The regular meeting of the City of Auburn Council was called to order by Mayor Bob
Roegner at 7:30 p.m. in the City of Auburn Council Chambers. Mayor Roegner led
those in attendance in the pledge of allegiance.
H. Roll Call
Those n attendance included Mayor Bob Roegner, and Coimcilmeanbers Whittall,
Walters, Burns, Arothers, Wisner, and Kurle. Councilm�nber Larson was excused.
Staff inembers included City Attorney Jack Bereiter, Planning &,Community
Developnent Director Mary MoC�nnber, Senior Planner Lynn Rued, Associate Planner
Greg Fewins, Parks & Recreation Director Len Chapnan, Public Works Director Frank
Currie, Finance Director Pat Dugan, Personnel Director Gretel Sloan, Fire Chief Bob

C. Announcements and Appointments

a. Pcoclamation - National Public Works Week
Mayor Roegner presented a procl�nation declaring the week of May 17 through
May 23, 1987 as "National Public Works Week" to Public Works Director Frank
Currie. Mayor Roegner enoouraged citizens look at the Public Works'
displays set up�in the lobbies of the main floor and se�nd floor of Auburn
City Hall.

a. Hianan Resources Camnittee
Request approval of the appointments of Joyce Pearson and Bob Davis to the
H�nnan Resources Camnittees Joyce Pearson is filling a vacated seat of which
the term will expire on December 31, 1988. 9ob Davis is filling a vacated
seat of which the term will expire on Decenber 31, 1991.
Motion by Councilmesnber 8urns seoond by Councilmember Wisner to approve
appointments of Joyce Pearson and Hob Davis to the H�anan Resources Canmittee.

II. A. Public Hearings
1. Application 7-87
' Consideration of Application 7-87 which is the request of the Quadrant
Corporation for a special property use permit to allow removal of 1,850,000
cubic yards of material lc�cated on the southwesterly of the intersection with
the West Valley Highway and 15th Street S.W.
Mary Mc�ianber explained the history of the proposed request for a special
property use permit. Mary noted the site is thirty-five acres in size and is
located southwesterly of the intersection of the tdest Valley Highway and 15th
Street N.W. Mary McCtanber's oomments focused on utility uses, and options for
roads up the hill. It was pointed out the applicant wishes to pursue
oommercial and industrial developnent of this property, and is aware of new

eonm�ercial and industrial development of this property, and is aware of new
mining standards contained in proposed surface mining ordinance of the City of
Auburn which include a 50 foot buffer.
Mayor Fmegner opened the public hearing.
George Sherwin - P.O. Box 13, Bellewe, WA 98009
George�sherwin, representive from the Quandrant Corporation, r.equested the �
Council consider approval of this application cronsistent with Hearing
�caminer's recamiendation. George Sherwin noted econanic wnditions had
resulted in a slower removal of the materials than anticipated. �e Quadrant
Corporation will grade the property to acceptable slopes as reca�mended by the
Hearing 6caminer, and allow for a fifty foot set back line to act as a buffer.
4homas E. Mathews - 37202 56th Ave., South, Auburn, WA 98001
�homas E. Mathews su�nitted a letter to the Council dated May 18, 1987
regarding Application No. 7-87. 'Ihcmas Mathews read the letter that was
submitted to the Counci.l. �e letter qave a brief history of the proposed
property noting that road access has not been unproving in this area, and that
original maps had shown that a road would have to be built as a wnnecting link
with the valley flmr tr� best develop this area. It is Mr. Mathews' opinion
that the permit should adhere to the previous agreement as originally proposed
between Broadway Holding Co. and the City of Auburn in 1971, that the road
extending frorti'the valley floor at 17th Street S.W. to 56th Avenue South should
be included in this permit, if granted. In addition, Mr. Mathews requested a
fifty foot buffer south of the platted 344th which adjoins his lot, and a fifty
foot buffer zone ea:;t ot the same lot.

