street southeast.
Frank Currie stated in October, 1986 the City cronducted a traffic study for
sight distance at the location of 12th and ' M' Street at the Miles Sand and
Gravel drive�,*ay because of a nwnber of canplaints the City received. �e study
indicated there c.*as a sight distant problen due to parked cars on the east side
of ':9' Street. Frank Currie reported the Public works Depar�ent posted
te�orary no parking zones on 'M' Street S.E. A previous traffic study
recaimended rechannelization of 'M' Street and a three lane facility with left
turn provisions which would }llow for through traffic. Frank Clarrie noted the
recannendation before the Council this evening is for a recharmelization of 'M'
Street allowing for left turns southbound at Miles Sand and Gravel, and
northbound onto 12th Street off of 'M' Street, and allaaing for left turn
movanants off of 'M' onto Auburn Way South. Frank Currie pointed out currently
the traffic backs up on 'M' Street as far as 12th Street S.E, going south.
Motion by Councilmanber Iarson secrond by CounciLnenber Whittall to introduce
and adopt Ordinance 4167.
Under discussion, Councilmanber Kurle asked if the trees were blocking the view
fran Miles Sand & Gravel entrance onto 'M' Street S.E, if a traffic light had
been cronsidered at this intersection, and what the 1983 traffic study had to do
with this intersection.
Frank Currie responded the trees do not obscure sight on 'M' Street S.E., the
traffic light would help the problen on 'M' Street, and the 1983 traffic study
conducted by Entranco rras done as part of the Harvey Road widening project.
The Harvey Road widening project was intended to be implenented in different
phases. It was noted the sight distant problan could be taken care of by
elminating parking on 'M' Street fran 12th Street S.E. to Auburn Way South.
Frank Currie pointed out the 1983 study indicated left turn lanes should be
installed at 12th Street S.E. and a dual left turn or increased left turn lane
be installed south of 12th Street S.E. on ' M' Street to prwide additional
storage for the dual left turn lane onto Auburn way Swth at its intersection.
Councilmenber Kurle suggested a�.mpranise regarding the no parking zones.
Frank (,Urrie stated the study indicated there is a 350 foot sight restriction
to the south on 'M' Street S.E., and to the north the sight restriction is in
excess of 400 feet, but the actual parking restriction is 155 feet to the north

and 190 feet to the south. EYank Currie pointed out the tiaffic study H*as
wnducted by the AiLSHTU book, and does not see a canpranise.
CounciLnenber Iarson explained there might be a possibility that Burlington
Northern would consider changing the signal light at the railroad crossing on
'M' Street which could allow four lanes fran Highway 18, south to Auburn Way.
Councilmember Larson expressed ooncern regarding the City's liability
associated with 'M' Street, and stated a no parking zone would be enforced fran
Auburn Way South to 12th 5treet S.E. to allow for a left turn lane.
Discussion oentered around current no parking zones �'M' Street S.E.,
recrorded accidents on 'M' Street, the intention of the 1983 Entranco traffic
study, and oosts associated with implenenting the no parking zones and left
turn lane.
Sane Councilmenbers felt the City was caught in the middle of a labor dispute
between Miles Sand and Gravel and their e�loyees, but felt croncern for the
traffic eonditions, sight distance problans, and safety conditions that exists
on ' M' Street S.E.
MOTION DENIED. 2-5 with Councilmenbers Walters, Burns, Brothers, Wisner, and
Kurle voting no.
Discussion continued regazding requiranents set for no parking zones in order
to create enough visibility at the intersection of Miles Sand and Gravel and
12th Street S.E.
Motion by Councilmenber Walters second by Council.menber Whittall to amend
Ordinance 4167 which would modify no parking areas according to standard Poblic
Warks criteria estalalished for minimun sight distance on 'M' Street S.E.
' Jack Bereiter pointed out, under the case law, the City has constructive and
actual notice of potential traffic sight obstruction hazard based upon traffic
engineering criteria which wnstitutes liability to the City.

2. Ordinance No. 4197 '
An ordinance of the City of Auburn, Washington, repealing Auburn Codified City
Ordinances 13.20.480 ;�nd 13.20.520, (Ordinance No. 4101) relating to the
monthly rates and chargPS for sewage disposal services and creating a new
Auburn Codifie3 City Ordinance 13.20.480 and 13.20.520.
Motion by Councilmanber Iarson seoond by Councilmenber Burns to introduce and
adopt Ordinance 4197. •

An ordinance of the City of Auburn, Washington, approving and �nfirming the
assessments and assessment roll of Local Improvanent District No. 337 for the
construction and installation of pavanent, curb and gutter, and sideoralks,
street and storm drainage along Lund Raad, and including a storm drain project
along west Main Street, within the city, as provided by Ordinance No. 4084, and
levying and assessing the crost and expe�se thereof against the several lots,
tracts, parcels of land and other property as shaan on the assessnent roll.

adopt Ordinance 4198.

A Resolution of the City Council of the City of Auburn, Washington, authorizing
the Mayor and City Clerk of the City of Auburn, to execute an extension of
Agreement for Sewage Disposal between the City of Auburn and the Municipality
of Metropolitan Seattle (METRO), original agreenent authorized by City of
Auburn Ordinance No. 2774 dated Novanber 5, 1973.

construction staking for the R Street S.E. frcan 29th Street S.E. to 33rd Street
S.E. City of Auburn Street Project.

Resolution 1729.

4. Resolution No. 1730
A resolution of the City Council of the City of Auburn, Washington, declaring
certain real property hereinafter described as surplus to the needs of the
Auburn Street Department and finding the value thereof c�unparable and
authorizing the exchange of said real property between the Auburn Municipal
Airport Department and the Auburn Municipal Street Degartrt�ent.
Motion by Councilmanber Iarson seoond by Councilmanber Burns to adopt
Resolution 1730.

Mayor's Report
bcecutive Session
Mayor Roegner announced there would, be an executive se$sion for approxunately 20-30
minutes regarding labor negotiations and land purchase negotiations.
The Council meeting recessed at.8:40 p.m. for executive session and reoonvened at 9:08
p.m.
Motion by Councilmanber Larson second by CounciLnanber Whittall to authorize the Mayor
and City Clerk to sign the Pblice Departrnent non-crnmissioned officers' labor o�ntract
subject to their ratification.
