I. A. Flag Salute
The regular meeting of the City of Auburn Council was calted to order by Mayor Bo'�
Roegner at 7:30 p.m. in the City of Auburn Council Qiambers. Mayor Roegner le
those in attendance in the pledge of allegiance. "
B. Roll Call
Those in attendance included Mayor Bob Roegner, and Councilmembers Whittall,
Walters, Burns, Larson, Brothers, Wisner, and Kurle. Staff m�nbers included City
Attorney Jack B�reiter, Parks �C Recreetion Director Len Chapman, Public Works
Director Frank GLrrie, Finance Director Pat Dugan, Fire Ghief Bob Johnson, Planning
Director Mary Nk�mber, Personnel Director Gretel Sloan, Police (�ief Jake Evans,
Police Captain Sherman, Senior Planner Lynn Rued, Deputy City Clerk Gayle Butcher,

C. Announcements and Appointment
1. Announcements
Proclamation
Mayor Roegner presented a proclamation proclaiming the week of December 13 to
19, 1987 as "National Drunk and Drugged Driving Awareness Week" within the City
of Auburn.
Citv Hall Christmas Tree
Mayor Roegner explained the tradition of Councilmembers femilies presenting and
decorating City Hell's Christmas tree, and Mnyor Roegner then introduced ar.�
thanked the families in attendance.

City Hall Press Coverage
Mayor Roegner introduced Brenda Day, Valley Daily News reporter who will now be
covering the City's business items, and Bruce Raimel, Valley Daily News
reporter, who will be responsible for itens of Public Safety.
Boy Scout Troop 331
Mayor Roegner announced that Boy Scouts from Troop 331 were in the audience
this evening earning their carmunication merit badge. Eaeh troop member
introduced himself to the Council.

II. A. Public Hearin�s
1. Application CAP-2-87
The Auburn City Council will conduct a public hearing on the appeal of the
Hearing Examiner's decision to deny the request of Tony's Mobil for a variance
to ellow a 60 foot high sign on property located at 306 "A" Street S. E.
Prior to the opening of the public hearing Mayor Roegner requested City
Attorney Bereiter swear in persons testifying on Application CAP-2-87. Mr,
Tony Reinhart, applicant, Lynn Rued, Senior Planner, and Mery MeC.Lmber,
Planning dc Cortmunity Develo�xnent Director for the City of Auburn, were sworn
in.
Mayor Roegner opened the public meeting.
Tony Reinhart - 306 "A" Street S. E., Auburn, WA
Tony Reinhart expressed concerns involving the hearing exeminer's denial of e
variance to ellow a 60 foot sign being placed on the sign poles currently
located at his property. Mr. Reinhart felt the hearing examiner's decision
placed an undue econanic hardship on his ability to attract motorists from
Highway 18. Mr. Reinhart presented photographs shaving comparable advertising
of various canpetitor's within the city limits of Auburn. Mr, Reinhart also
stated that the 45 foot sign ordinance is detrimental to his advertising
ability since motorists would not be able to see his sign from Highway 18. Mr.
Reinhart stated the 60 foot poles are not detrimental to the City since other
gas dealers, with the exception of the Chevron dealer, have 60 foot poles. Mr.
Reinhart would recondition the poles and install a quality sign. Mr. Reinhart
felt he met the four eriteria as noted in the city's ordinance which is
necessary for a sign variance.
Mayor Roegner called for further testimony from any one wishing to speak on the
public hearing for Application CAP-2-87. No one else spoke for or against the
application.
Motion by Councilman Burns, second by Councilwornan Wisner to close the public
hearing on Application ('AP-2-87.

Sane Councilmembers expressed their concerns and made comnents upon Application
CAP-2-87, and the Planning staff addressed any questions which Councilmembers
directed to th�n. City Attorney Bereiter edvised the Council of their options
of affirming, rejecting, rtadifying, or r�nanding the decision of the hearing
examiner for further consideration on Application GAP-2-87. Planning Director
Me(,limber pointed out to the Council an option to attract motorists to the
City's downtown would be to work with the state's highway department to place
state service signs near exits on highways.
Motion by Councilman Burns, second by Councilwortian Wisner to affirm the hearin
examiner's decision to deny the request of Tony's Nbbil for a variance to allow
a 60 foot high sign on property located et 306 "A" Street S.E.

2. Application No. 26-87
The Auburn City Council opened the public hearing on October 19, 1987 and
continued it until this eveing on Application No. 26-87 regarding the request
of Theron Torgerson to rezone from R-4 (Multiple Family Residential District)
to C-3 (Heavy Camiercial District) and Ca�rehensive Plan Nlap amend from High
Density Residential to Heavy Camiercial Land Use Classification in the vicinity
of 4400 block, east of Auburn Way North.
Mayor Roegner opened the public hearing.
Joel Haggard - 2426 Financial Center, Seattle, WA
Mr. Joel Haggard addressed the Council as the attorney for the applicant. Mr.
Haggard comnended City staff for providing all the necessary information he
requested. Mr. Haggard expressed his concerns in researching the archival
records of the proposed rezone property. Nh. Haggard noted he had addressed a
letter of his concerns to City Attorney Bereiter dated November 18, 1987. Mr.
Haggard briefly explained his findings of review of City records pertaining t�
the rezone of the proposed property in July, 1971.
Mr. Haggard drew attention to the terminology in the City's Comprehensive Plan
and what he felt was spot zoning surrounding the proposed property. Mr.
Haggard presented arguments which he felt should result in either the City
rezoning the parcel from R-4 beck to C-3, or to give back to Mrs. Hodges, the
parcel of property, which was dedicated to the City in 1971.
No one else spoke for or against the application.
Motion by Councilwoman Wisner, second by Councilman Larson to close the public
hearing.
M:7CION CARRIED UNANIMXISLY. 7-0.
Councilmembers directed questions and cam�ents to city staff inembers in the
Planning and Attorney departments concerning the history of this rezone and
possible estoppel law applications. The Council questioned whether Mrs. Hodges
had specific knowledge of the City rezone process in 1971. Mrs. Hodges
answered that a realtor, C. 19alesis, had taken care of matters for her.
Motion by Councilman Burns, second by Councilman Walters to remand Application
No. 26-87 back to the Planning and (',omnunity Development (',omnittee for further
consideration. �

Mayor Roegner celled for a five-minute recess. The City Council meeting
reconvened at 8:45 p.m.
3. 1988 Final Budget Hearing bc Federal Revenue Sharing
The Auburn City Council to conduct the final public hearing on the 1988 City
Budget and proposed use of Federal Revenue Sharing Funds.

extended) in the 900-1000 blocks between 5th and 8th Streets N.E.

Chairman Burns noted the Planning dc (',amiunity Development Comnittee did not meet
since the last Council meeting. The next regularly scheduled meeting will be held
on Thursday, December .10, 1987 at 6:00 p.m.

Chairman Larson reported that the Public Works Comnittee did not meet. The next
regularly scheduled meeting of the Public Works Cormiittee is Thursday, December 10,
1987.

The Council continued the hearing until December 21, 1987 regular Council meeting.

The request of Block Bros. (USA), Inc. for a preliminary plat to be known as Puget
Sound Park of Industry consisting of 53.4 acres zoned M-1 (Light industrial) and

Auburn Way North.