Councilmember Kurle questioned the emergency access to this property. Chief ,
Johnson stated a 600 foot longer road going up the hill is better than a
shorter road which is steeper and has more curves.

mining permit based .upon the Hearing Ekaminer's findings of fact, conclusions
and conditions as outlined and to instruct the City Attorney to prepare the
necessary ordinance.
MOTION CARRIED UNANIMOUSLY. 6-0.
2. Application No. 8-87
Zhe request o Roger Tschida/Farmers Union Central Ekchange to rewne from C-1
(Light Camnercial) to M-2 (Heavy Industrial) along with a cxmditional use
permit to permit a bulk petrole�an tank fann on property located on the north
side of West Main Street in the 800 block.
Mayor Roegner opened the public hearing.
Jack McCollam - 9402 49th Avenue Court Fast, Tacoma, WA 98446
Jack McCollam, representing Rager Tschida, stated they are requesting a rezone :
to M-2 with a ooriditional use pennit to allow renewed use of an existing bulk
fuel storage facility. Zhe present zoning is C-1 which dces not allow for bulk
storage facilities. Jack NkCollam pointed out the use was established ,
approximately fifty years ago and the site has not been used for about two
years.

Consideration of an amendment to the City of Auburn Camprehensive Plan Map from
the existing Moderate Density Residential Classification to Office/Residential
Classification located on the south side of 8th Street N.E. between Henry I3�ad
and "R" Street N.E. Consideration of an Area Zoning amendment from R-3 (ZWo
Family (Duplex) Residential District) to R-0 (Residential Office District) at
the same location.
Mayur imegner opened the public hearing.
Bob 9nythe - 29 First Street N.E., Auburn, WA 98002
Bob Snythe, attorney for hbnroe and Meredith Shropshire, spoke on behalf of
approval of this amendment to the Canprehensive Plan Map and Application No.
3-87 which appears later in the agenda imder V.B. Bob 3nythe noted the
envirormental checklist was filed with the Planning Department on May 14, 1987.
Motion by Councilmember Burns sewnd by Councilmember Wisner to close the

B. Audience Participation

Bill Dray expressed o6ncern regardinq the proposed Zoning Code and Area Zoning
, changes that will be oonsidered under V.A, of tonight's agenda. Bill Dray stated
the he is interested in seeing the M-2 zoning maintained for a business that has
operated in Auburn for twenty-eight years.
Gene Wright - 2740 Forest Ridge Drive, Auburn, WA 98002
Gene Wright drew attention to croncerns he had with the proposed changes in zoning
, and uses. Gene Wright stated the restrictions on the kinds of uses and criteria
are not practical especially regarding outside storage, and are not comparable with
other jurisdications.

Frank Miles - P.O. Box 130, Auburn, WA 98071
EYan�c Mi s felt by �lopting a new zoning code for the City of Auburn was a very
positive rtave on the City's part, but stated the proposed code allowed for non-
confottning uses except for his type of business. Frank Miles requested that Miles
Sand and �Yavel not be required to obtain a surface mining permit in order to
oontinue mining in areas that have been mined since 1890. Frank Miles noted that
his oanpany has been operating in Auburn for over forty years and felt the legality
of the requirement to obtain a permit to wntinue mining is very questionable.
Jack Eaing - 622 South Central, Kent, WA 98031
Jack E.ri g, F�ing & Associates and representing Ual Bain, expressed concern for
property located on the west hill in regards to new zoning code. 1fie new zoning
oode would rezone this property to an R-S type wne which requires 35,000 square
foot lots opposed to the current wning of R-1 which allows for 8,000 square foot
lots.
Zanetta Fontes, P.O. Box 626, Ftenton, WA 98057
Zanetta Fontes, attorney representing Continental Dirt, asked that the Council oon-
sider ruling on Continental Dirt's parcels on Auburn-Black Di�nond i�ad and "R"
Street S.E. at a later date and that that property renain wned at C-3 or M-2
instead of changing it to R-3. �
Robert Heller - 1001 Fourth Avenue Plaza, Suite 4400, Seattle, WA 98154
l�bert Heller, Attorney representing Canadian Commercial Bank, stated a letter was
su6mitted to the Council requesting reconsideration of rezone from C-3 to M-1
regarding approximately 15 acres of the Bank's property at the intersection of West

