The regular meeting of the City of Auburn Council was called to order by Mayor Bob
Roegner at 7:30 p.m. in the City of Auburn Council Chambers. Mayor Rnegner led
those in attendance in the pledge of allegiance.
B. Roll Call
Those in attendance inclucled Mayor Bob Roegner, and Councilmembers Whittall,
Walters, Burns, Larson, Brothers, Wisner, and Kurle. Staff inembers included City
Attorney Jack Bereiter, Planning � Camnunity Development Director Mary McCumber,
Parks & Recreation Director Len Chapman, Public Works Director Frank Currie,
Finance Director Pat Dugan, Personnel Director Gretel Sloan, Fire Chief Bob

a. Earthquake Week Proclamation
� Mayor Roegner proclaimed April 12 through April 18, 1987 as "F�rthquake
Awareness Week" as p3rt of the City of Auburn's oontinued emergency
management plan, and to inform the public of potential safety hazards
associated with earthquakes.

b. Keep Washington 100$ [datural
Mayor Roegner proclaimed the week of April 18 through April 26, 1987 a.
"Keep Wasfiington 1008 Natural"--"Spring Fally 87 Clean-up and Recyclin_
Week" within the City of Auburn. Mayor Roegner stated the City o
Auburn's spring clean-� program will begin on April 20 until May 18, 1987.
Maps will be published in the newspaper showing pick up dates in the Auburn
area.
D. Agenda Modifications
Mayor ld�egner stated the m�dificatons are included under Council agenda item
VII.A.2 Ordinance 4216. Mayor.Roegner stated the Council packet includes a"draft"
ordinance, and the Council received the original ordinance prior to the meeting
relating to Local Improvement District 337, and the offer to purchase $568,702.29
Local Improvement District Guaranty FUnd Bonds by Harper, McT.ean & Company, and
appendix A which contains a brief description of the bonds, including principal
amount �turities, interest rates, call provisions, purchase price, ar�d the
proposed date of delivery and payment (the closing).

II. A. Public Hearings
1. LID 338
The Council of the City of Auburn will ooriduct a public hearing on the
assessment roll for Local Improvement District 338 providing for the
construction of an 8" Hraterline and appurtenances in 4th Street N.E. (324th
Street S.E.) between a point approximately 140 feet east of 102rri Place S.E
easterly approximately 325 feet, thence southeasterly in an easement road 35
feet + and to construct a 4" waterline southerly in 102rd Place S.E., 180 fee
+, and installation of two hydrants, one near 102nd Place and 4th Street and
the other in the easement near the end of the 8" line, and providing for the
construction of an 8" waterline approximately 300 feet in length along an
easement connecting the existing waterline on Riverview Drive to the North with
the waterline on 4th Street N.E. {324th Street S.E. ), within the County of
King, State of Washington.
Ma}ror Roegner informed the Council of the letter of objection from property
avners B.E. Britton and F.M. Britton expressing objection to LID 338,
assessment number 15 that appears later in the agenda under item II.C.1.

Lloyd Britton objects to the assessment 15 on LID 338 because a drainfield
could not be installed in order to rtnke the property buildable. Lloyd Britton
stated this property has only been used as a dump, and a 30 foot easement'
additionally prevents improvements to the property.

Leon Israel felt the current Mrater system is adequate and a new water system
would not serve the property owners any better.

