Mr. Bhatia - Mr. Bhatia sta�d it �,as not a question as b� whether the sign was
liked, but whether or rot he was operating his business within the law.

No one else spoke for or against the application.
Motion by Councilmember Burns, secrnd by Councilmember Walters tn close the
p�lic hearing.

Councilmember Walters inquired about the application process ard on what basis
the application was d e�ied. Gene Haxh�n, Chief Building Official, explained
the applica ion did not fit the requirements of the oode as stated in Section
18.16.050 (C� (5b) .
General discussion folla,�ed on ways in which the applicant could comply with
the Cale requirements with Councilmembers Wisner arrl Walters supporting the
applicant. Councilmember Lars�n indicated he felt the Hearing Examiner's
decision should be �held. Councilmember Bums indicated his interpretation of
the c.odes seemed to support the applicant.
Motion by Councilmember Lars�n to d�y the applicant's appeal arx3 �phold the
Hearing Examiner's decision tr� deny a permit to allow an additional
freestarcling/portable sign. Secorc7 by Councilmember Brothers.

voted DA.
F'urther discussion follovred on m�dification of the Hearing Examiner's decision.
City Attorney Beceiter stated the decision oould be m�dified if the Council had
a reason Go do so.
Motion by Councilmember Burns, second by Councilmember Walters to m�dify the
Hearing Examiner's d�ision that a portable sign be a1lowEd at 724 22d Street
N.E. based on Council review of the facts ard City Codes, arzl the Council's
interpretation of those ooc3es.
Lynn Rued, Senior Planner, not�ed the new code regulations differ from the old
code. Planning Direcinr Mary McCumber irxiicated any existing signs which do
not comply with the new co�e at the ercl of one year must be taken daan.
