The regular meeting of c.he City of Auburn Council was called to order by Mayor Bo
Rcegner at 7:30 p.m. in the City of Auburn Council Chambers. Mayor F�egner le
those in attendance in the pledge of allegiance.
B. Roll Call
Those in attendance included Mayor•BOb Roegner, and Councilmembers Whittall,
Walters, Burns, Larson, Brothers, Wisner, and Kurle. Staff inembers included City
Attorney Jack Bereiter, Planning & Camnunity Development Director Mary McCwnber.
Parks & Recreation Director Len Chapman, Public Works Director Frank (.lirrie,
Finance Director Pat Dugan, Personnel DireCtor Gretel Sloan, Fire Chief Hob

Proclamation - "I Am Sanebody Week
Mayor Roegner announced, at the request of the Parent Teacher Student Association,
he will be presenting a proclamation on Tuesday, March 17, 1987 at the Auburn
Performance Arts Center honoring "I Am Somal�odY Week".

Mayor i�egner stated the modifications are �nder IV. Consent Agenda, item B.
Vwchers, number 1,`payroll. The Finance staff requests a change in payroll
numbers. Under VII.B9 the modification includes replacirig the "engineer's
certificate" with the certificate that specifies the signatures mntained on th
petition submitted for the proposed Local Improvement District No. 338 oonstitu�
758 of the total assessable square footage in said Local Improvement District
70.58 of the property owners involved in the said improvement district, and an add
on under VII.B.10 which is Resolution 1746 authorizing the Mayor and City Clerk of
the City of Auburn to execute a wntract between the City of Auburn and 'ibrm &
Country Steel Buildings for the purpose of constructing a storage building at the
City of Auburn's Maintenance & Operation facility.

II. A. Public Hearings
1. Application No. 3-87/Rezone
The Oouncil of the City of Auburn will cronduct a public hearing regarding the
request of Monrce W. and Meredith 5hropshire to rewne from R-2 (Single Family)
to R-3 (Duplex) along with a wnditional use permit for a business office and a
three chair beauty salon on property located on the southwest corner of Sth and
"R" Streets N.E. conmionly known as 1528 8th Street N.E.
Mary McCumber sumnarized the testimony ar� discussion held at the Planninq
Camnission meeting on March 3, 1987. Mary McCumber stated the property is
designated by the oomprehensive plan as moderate density residential. The
applicant wnuld like to convert a single family home to an office use and
beauty salon use, and the problem is the beauty salon is considered by the Cit
as a oo�mnercial use by both the City's cortq�rehensive plan and existing zoni
code. Initially the applicant submitted an application for a C-1 wne whi
would allow beauty salons within that category, but the zoning category ..-
inconsistent with the comprehensive plan's designation for residential and
would have requirecl an amendment to the comprehensive'plan map. The applicant
withdrew the initial request for C-1 zonirig and reapplied for R-3 zone and a
conditional use permit. Mary McCumber roted the R-3 zone is consistent with
the oomprehensive plan msp designation of moderate density residential;
however, the use of the beauty salon is inoonsistent with both the
coi�rehensive plan for that category and the zoning oode. Mary McCumber stated