Under discussion, Councilmember Kurle questioned if a sewer was braight into
Lloyd Britton's property if that Mould make his property buildable.
Frank Currie responded the by putting the drainfield in the easement wrwld make
the property buildable.
Lloyd Britt� stated if the City of Auburn put in sewers and if Mr. Peterson
would release the 30 foot easement the property would be buildable.
2. Zoning Code ar� Proposed Area Zoning Maps
A public hearing has been called by the Council of the City of Auburn for all
interested persons desiring to oomment on the proposed chanqes in the City's
zoning oode and the proposed area zoning maps for the City of Auburn as amersied
by the Auburn Planning Commission.
Mary McCumber briefly sunmiarized the process the City of Auburn has taken in
, order to revise its 1969 Canprehensive Plan. [�ry McCumber stated the two and
one-half year process started with background studies assessing varia�s aspects
of the m�mnunity and the changes that are expected to occur. A series of
neighborhood meetings were held in 1985 for City officials to hear Auburn
citizens' concerns about their ooanmunity, including both problems and
opportunities. The draft plan and the acoompanying environmental review
documents were presented to the Auburn Planning Commission for its. review in
January 1986. Public hearings and workshops were held � the draft, revisions
were made, arxi a proposal was recacmiended to the Auburn City Council in May,
1986. The Auburn Comprehensive Plan was adopted on August 18, 1986.
Mary McCumber pointed out that to ensure the Canprehensive Plan is implemented,
two critical measures are currently being revised—the Zoning Code and Zoning
Map. Mary hk.Cumber roted the existing Zoning Code is very wt-0f-date,
inconsistent, and fails to address marry of the Comprehensive Plan goals. There
is a need to amend the City's zoning maps which will occ.'ur through area zoning;
a legislative process that is initiated by the City anci is comprehensive in
nature involving many separate properties under various ownerships. The area
zoning process applies the Comprehensive Plan's policies and map, using the
proposed new zoning aode to properties inside the City limits of Auburn.
In September, 1986 a process began for the initial review and revisions to the
zoning code and area zoning. A mailing was sent to all Auburn residents and
property owners notifying them of the changes and inviting them to attend open
hwses to met with Planning staff to express concerns, and a public hearing was
held to receive concerns and oonrtnents to the drafts. Mary McCumber stated the
purpose of the hearing tonight is to identify concerns with the draft zoning
code and area zoning as amended by the Planning Commission. Ebllaving this
hearing, the Planning and Canmunity Development Canmittee will address the
identified issues and recommend necessary amendments. The amendments and the
draft documents will be mnsidered by the full Council for review and action.

Mike Ker�yon, Attorney for Union Oil of California representing Don Small for
property located at 112 3rd Street S.E. Mike Kenyon e�cpressed concern with the
down zoning of an eight lot parcels from M2 to M1.
Dick osborne - 2400 Columbia Center, 701 5th Avenue, Seattle, GUi Dick Osborne,
Union Oil Representative, described three different fuel products, mted their
"flash points", and explained how safe the fuel products are. Dick Osborne
pointed out that danger centers around the vapors that are produced from th
fuel when it is mixed with oxygen and must include a source of ignition. The
main safety rule ;s to keep gasoline in the tanks underground, have bottom
loading tru�Rs, do rot over fill trucks, and extensive employee safety
training. In closing, Dick Osborne noted the bulk storage for fuels has been
in Auburn for 70 years without a fire.

Ar�dy Beroni, Manager for,Union Oil, stated the proposed M1 zone would prohibit
the plant from expansion or any modernizing. Andy Beroni felt the bulk plant
in Auburn is safe fo: the community and employees.
Cal Scarff -�P.O. Box 5238, Redondo, 4�1
Cal Scarff, owner of Scarff Fbrd in Auburn and property owner of approximately
4 acres behind the dealership, expressed wncern regarding expansion of the
dealership in order to rteet obligations with the Ford Nbtor Ca�any and
franchise oommitments with Izusu. Cal Scarff felt the property should be
upgraded from a C1 to C3 zoning in order to allow for expansion.
Gene Wright - 2744 Forest Ridge Dr.,Auburn, I�41
Gene Wright submitted a letter for review by the Planning Commission requesting
more time be spen� � reviewing the draft zoning oode and area wning maps, and
requested the Council consider his suggestions.
Bob Ll - 5800 South 316th, Auburn, i+II�1
Bob Lloyd stated his concern of the porposed two to one slopes and because of �
proposed road and slope bf the property only 30 acres of 80 acres arc
buildable. Bob Lloyd r2quested the Council reconsider the open space
designation that there be a comprmnise for development of view property.
Frank Miles - P.O. Box 130, Auburn, WA
Frank Miles, Miles Sand and Gravel, stated his family oamed business has been
operating in Auburn for 50 years. FYank Miles pointed out the proposed zoning
for his business property would not allow for expansion and avuld put him out�
of business. FYank Miles requested the Council consider leaving his 20 acre
property zoned for heavy industrial.