Valley Highway, 15th Street N.W. and State Highway 167. Canadian Catanerical Bank
would like to retain existing zoning. Id�bert Heller appologized to the Planning
�epartment for some of the statements made in the letter. R�bert Heller stated
they may have heard what they wanted to hear, and that the differences are simply
opinions. Imbert Heller indicated Canadian Comnercial Bank's position regardinq
zoning and uses is that there should be a determinant wne with a list of uses and
what the uses could be instead of malcing a eommercial use subject to a review �
process in order for the City to be aware of who is moving in and whether or not
the type of use fits in.
C. Correspondence
Mayor imegner noted a letter dated May 12, 1987 from Robert I. Heller requesting
reconsideration of a rezone; Canadian Comnercial Bank was included in the agenda
modifications.
COUNCIL COP4�IITTEE REPORTS
II. A. Municipal Services
Linda Wisner, Chairnian, noted the Municipal Services Comnittee met on May 4, 1987
and the minutes are of public record. Zhe next meeting will be Nbnday, June 8,
1987 at 7:30 p.m.
B. Planning & Comnunity De�•elopment
Chairman Burns stated the F'lanning & Camnunity T]evelopment Clamnittee met on May 11,
1987 and the minutes are of public record. Zhe next scheduled regular meeting will
be May 26, 1987 at 7:30 p.m.
Nbtion by Councilmenber Burns second by Councilmenber Walters tA adopt the Draft
City of Auburn Zoning flrdinance, Draft City of Auburn Area Zoning Report and Area
Zoning Maps (28 maps) ar� text; and necessary Auburn Comprehensive Plan Map
amendments as reoami�ended by the Auburn Planning Caivnission and amended by the
Planning and Cartnunity Develop�nent Cortmiittee; and instruct the City Attorney to �
prepare the necessary ordinance.
Under discussion Councilmenber INalters requested the Council reconsider Canadian
Cortmercial Bank request at the next Council Conmittee meeting and that it not be
included in tAnight's adoption of code, and if Miles Sand and UYavel was the only
gravel operation subject to the non-conforming use.
Lynn iaued responded there are three locations in Auburn that do not have current
mine peYmits, therefore, Miles Sand and Gravel is not being sinqled out. 'Ihey
include Burlington Northern Railroad and two on Kersey Way.
Discussions centered around the long term process and the short terni process for
amerx9ing the new 2onir�g code and area zoning in order to malce corrections. Mary
McCianber pointed out the staff is recamnending these processes as well as
conducting a public hearing one year from date of publication on the new wninq
code, and for a period of one year the Planning & Corrtnw'iity Development Ca�rtnittee
will have on their agenda every two weeks a portion set aside for citizens to bring
errors in the oode to the City's attention. Mary McCwnber noted this process would
not be used for regular processinq of rezones but rather a flexible system to
systemically look at oode oorrections.
Councilmember Whittall stated he is not in favor of approving the zoning oode this
evening, and felt the Council should look at each section separately and adopt each '
section separately.
Gouncilmember Kurle ooncurred with some of Counci]member Whittall's conments, and
stated there are too many gray areas i.n the proposed zoning code. Gouncilmember
Kurle recamnends the Council look at each section separately.
Councilinember Walters stated the proposed zoning oode ordinance is equitable and
reasonable, and felt the gray areas can be resolved. Councilmenber Walters pointed
out he is tired of driving down residential streets and seeing an apartment complex
in the middle of the development, outdoor storage sitting next t�o freeways, and

Vice�.hairman Whittall reported the Public works Cortmittee met on May 7, 1987 and
the minutes aze of public recrord. The next regularly scheduled meeting is
' Thursday, P7ay 21, 1987 at 7:30 p.m.
D. Finance
Chairman Kurle reported on the Finance Crnmittee meeting which was held prior to
the Council �eting this evening. Chairrtian Rurle informed the Council the aext
regularly scheduled meeting of the Finance Catmittee will be held on June 8, 1987
at 6:30 p.m.
Mayor Roeguer requested a recess at 8:55 p.m. The meeting of the Auburn City Council
recronvened at 9:05 p.m.

gone through the mandatory thirty day review process. The applicants have just
submitted the envirornnental checklist to the Planning Department.

services agreenent between the City and Williams, Roth and Associates, for
design of a water line on 2nd Street S.E., together with street improvements.

Mayor Roegner �mplimented the Council and Planning staff for their omm�itment and
professionalism leading to the adoption of the new aoning oode.
Executive Session
Mayor Rcegner requested a brief executive session for approximately five minutes to
discuss litigation itens. Mayor Rcegner stated rm action would be reqaired by the
Camcil and reootmnended the Camcil meeting be adjoucned.
