The regular meeting of the City of Auburn Council uras called to order by Mayor Bob
;oegner at 7:30 p.m. in the City of Auburn Council Chambers.
I. A. Flay Salute
Boy Scout Pack 456 posted the colors of the flag, and led those in attendance in
the pledge of allegiance. The representatives of Boy Smut Pack 456 included Randy
Powel.l, Assistant Leader, Brandon R�ell, Ryan Pryor, Zack Cbpe, '171omas

a. Farthquake Awareness Week
� Mayor Roegner presented Fire Chief Bob Johnson with a proclamation
proclaiming April lU through April 16, 198f3 as "Farthquake Awareness Week."

Mary Stanton received the proclamation presented by Mayor f�egner
proclaiming April 17 through April 23, 1988 as "National Library Week."

Mayor Roegner noted the City of Auburn Library is experimenting with staying
open on Sundays.
2. Appointments
Mayor Roegner announced his recommendations for appointment to the Auburn
Centennial Commission for the duration of the mrmnission which shall last until
December 31, ]991. It was roteci there are still four positions vacant

Additionally, Msyor Roegner noted there were twenty to twenty-tive people that
were suggested by other clubs or volunteers to participate, and even though the
city was unable to name then as comnission members, there would be future
involvment for them as the carmission progresses.

A. Public Nearings
1. Local Improvanent District No. 339
The Auburn City Council of the City of Auburn adopted Resolution No. 1827 on
March 7, 1988 declaring the intention to initiate the formation of Local
Irtprovement District No. 339 to construct and install asphalt pavement,
including crushed rock subbase, storm drainage ditches and gravel shoulders and
miscellaneous related work along property described in Resolution No. 1827 to
assess all of the cost and expense of such improvement against the property in
such district specially benefited thereby.
Mayor Roegner opened the public hearing.
Rich Wagner - 4925 Foster Avenue S.E., Auburn, WA
Rich Wagner, resident within area of proposed local improvement district,
thanked staff for their assistance in keeping the rural 2one within the
proposed area as pert of the Canprehensive Plan. Rich Wagner requested a show
of hands of those who have signed the petition in favor of the proposed local
improvanent district. Nbst of the audience raised their hands. Rich Wagner
pointed out eighty-eight percent represent favorable LID petitioners. Rich
Wegner stated the proposed LID area currently has the most hazerdous school bus
stops in the systan, and new road improvements will alleviate this problem.
Rich Wagner requested Council approve roed improvements Tor the Hidden Vall�
area.
Reba Kavran - 5222 Bridget Street S.E., Auburn, WA
Reba Kavran stated she was not in favor of the proposed local improvement
district because it would be an extrene and unusuel hardship due to her incane.
Reba Kavran indicated that she hes been threatened with condemnation, and
pressured by Rich Wagner. Reba Kavran indicated thet Rich Wagner introduced
himself as a representative ot the city.
Mayor Roegner clarified thet Rich Wegner did not work for the City of Auburn,
but was a neighborhood representative.

related work along 53rd Street S.E., Ward Avenue S.E., Bridget Avenue S.E.,
55th Street S.E., Duncan Avenue S.E., Foster Avenue S.E. and proposed 47th
Street S.E, west of Foster Avenue S.E.; construction and installation of
asphalt pavement, including gravel base, crushed rock subbase, storm drainage
ditches and miscellaneous related work along proposed 47th Street S.E., west of
Bridget Avenue S.E.; installation of street lights at 53rd Street S.E, and Ward
Avenue S.E., 53rd Street S.E. and Bridget Avenue S.E., 55th Street S.E. and
Foster Avenue S.E., Bridget Avenue S.E. and proposed 47th Street S.E. and north
end cul-de-sac Foster Avenue S.E., within the County of King, State of
Washington, all in accordance with Resolution No. 1827 of the City Council;
creating and establishing Local Improvement District No. 339; providing the
method of assessment in said district and the mode of payment thereof, and
creating a Local Improvenent Fund therefor and authorizing staff to call for
bids.
Motion by Councilmember Wisner to introduce and adopt Ordinance No. 4279,
second by Councilmember Burns.

2. Application 50A-87
Consideration of the proposed Lakeland Hills Plan as an element of the Cit of
Auburn Camprehensive Plan. The Lakeland Hills Plan is intended to serve �s a
guide for making future decisions regarding public improvements and development
approvals in the Lakeland Nills Special Planning Area.
Prior to opening the public hearing Senior Planner Rob Chave briefly updated
the Council on the proposed Lakeland Hills Plan. Rob Chave stated after the
edoption of the Canprehensive Plan a number of areas were left for future
consideration because of the need of more detailed investigation of
circumstances involving certain areas to identify what the planned uses and
conditions should be that would accanpany developments. The Lakeland Hills
eree is the first special planning area to come before the council which is
designed to be incorporated into the Comprehensive Plan as an element. Rob
Chave noted the issues surrounding the Lakeland Hill Plan include "A" Street
S.E. bridge widening project, and park land of which the developer htas the
plans requiranents.