Fred Pce stated he was speaking in behalf of Cliff D'body, [Q�ID Trucking located
on approximately five acres on Lund Road. Fred Poe noted the proposed M1 wne
may not allow for the a trucking comgany maintenance facilities, and asked the
Council for careful consideration prior to adoption of zoning code.
Fred Poe pointed wt there are drastic changes in the M1 wne as to number of
uses allowed, administrative approval and some with a conditional use permit as
a requirement. Fred Pce ooncluded that Auburn's principle use is a freight and
distribution facitily town, ar� he invited the Council to tour North Kent as a
comparison.
Robert Heller - 1001 Fourth Avenue Plaza, Suite 9400, Seattle, t�A.
Robert Heller, Attorney for Canadian Ccmmercial Bank, stated his client own.
a�,i.:oximately 60 acres in the area bounded by State Highway 167, 15th Stree
N.W., and the West Valley Highway. All of the property is proposed for
rewning. RoY�ert Heller noted for the record Canadian Ca�vnercial Bank was not
notified of the Comprehensive Plan amendment process.
Robert Heller expressed eoncern regarding the proposed M1 (Light Industrial) on
a approximately 15 acres because it is not �nsistent with the owner's
objectives and is not in the best interest of the City. R�ert Heller

requested lots 1, 2, and 3 with short plat 2-86 be changed fran Light
Irxiustrial to Heavy Camnercial, and that the present C-3 zoning be maintained.

Robert Heller explained that a planning consultant reviewed the site and'
determined that �ntinuation of the Heavy Conanercial z�one designation for
properties at the intersection of N.W. 15th and West Valley Highway would be
� cronsistent with good planning principles and the general policies and
objectives of the Auburn Canprehensive Plan. Imbert Heller felt that ready
access to SR 167, �kes it desirable to provide for so� eoncentrated nodes of
commercial use within the light industrial area and prmnotes mixed use.
Robert Heller roted the Planning Department staff has taken the position that
commercial uses may be permitted in the M-1 zone under the administrative
permit process, however, the review process dces not effectively ar�d fairly
accanplish this purpose in that there aze not standards or guidelines to
follow. Robert Heller submitted a letter to the City Clerk.
Ernie Bailey - 3130 B Street S.E., Auburn, NTP,
Ernie Bailey, Rohr Industries, was concerned about the rezone of his property
located on area wning a�p 9B from M2 to R4. Ernie Bailey requested additional
t?^� to speak with the Planning staff because such a rezone could potentially
force relocation of their business.
Randy Hamblin - 1427 116th Avenue N.E., Bellewe, 4�, 98009
Randy Hamblin submitted Quadrant Corporation's oomments to the �uncil for
their review. Fandy Hamblin noted a permitted use in the M1 Light Industrial
District "rsrehousing and distribution facilities arid wholesale trade not open
to public, mt intended to include freight terminals". Nbtor freight terminals
and transportation" is proposed as a permitted use only in the M-2 Heavy
Irdustrial District. Fandy Hamblin pointed out that often the warehousing and
distribution facilities own the product they distribute, where motor freight
compaines perform the same function, but he product carried may be amed by a
separate individual.
John McCullough - 111 3rd Avenue, Seattle, V�. 98101
John McCulloh, Attorney for Georgia Pacific, felt the City should eon sider
using greater flexibility in using outside storage and allow for cleansing
material manufacturing. John Mc�ullough expressed concern for the change in
zoning classification from M2 to M1 on the Fiorito property, and felt the
Planning staff shwld recognize the importance in oomparing zoning currently
existing.

Northwestern Drug
Ted Morrisette - Puyallup, FR1
Ted Morseth explained Northwestern Drug's employment offered too much of an
economic loss, and therefore, he was no longer an employee. Ted Nbrseth
� expressed concern regarding controlled substances being stolen from the mmpany
by the new employees at Northwestern Drug. Ted Morseth requested c�mnunity
support in rteking sure oontrolled substances were not being taken from
Northwestern Drug.