in order foY-the applicant to have this type of use the oomprehensive plan text
for moderate density residential areas, and the zoning oode would have to be
for that location would be appropriate, the Planning Con¢nission was concerned
with the opening af a moderate density residential category to a eommercial use
throughout the City because it would have to be applied consistently throughout
the City. It would mean ar�y moderate density residential area wvuld have the
opportunity to have that type of zoning, and the oode would have to be amended.
Mayor Roegner opened the public hearing.
Robert Smythe - 29 First Street N.E., Auburn, WA,
Robert Smythe, Attorney representing Monrce and Meredith Shropshire, presented
a msp outlining the uses surrounding the proposed rewne. The uses surrounding
the proposed property include multi-family, park property, and oo�mnercial.
Robert Smythe noted the use that states offices, businesses and professional
which is different than what the Planning staff is recomnending in the R-2
conditional use permit authorized uses. The R-2 classification is "offices
(professional)" and dces riot mention business offices. Bob Smyth pointed out
the Planning Degartment's position that there is m distinction between
professional office and business office, and stated this is what he disputes
most, on behalf of his applicant.
Bob Smythe submitted sources defining "business" and "office". Ooncerns were
expressed regarding traffic volumes, size of property for multi-family use, ar�
set back lines for �alti-family use. Bob Smythe noted policy 17.1.15 limited
commercial uses in a R-3 zone with wnditional use permits. Bob Smythe
mentioned because the proposed rewne is a business office and it meets
criteria established in the oomprehensive use plan that his applicant is
entitled to be oonsidered under the present constraints of the oode as a
conditional use permit with a R-3 use, and do not need to have the zonirg oode
amended to allow a beauty salon at this location. }
� Bob Smythe stated the proposed rezone would allow for a buffer and would
enhance the sight distance along 8th Street N.E., and would blend well into the
area. The salon would provide a high density service to the surrounding area
and wvuld be a better u�e than the uses that oould be allowed under the
�nditional use permit in the R-3 zone such as college, governmental building,
. fire station, fraternity house, public utility building, and gytnnasium.

Bob Smythe requested the Cauncil grant the application as it exists, and if
that is not possible the Council consider granting the application subject to
it being changed over to a RO classification after ld� classification has been
established by the City Council.
Bob Smythe read three letters submitted by residents in the neighborhood in
support of proposed rezone.
Motion by Councilmember Burns seeond by Councilmember Walters to close the

Discussion centered around questions the Council had regarding the types of
uses authorized in the R-3 zone, uses oo�atible with m�derate density
residential, beauty salon designation in the zoning oode, oo�mnercial activity
relating to residential areas, multi-family use on proposed property, and other
uses that oould be used in oownercial activity verses residential activity with
a oonditional use permit.
Councilmember Uhlters questioned the history behind the established beauty
salon that was located adjacent to the proposed rewne property. Lynn Rued
responded the current beauty salon was approved in 1973 through a process that
no longer exists with the City of Auburn. This property was given a special
property use permit. The uses listed within the R-4 zone include only multi-
family type uses. There were no uses listed within the R-4 zone that could be
permitted through a permit process. In 1973 there v,as a permit function where
the City could decide if the use msy be appropriate within a zone, no mstter

what the use or zone was, and the City could grant a special permit. Lynn Rued
pointed out in 1973 there were no guidelines, policies, or direction in the
issuance of a special permit granting a beauty salon on the property adjacent
to the proposed rezone.
:n 1974 the Zoning oode rras amended to allow for oonditional use petmits within the zoninq
�ode.
Mary MoCumber responded to questions regarding the kinds of uses that can �
required for professional offices and commercial activities. Mary McCumbe
stated due to the uncertainty that would arise with regard to partial approval
of the project, the entire conditional use permit should be denied and a new
application submitted to ensure oomplete review by staff and the public. The
earliest this proposed rezone wuld be approved would be by tlie middle of Mayy
in wnjunction with the adoption of the new zoning oode•
The draft Id� zoning category might be a possibility. The Planning staff had
not studied the Im wning for this praposed rewne. The residential office (RO
zone) is one that is located on arterials, adjacent to residential areas, and
other parts of the city.

