Flag Salute The re;ular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. Boy Scout Troop 401 members Peter Super, Mark Forchione, Geoffrey Zak, Scott Zak, and Lawrence Silk posted the colors of the flag and led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner, and Councilmembers Whittall, Walters, Burns, Larson, Brothers, Wisner, and Kurle. Staff inembers included Parks bc Recreation Director Len Chapman, Public Works Director Frank Qirrie, Finance Director Pat Dugan, Fire Chief Bob Johnson, Planning Director iNary NkQimber, City Attorney Jack Bereiter, Police Chief Jake Evans, Police Captain Bill Pitzl, Senior Planner Lynn Rued, and City Clerk Robin Wohlhueter. C. Announcements and Appointments 1. Announcements Council Minutes Amend�nent Meyor Roegner noted the minutes of December 21, 1987 regular Council meeting reflect an incorrect time length for the Police Lieutenants Union contract. , Motion by Councilmember Larson, second by Councilmember Wisner to approve amenc�nent to the Dece�nber 21, 1987 regular Council meeting minutes under item VIII.A. authorizing the Mayor and City Clerk to sign a three year contract with the Police Lieutenants Union for 1987-89. ' Game Farm Park Dedication Mavor Roegner informed the Council the dedication of the Auburn Game Farm Park is scheduled for June 4, 1988 along with possible completion of other city parks such as Issac Evans. Annual State of City Address Mayor Roegner announced his ennual State of the City Address is scheduled for Tuesday, February 16, 1988 at the regularly monthly meeting of the Auburn Area Chamber of Camnerce. 2. Appointments Airport Board Motion by Counciimember Larson, second by Councilmember Walters to Confirm the re-appointment ot Dave Nbrgan to the Airport Board for a five year term which would expire December 1992. NI7f[ON CARRIED UNANINDUSLY. 7-0. New City Attorney Mayor Roegner introduced Marguerite Schellentrager to the Council, and noted the extensive personnel selection process by which she was selected. Merguerite Schellentrager will replace retiring City Attorney Jack Bereiter. CITIZEN INPUI', PUBLIC HEARINGS & �RRESPONDENCE Public Hearings 1. Lend Clearing Ordinance The request to hold a public hearing regarding Chapter 15.74 of Ordinance entitled "Land Clearing". � Auburn Codified Ylary MeGUmber briefy explained that due to unauthorized clearing of land last year and concerns raised by neighboring property owners, staff felt it necessary to establish an ordinance regulating land clearing. Mary MeQimber pointed out staff researched a wide range of land clearing approaches used stetewide in drafting an ordinance to regulate removal of trees with set conditions. The draft ordinance provides for a permit process and intends to manage surface water runoff and erosion problems. The proposed ordinance would allow the city to utilize its permit process instead of relying solely on the Department of Natural Resources. �Vleyor Roegner opened the public hearing. Larry Frazier - 2115 112th Avenue N.E., Bellevue, WA Lerry Frazier referred to a letter submitted to the Auburn City Council requesting potential amendments to the draft ordinance. Larry Frazier urged Council support of the staff recomnendation in adoption of the proposed ordinance. Robert Lloyd - 5800 South 316th, Auburn, WA Robert Lloyd suggested Council consider including languege in the draf� ordinance addressing the growth of nAturel vegetation and view properties Concerns centered around natural vegetation growing up enough to eventuall obslruct view properties along the ridge. H.E. Holm - 100 Mountain View Drive, Auburn, WA H.E. Holm felt view properties should be given consideration as pert of the ordinance. Lloyd Jones - 120 H Street N.W., Auburn, WA Lloyd Jones, Forester for the Department of Natural Resources, expressed concerns about the professional forestry expertise involved with the proposed permit process for land clearing. Lloyd Jones suggested establishment of an urban zone for better review through the SEPA process. Lee Singer - 235 Hi-Crest Drive, Auburn, WA Le�' Singer, representing residents of Hi�rest area, stated this neighborhood has been hurt by the lack of an ordinance governing tree removal, and expressed support of the proposed ordinance. Meris Nixon - 523 Aaby Drive, Auburn, WA Mrs. Nixon concurred with the proposed ordinunce in that it regulates tree cirtting whieh would prevent Auburn from looking like California. Steve Peters - 102 Hi-Crest Drive, Auburn, WA Steve f'eters suggested that the ordinance should allow for topping of trees. No fees would be imposed by this for any such fees would be part of a separate general fee Since the ordinance provides for a means of a permit process for land clearing and not forestry, Frank GLrrie comnented that an engineer, in processing a permit, could consult with a forester as deemed necessary. Motion by Councilmember Burns, second by Councilmember Walters to approve the ordinance including amendments resulting from Seattle Master Builder AcGOCiation comnents, language addressing view properties and section 15.74.020 (D), expanding how applies when less than one acre and more, of draft ordinance. Application No. V-2-87 7'he Auburn City Council continued this public hearing at their November 16, 1987 regular meeting on Appplication No. V-2-87 regarding vacating a portion of a subdivision lying north of 7th Street N.E. George Schuler - 1413 12th Street N.E., Auburn, WA George Schuler spoke in behalf of the Scarff family. George Schuler pointed out the vacation would allow for development in the future with the plat still being served by two public streets. �Notion by Councilme�nber Burns, second by Councilmember Wisner to close the public hearing. M7fION CARRIED IJNANIM�USLY. Councilmember Burns questioned the development of streets surrounding the proposed plat vacation in relation to Fred Meyer proposal. Discussion centered arou�d the staff addressing Council concerns regarding localion of streets surrounding Application No. V-2-87. Audience Participation Mark Brandow - 505 29th Street S.E. Mark I3randow, President of Northwest Residential Services, Inc., explained that they ht�d continued the process of obtaining a Conditional Use Permit from the city to provide new services at the Chartley House. Merk Brandow specified that potentially dangerous persons with crimninal behavior will not be allowed aclnission to Chartley liouse, and city staff will participate in a citizen advisory comnittee to monitor the permit. Sherill Clark - 1717 3rd Street N.E., Auburn, WA Sherill Clark, Troop 401 Scout 1Naster, mentioned that Boy Scout Troop 401 presented the flag cerinony earlier in the meeting, and reeognized Boy Scout Danonic Thompson. Danonic Thanpson has just returned from the l6th World Australian Jamboree 1987-88 in Australia. Meyor Roegner suggested a recess at 8:38 p.m. for approximately five minutes. OWNCIL �VINITTEE REP'OIiCS January 18, 1988 Municipal Services Chairinrin Wisner reported the Municipal Services Carmittee has not met since the last Council meeting. The next meeting of the Municipal Services Camiittee on January 29, 1988 is cancelled. B. Planning bc Carmunity Development Chairman Burns stated the Planning dc Cartnunity Development C,ormiittee met on Janua 12, 1988 and the minutes are of public record. The next Planning dc Cormwnity Development Comnittee meeting is scheduled for Tuesday, January 26, 1988 at 7:30 p.m. C. Public SVorks The Public Works Chairrm n, Bud Larson, stated this comnittee has not met since the last Council meeting. The next meeting of the Public Works Camiittee will be held on January 21, 1988 at 7:30 p.m. Bud Larson announced the Council Cannittee on Camnittees will meet this Wednesday, January 20, 1986 at 6:00 p.m. at Auburn City Hall. D. Finance Chairmrin Kurle reported the Finence Cartnittee met at 6:30 p.m. prior to the Council meeting tonight to review surplus of equipment, legal advertising bid award, and claims and pn,yroll. Councilme�nber Kurle's motion to authorize one councilmember to attend the meeting died for lack of a second. Application No. 26-87 The Auburn City Council at its December 7, 1987 Council meeting referred this item to the Planning & Carmunity Development C'.amiittee for their review regarding the request of Theron Torgerson to rezone from R-4 (Multiple Family Residential District) to C-3 (Heavy Cannercial District) and Canprehensive Plan Map amendment from High Density Residential to Heavy Corrmercial Land Use Classification in the vicinity of 4400 block, east of Auburn Way North. The Planning & Cartnunity Development Camiittee wil] consider this on February 9, 1988 at the request of the applicant. B. Resolution No. 1809 The Auburn City Council at its December 21, 1987 Council meeting referred Resolution No. 1809 to the Public Works Cannittee for review. Resolution No. 1809 peratins to a solid waste interlocal agreement with King County. No action required by the City Council until the end of June. C. Resolution No. 1810 The Auburn City Council at its December 21, 1987 Council meeting referred Resolution No. 1809 to the Public Works Carmittee for review. Resolution 1810 authorizes the IVleyor and�City Clerk to execute a forum interlocal agreement with King County that will consider issues of policy regarding terms and conditions of the solid waste interlocal agreement entered into by the cities and towns located with King County. No action required by the City Council until the end of June. VI. [�1N BUSINESS A. Application No. 5-877C City Council to consider amending the C-1, Light Cannercial, District to allow for household goods storage subject to a Conditional Use Permit and to instruct the City Attorney to prepare the necessary ordinance. The Council reviewed Application No. 5-877�. Application No. 34-87 City Council to consider approval of the Conditional Use Permit on the request of � Chartley Nouse to ellow them to continue and to provide additional services to the mentally ill at their facility located at 505 29th Street S.E. based upon the Hearing Exeminer's �indings of Fact, Conclusions and Conditions. Mary i17c(,�mber reported on a series of criteria which