Ebelyn Nyseth - Sumner, i�41 '
Evelyn Nyseth stated she was an employee for Northwestern Drug for eleven years
and Auburn is where she has done her banking and shopping. Ei�elyn Nyseth noted
658 of the workeas at Northwestern Drug have out of state licenses, and
expressed concern with mntrolled substances leaving the warehouse and not
properly being stored. Et�elyn Nyseth requested the Council oonsider having
the Drug F�forcement Agency check on Northwestern Drug.

Arthur Hamilton stated only eighteen families from the City of Auburn work for
Northwestern Drug, and that any revenue from the canpany is going back east.

Sue Wood explained the emplayees of Northwestern Drug that are participating in
the labor dispute will have been pernianently replaced. Slze hbod stated the
employees crossing the picket lines have been subsidized by Northwestern Drug'
east coast chmer. Sue Wood noted she has mntributed to United Way and othe
organizations which oontributed to the o�mmunity, and felt the employee. _
crossing the picket line would not.
Vehicle For Sale Signs
Virginia Haugen - 2503 R Street S.E., Auburn, NII� 98002
Virginia Haugen questioned if it was illegal for a property amer to put a for
sale sign on vehicles. Virginia Haugen stated her application for a business
license was denied.
Lynn Rued resporxied an applicant must meet eight a�t of ten of the requirements
of a home occupation in order to be issued a license. Lynn Rued stated no
display pertaining to the occupation, other than the one permitted sign,
visible from the street or adjacent residences, is allowed.
Mayor Roegner suggestecl Virginia Haugen discuss the problem with the Planning
Department.
Councilmember Kurle requested follow-up fran the appropriate staff on both
Northwestern Druq and Virginia Haugen's concerns.
C. Correspondence �
1. LID 338 Letter of Objection
On March 31, 1987 the City Clerk of the City of Auburn received a letter fro
property owners B.E. Britton and F.M. Britton expressing objection to LID 338
assessment number 15. �
Mayor Roegner acknowledged the letter received by B.E. Britton prior to the
public hearing this evening ur�der agenda item II.A.1 LSD 338. r

III. A. hhu�icipal Services
Linda Wisner, Chairman, stated the Municipal Services Cormnittee met on March 26,
1987. Councilmember Wisner noted the City of Auburn's Spring Clean-Up will begin
on April 20, 1987 through May 18, 1987. The next regularly scheduled meeting will
be Thursday, April 16, 1987.
B. Planning & Canmunity Development
Chairman Burns stated the Planning & Conmiunity Development Committee met on March
24, 1987. At the March 24, 1987 meeting the Planning � Community Development
Camnittee reviewed half of the zoning oode. The Camnittee met o� March 31, 1987
and finished reviewing the zoning oode. The next workshop will be held on
Wednesday, April 8, 1987 at 5:30 p.m. for land zoning change designations. There
will be a special Planning & Cotmnunity Development Conunittee meeting ar� hbnday,
April 13, 1987 for public input, staff response to wncerns on the new zoning oode,
and tc begin the process of shaping the zoning code for the final stages o-
approval. Councilmember Burns stated it was undetermined at this time if th
Cwncil �.orkshop scheduled for April 13, 1987 �,ould be cancelled. The nex
regularly scheduled Planning � Community Development Camnittee meeting will
April 14, 1987 at 7:30 p.m. ,
C. Public Works
Chaim�an Larson reported Che Public Works Committee met on March 19, 1987 and the
minutes are of public reoord. The next regularly scheduled meeting is April 9,
1987 at 7:3Q p.m.

channelization improvements at the interesection of East Valley Highway South

Mayor Roegner stated there ��ld be an executive session for approximately 10 to 15
minutes to discuss litigatiun. The Council recessed to executive session at 9:30 p.m.

The Council reconvened its m��eting at 9:45 p.m.
Motion by Councilmember Burns second by Councilmember Walters to authorize to the City
of Auburn administration to take action to pursue legal steps necessary to protect the
intereats of the citizens of Auburn seeking judicial review of the refusal of the
Bureau of Indian Affairs to provide an •environmental impact statement regarding the
proposed recreationsl vehicle park development for the Muckleshoot Indian Tribe.