Jackie Volstad, buyer of proposed rezone property, stated the month of May is
the time frame she has planned on opaning her beauty salon.
Discussion oontinued regarding the proposed rezone. The Council expressed
concern regarding the fees, and what the City's position would be on the number
of possibilities initiated by a change in the oomprehensive plan map
designation for an area larger than this parcel, or initiate an area zoning for
those parcels th�t would accompany this rezone, or what the City could do to
the oomprehensive plan map designation which would r�u�T thin �11C��t thP'
individually apply for a reclassification. Mary P°
planning staff would have a recomnendation to the Planning Canmission by th�
April meeting on ha+ to proceed and would want to look at other similar parcel
in this area in relationship to the am�prehensive plan and the zoni
ordinance. '
Sane of the Councilmembers agreed that allowing a beauty salon on this property
would mt be detrimental to the area, and if the Council allows this type of
use on this property now, the Council will have set precedence to future
applicants and will have further defined a beauty salon as being oonsistent
with an "office" statement.
Jackie Volstad submitted pictures to the Council of the proposed property.
Motion by Cwncilmember Burns second by Councilmember Walters to approve the
reanne based upon the findings of fact and oonclusions as outlined and to
instruct the City Attorney to prepare the necessary ordinance, but to deny the
conditional use permit based upon the findings of fact and conclusions as
outlined and to direct the Plannirig Department to begin a study to determine
the feasibility of an Office/Residential Canprehensive Plan Map designation on
that portion of 8th Street N.E. lying east of Henry arxi Pike Streets N.E., and
to rraive any further fees for the applicant in relationship to the rezone.
Mary McCumber pointed out the Council procedurely has a request before them
that requires Council action. Discussion centered around the c7ptions the
applicant would have if approved or tabled. If tabled, there would be time fo
the Planning staff to develop the PA designation. What the planning staf�
recommerxied was the issue come back to the Planning Commission in �1Pr�o �he
clear process �+vvuld be established for oonsidering a chang

A. Municipal Services
Chairn�an Wisner stated there is no report because the Municipal Services Ccenmittee
did mt meet since the last Council meeting.
g, Planning & Community DeveloFanent
Chairman gurns noted the Plannirig & Coimnunity Development Crnmnittee met on March
10, 1987 and the minutes are of public record except for the issues of the draft
zoning code and area zoning.
Chairrt�n gurns announced there will be two Planning & Community Development
workshops scheduled for Tuesday, March 24, 1987 and Tuesday, March 31, 1987. Both
workshops will begin at 5:30 p.m. at Auburn City Hall, and the purpose of the
workshops is to review the draft znnin9 oode, and proposed aonging changes.
Chairman Burns annwnced a Council workshop will be scheduled for the purpose of
reviewing proposed area zoning changes and the draft zoning oode on Monday, April
6, 1987 from 5:30 p.m. to 7:30 p.m. at Auburn City Hall. The Council workshop will
be prior to the regular meeting of the Auburn City Council.
Notice of Public Hearing - Zoning Code
Motion by Councilmember Burns second by C.ow�cilmember Walters to call for a
public hearing to on the proposed zoning in the City's zoning �de, and the
proposed zoning changes at the next City Council meeting on P,pril 6, 1987. �

Chairman Larson stated the Public Works Committee met on M3rch 5, 1987 and the
minutes are of public record, Chairman Larson noted Resolutions 1736 thrw�gh
Resolution 1740 that appear on tonight's agenda relate to segregating LIDs. The
next meeting will be Thursday, March 19, 1987 at 7:30 p.m.
D. Finance
Chairmari Kurle roted the items of discussion the Finance Committee reviewed prior
to the Council meetirtg.
Resolution 1742 - Washington Cities Insurance Authority
Motion by Cwncilmember Kurle seoond by Councilmember Larson to approve
Resolution No. 1742 which authorizes the City of Auburn to paLticipate in the
Washington Cities Insurance authority to jointly self-insure its general
liai�ilities, and authorizing the I�yor of the City of Auburn to execute
Appendix "C" to the original interlocal agreement creating the Washington
Cities Insurance Authority.

approximately 140 feet east of 102nd Place S.E. easterly approximately 325
feet, thence southeasterly in an easement raad 350 feet + and to oonstruct a 4"
waterline southerly in 102rd Place S.E., 180 feet +, and installation of two
hydrants, one near 102rxi Place and 4th Street and the other in the easement
near the end of the 8" line, and providing for the construction of an 8"
waterline approximately 300 feet in length along an easement oonnecting the
existing waterline on Riverview Drive to the North with the waterline on 4th
Street N.E. (324th Street S.E.), within the Qounty of King, State of
washington, and to create a local improvement district to assess the oost and
ex�,ense thereof against the properties specially benefited thereby; and
notifying all persons who desire to object to the improvement to appear and