the State Department of Socia] Health and Services uses to exclude mentally ill offenders from admission to the Chartley House in Auburn. It was noted that staff worked with Washington State Department of Social and Henith Services and staff from King County Deparfinent of Human Itesources in developrnent of criteria which prevents program placement of inentally ill offenders in the Chartley House. �lary McGUmber explained steff recarmends approval subject�to six conditions. That DSHS contract be part of the (',onditional Use Permit, -5- �\ �� ., :I'CY OF AUF3URN �UNCI L W;V: f I NG January 18, 1988 there would be no amendments to contract without prior review of the Planning Director, a change of ownership or management of Chnrtley House to review permit with city to ensure future compliance, the City of Auburn would have a representative on the Advisory Camiitlee and the Comnittee shall assist in monitoring the permit, using the Washington State Department of Social Health and Services' criteria to insure conditions are being met in not admitting mentally ill offenders to Chartley House, and that the Advisory Cortmittee and/or City of Auburn may ask for a Randan Patient Profile to monitor requirement of the permit. The Councilmembers expressed concerns in several areas pertaining to issuing approva, of the Chartley House Conditional Use Permit to provide services to the mentally ill Concerns include the kind of patient problems that would be accepted into the inpatient or outpatient program offered by the CharU ey House, what kind of leverage would lhe City of .Auburn have if a patient projected crimninal behavior while resident of CharU ey flouse, average stny and ability for patients living on their own upon canpletion of the Chartley House program, end number of public safety calls the city has received in the past yenr from the Chartley House. Mark Brandow, President of Northwest Residential Services, Inc., addressed the concerns expressed by the City Council. Merk Brandow e�nphasized the Chartley House has taken patients tran Western State Hospital since 1977, and the most significant chenge has been not in the type of patient eccepted at the Chartley House, but the change in staff. Mnrk Brandow stated the Chartley House will provide a psychiatrist visit four times a week to the Chartley House and has a psychiatrist on-call 24 hours-a-day, 24 hour medical administration/monitoring by licensed staff. Currently the Chartley House admits between sixty to sixty-four patients into their program with the average stay being one to two years. Outpatients living in the cattnunity will also have access to mental health services provided by Gl�artley House. Mark Brandow comnented that the demand for mental health services in Auburn is more than what Velley Cities Mental Health can manage. Mark Brandow noted that elcohol/drug use is not the primary problem seen at the ChRrtley House. Concerns raised by the council regarding leverage the city would hav� if a patient displayed behavior that did not meet the conditions of the permit wa addressed. Mark Brandow assured the council that condition six of the permit woul allow for the city to request patient profile, subject to civil rights. Council, staff, and Ylr. Brandow spent some time discussing a hypothetical patient profile when a patient condition results in signs of a violence or criminel behavior and what interpretation would or could be made by the judicial system. Brandow and Mary MeCumber reiteriated that no mentally ill offenders would not be allowed to reside on the premises of the Chartley House, and with assistance fran the representative on the Advisory Carmittee a profile can be rtanitored for review and compared with all conditions of the Conditional Use Permit. Mary MeCumber assured the Council that ell conditions of the permit would be monitored by staff. The city's Public Safety Officials responded to the concern expressed by a Councilme�nber regarding the number of call received by Police and Fire Departments at the Chartley House. Chief Johnson stated the Fire Department responded to 3400 aid call during 1986, and of thet response 34 were to the Chartley House. During 1987 the Fire Department realized a 10% increase in aid calls, with response to the Chartley dropping 40%.Chief Evans noted the Police Department received tens calls in 1987 from the Chartley House requesting assistance, mostl,y for missing residents. Motion by Councilmember Burns, second by Councilmember Walters to affirm the Hearing Examiner's decision to approve the Conditional Use Permit based upon the Hearin Examiner's Findings of Fact, Conclusions and Conditions, end instruct the City Attorne� to prepare the necessary ordinance. Chapter 35A.63 of the laws of the State of Washington, designating these amendments as guidelines for exercising the city's authority under the Washington State Environmental Policy Act (SEPA) and directing that this Resolution and the Camprehensive Plan Text Amendments it adopts and approve� be filed with the Auburn City Clerk and be available for public inspection.