B. Audience Participation
Mayor Roegner drew attention to those that were in the audience that had interest
in Application No. 6-88, and invited audience participation. Application No. 6-88
is the request of Robert and Janet Dressel for a preliminary plat to be known as
Siler's First Addition consisting of 4.39 acres located on the north side of 37�
Street S.E. in the 1400 block and extending north to 33rd Street S.E.
Jay Witherbee - 3511 4th Street S.E., Auburn, WA
Jey Witherbee expressed concern that he had not been notified of the public hearing
that wes held before the Hearing Examiner, felt an error in procedure occurred, and
requested council conduct another public hearing on Application No. 6-88.
Mary Eversole - 3508 O Street S.E., Auburn, WA
Mary Eversole reported that she told neighbors of the public hearing that was held
before the Hearing Examiner, and requested council hold another public hearing
regarding Applicetion No. 6-SS.
Mayor Itoegner requested agenda item V.A. be addressed at this time.
Resolution No. 1639
A Resolution of the City Council of the City of Auburn, Washington, approving the
preliminary plat to be known as Laus Deos Addition, a 12 lot residential single
family subdivision consisting of 2.9 acres on property zoned R-2 (Single Femily)
and located on the noeth side of 29th Street S.E. in the 800 Block.
Mayor Roegner briefed the council on previous action tabling Application No. 33-87
regarding the "Laus Deo" preliminary plat due to allegations made by Laurel
Lorenz-Tsujikawa in a letter she submitted. Ms. Lorenz-Tsujikawa, a citizen,
referred in her letter to e conversation she had with Councilmember Lerson.
Councilmember Larson was hospitalized at the time of Ms. Lorenz-Tsujikawe,,'�
allegations and unable to conment on the issue. Mayor Roegner offe�
Councilmember Larson an opportunity to respond to the letter submitted by Leu
Lorenz-Tsujikewa.
Councilmember Larson clarified the statements made in the conversation with Laurel
Lorenz-Tsujikawa on Tuesdey, February 17, 1988. Councilm�nber Larson noted he and
Ms. Lorenz-Tsujikawa are employed by the Auburn School District and see each other
on school matters several times a day. Councilmember Larson further explained that
on Februery 17, 1988, they saw each other at school and the issue of the "Laus Deo"
preliminary plat came up. Ms. Lorenz-Tsujikawa asked Councilmember Larson what he
thought ot it. Councilmember Larson stated he said that unless the neighborhood
had other evidence besides what the council had seen so far, he would probably vote
to put the road through. Ms. Lorenz-Tsujikawa stated that Cowicilmember Larson was
prejudging the issue, and Councilmember Larson said he responded, "No, 1 don't
think so." Councilmember Larson reiterated at the time of this conversation with
Ms. Lorenz-Tsujikawa he had not prejudged or pre-decided the issues surrounding the
decision on Application No. 33-87. Councilmember Lerson gnphasized that he is a
man of integrity and intended to vote on this matter.
City Attorney Marguerite Schellentrager reported she has spoken to Councilmember
Larson concerning his conversation with Ms. Lorenz-Tsujikawa and thoroughly
researched the doctrine of Appearance of Fairness and reviewed the statutes that
relate to that doctrine. Ms. Schellentrnger's legal opinion and conclusion that
Mr. Larson's conversation with Ms. Lorenz does not violate the Apper�rance ot
Fairness doctrine and does not violate the Standard Appearance of Fairness te�
Ms. Schellentrager continued that Couneilmember Larson's statement on the rec
is in compliance with the requirements of the Appearance of Fairness statute.

Municipal Services
Chairmnn Whittall reported the Municipal Services Camnittee met on Merch 31, 1988
and the minutes are of public record. Councilmember Nfiittall requested Police
Chief Jake Evans comnent on the scheduled child abuse training offered to public
safety personnel.
Jake F,vans stated thet due to the recent tragic death of Kevin Hoffman, as a result
of child abuse, the Police 6c Fire Departments have reexamined and reviewed their
procedures in response to such cases. Additional training has been scheduled to
emphasize the responsibilities of both medical and police personnel in child abuse
cases.

have been individually reviewed by carmittee members which appear under the consent
agenda. The next meeting will be April 18, 1988.

family subdivision consisting of 2.9 acres on property zoned R-2 (Single Family)
and located on the north side of 29th Street S.E. in the 800 Biock.
The City Council acted upon Resolution No. 1839 under agende item II.B.
B, Resolution 1809
The Auburn City Council at its December 21, 1987 Council meeting referred
Resolution No. 1809 to the Public Works Cartnittee for review. Resolution No. 1809
pertains to a solid waste interlocal agreement with King County.
No action required by the City Council until the end of June.
C. Resolution 1810
The Auburn City Council at its Decenber 21, 1987 Council meeting referred
Resolution No. 1810 to the Public Works Carmittee for review. Resolution 1810
autho�izes the Mayor and City Clerk to execute a forum interlocal egreement with
King County that will consider issues of policy regarding terms and conditions of
the solid waste interlocal agreement entered into by the cities and towns loca�
with King County.
No action required by the City Council until the end of June.
D. Application No. 26-87
The Auburn City Council at its December 7, 1987 Council meeting referred this item
to the Planning dc Comnunity Development Comnittee for their review regarding the
request of Theron Torgerson to rezone from R-4 (Multiple Family Residential
District) to C-3 (Heavy Cattnercial District) and Comprehensive Plan Map emendment
fran High Density Residential to Heavy Corrtnerciel Land Use Classification in the
vicinity of 4400 block, east of Auburn Way North.
No action required by the City Council et this time.

Annie MeDonald, R.N., to do medical screening of prisoners at the Auburn City
Jail.
Motion by Councilmember Whittall, second by Councilmember Brothers to approve
Resolution No. 1840.

two foot easement from the Auburn Water Department to the Auburn Street
