Fla¢ Salute The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. Cub Scout Pac 401 posted the colors and led the pledge of allegiance. Mayor Roegner thanked Pac 401. B. IRo 1 Cail Those in attendance include Mayor Bob Roegner, and Councilmembers Brothers, Burns, Kurle, Larson, Walters, and Whittail. Councilmember Wisner is absent. Staff inembers in attendance include Pazks & Recreation Director Len Chapman, Public Works Director Frank Currie, Fire Chief Bob Johnson, Senior Planner, Lynn Rued, City Attorney Mazguerite Scheilentrager, Police Chief Jake Evans, Finance Director Pat Dugan, Personnel Director, Gretel Sloan, Deputy City Clerk Jan Hubbard, and City Clerk Robin Wohlhueter. C. Announcements and Annointments 1. Announcements - a. Mayor Roegner noted budget season has started, and stated the Council Goal Setting Workshop is � tentatively set for October 3, 1988, at 5:30 p.m. in the Council Work Area prior to the regulaz Council meeting. b. Police Deoartment Award Mayor Roegner and the Council honored Of£icer Kelly and canine Judge with a medal of distinction for their outstanding service as a Canine Team over the last six years. ; ... y � NLC Votine Deleaates Council consideration on the appointment of Councilmember Pete Whittall as voting delegate to the National League of Cities Conference December 3-8, 1988; and as alternates, Councilmembers Don Kurle and Jim Walters. Mayor Roegner stated Councilmember Kurle has a schedule conflict and will not attend the conference. Motion by Councilmember Larson, second by Councilmember Burns to appoint Councilmember Whittall as the voting delegate, and Councilmembers Walters and Brothers as the alternates. MOTION CARRIED UNANIMOUSLY. 6-0. ; Plannina Commission Council Consideration of the appointment of George Sanders to the Auburn Planning Commission to fill John Carpenter's unexpired term. Mr. Sanders term will expire December 31, 1992. �? Centennial Commission Councit consideration on the appointment of Hiro Nakai as a representative of the White River Buddhist Temple to serve on the Auburn Centennial Commission. His term wili expire December 31, , 1991. � IV.A. 1 �2� CITY OF AUBURN COLJNCIL MEETING September 6,1988 Motion by Councilmember Larson, second by Councilmember Waiters to approve George Sanders to the Planning Commission and Hiro Nakai to the Centennial Commission. MOTION CARRIED UNANIMOUSLY. 6-0. Councilmember Kurle introduced Wallace Wong who is attending the Council meeting tonight. Wallace is a Hoy Scout from Troop 401 working on h;s citizenship merit badge. D. Aeenda Modifications Mayor Roegner noted the agenda modification appears under I.C.2. Item I.C.2 requests Council consideration of H'uo Nakai for appointment to the Centennial Commission. I r . y i. •;; �• � . A. Public Hearinas 1. Aoolication No. 24-88 Council consideration on the request of Primazk Corporation for a Conditional Use Permit to implement a conceptual Conditional Use Permit previously approved under Ordinance 4114 to allow construction of 302 multi-family units on property located southwest of 15th Street N.W. extending south to South 320th Street lying east of 60th Avenue South. Prior to opening the public hearing Mayor Roegner asked Senior Planner Lynn Rued to give a brief history of the project. Mr. Rued stated the most relevant history of the project dates back to 1981 when an ETS was done on the project. Based upon the EIS, the Council in 1981 approved another mining permit and a conditional use permit (CUP) for attached residential housing. Both permits were for a 5 year period. In 1986, the Council again considered the mining permit and CUP. The mining permit was approved for another five � years and a conCeptual conditional use permit was approved for the attached residential housing. Mr. Rued stated those permits in 1986 approved the arterial and the multi-family housing. Mr. Rued stated the purpose of this conditional use permit is to review the actuai siting of the dwelling units, to review a traffic study to determine the improvements required of the arterial, to ensure the park standards are met, to ensure a traffic signal is constructed at 15th N.W. and West Valley i-lighway, and to ensure the adequacy of utilities. Mr. Rued commented that subsequent to the 1986 approvals a new comprehensive plan, zoning code and map were adopted which added constraints to multi-fami]y development in single family zones. Mr. Rued stated since the approvals occurred prior to the new code they were vested and could not be considered as a new project.. Mayor Roegner asked that anyone wishing to testify for or against Appiication No. 24-88 be sworn in at this time. Approximately six people stood from the audience along with City staff while Marguerite Schellentrager administered the oath. In conformance with the Revised Code of Washington relating to the Appearance of Fairness doctrine ia ex parte communications, Mayor Roegner requested Councilmembers cite any outside contact they may have engaged in with either opponents or proponents in regard to Application No. 24-88. Mayor Rcegner opened the public hearing. � Jan Mehloff 512 eAh., Tlriva A��hnrn ORAM Jan Mehloff stated she represenu a group of concerned property owners on the west hill. She read a copy of a petit;on signed by 85 property owners and submitted to the Council which requests the Cauncil deny Application No. 24-88. Ms. Mehloff stated the west hill property owners feel Applicatioa 24-88 should comply with the requirements of the new comprehensive plan, aad that conditions have changed enough to warrant a new EIS. �. Auburn 98002 Alva Loag, attorney representing Gertrude Jones who owns 38 acres directly below the proposed construction,requested a new EIS because his ctient does not feel drainage has been taken into consideratioa. A heavy rainfall in 1986 caused gravel to wash onto Ms. Jones' property. Mr. Long read a letter concerning the storm and subsequent drainege problem into the record. �Pnn Ctucki 724 W Hi-Crest Dr Aubutn 98002 Leon Stucki stated the neighborhood wants the single-family character ; of the neighborhood preserved. He stated he thought the original project was for condos which would better preserve the single family atmosphere of the community. He asked that the Council consider the wishes of the property owners. Fred Rilev 4813 Milloond Loon Auburn 98002 Fred Riley, a resident of Lakeland Hills, stated Application 24-88 reminded him of the concerns expressed by Lakeland Hills homeowners regarding a recent application ia Lakeland Hills for multi-family housing there. He reminded the Council they represent the people and asked them not to repeat the Lakeland' Hills decision which was in favor of the developer. The following persons wishing to test;fy were administered the oath by City Attarney Schellentrager as they had not taken the oath previously. �rsil Knierim 32206 58th Avenue S Auburn 98002 Virgil Knierim stated he is a King County police officer who says the biggest problems on the west hill now are daytime robberies. He feels a multi-family housing project would bring other problems such as drug trafficking. Guv Soencer 1200 S 192d Suite 102 Seattie 98148 Guy Spencer, the architect for Primark Corporation, stated the density of the housing is 302 uniu on 55 acres, or 6 units per acre, which is ' less density than some single housing projects. He described the projecPs buffer areas, new arterial, and health and recreational facilities. Rnrh Richardson CDS Manaeement Ruth Richardson stated the goal of CDS Management is to work with the developer (Primark) to enhance the development. She stated the units will have deterrents to burglary and theft, potential renters witl be screened for certain income levels, and recreational facilities will always be monitored. A study of the needs of the neighborhood was performed prior to designing the development. City Attorney Schelientrager swore in the following persons to testify. iamac r imric 524 Aabv Dr Auburn 98001 James Limric felc iacrease in capacity at Evergreea Heights Elementary that would occur as a result of the proposed development had not been addressed, nor the possibie increase in traffic. He feels the new arterial will create more of a traffic bottleneck. *4arilvn Gould 32320 58th Ave S Auburn. 98001 Marityn Gould stated she feels the Council is not treating applications with consistency. She cited the Val Bain development in which 57 units are proposed on 44 acres. Motion by Counciimember Burns, second by Cauncilmember Whittall ' to close the public hearing. MOTION CARRIED UNANIMOUSLY. 6-0. Discussion followed in which Councilmembers asked the staff ahout the drainage on the proposed devetopment. Public Works Director, Frank Currie, stated a new drainage plan has been implemented in the area which is quite adequate to handle storms such as the one that occurred in 1986. Further discussion took place about the amount of rent for tha units. PAGE 3 4 CITY OF AUBURN COUNCIL MEETING B. C. September 6,1988 Councilmember Walters asked the City Attorney what the rights of the developer are if the Council denys the application request. City Attorney Schelienuager stated the developer has vested rights and is entitled to pursue development. The applicant has complied with all the conditions outlined by the City. Further discussion followed about the bike lane and sidewalks oa the arterial, potential for landslides, landscaping requirements, and adequacy of the current EIS. Motion by Councilmember Burns, second by Councilmember Walters to approve the conditional use permit implementing the conceptual Conditional Use Permit approved under Ordinance No. 4114 based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions as outlined and to instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED. 5-1. Councitmember Whittail voted no. Councilmember Burns asked that a re-examination of the Hearing Examiner's role be placed on the agenda of the next Planning and Community Development Committee meedng. Mayor Roegner cailed a recess at 8:55 p.m. The Council meeting reconvened at 9:05 p.m. Audience Particioation: None. . .� � , Councilmember Wisner Letter of Resienation Council determination of the letter submitted by Linda Wisner dated August 19, 1988 requesting acceptance of her resignation of Council Position nl on the Auburn City Council. Motion by Councilmember Larson, second by Councilmember Burns to accept Linda Wisner's resignation from the City Councii and authorize acceptance of letters of interest for Council Position No. 1 beginning September 7 through September 16, 1988, at 5:00 p.m. Councilmembers will interview applicants September 20, 21, and 22, 1988. MOTION CARRIED UNANIMOUSLY. 6-0. Mayor Roegner and some Councilmembers expressed reluctance in accepting Ms. Wisner's resignadon and noted her outstanding service on the Council. Mayor Roegner stated applicants should send a letter of interest and resume to the City Clerk's office beginning September 7 and concluding September 16, 1988, at 5:00 p.m. III. COUNCIL COMMITTEE REPORTS A. Municinal Services Chairman Whittall stated the Municipal Services Committee has not met since the last Council meeting. The next regu]azly scheduled Municipal Services Committee meeting will be September 15, 1988, at 5:30 p.m. B. Plannin¢ & Communitv Develonment Chairman Burns stated the Planning 8c Community Development Committee has not met since the last Council meeting. The next meeting will be September 13, 1988, at 7:30 p.m. C. Public Works Councilmember Burns, Vice-Chairman of the Public Works Committee, reported the Committee met August 18, 1988, and the minutes are of public record. Councilmember Burns, due to scheduling conflicts, deferred chairmanship of the Public Works Committee to Councilmember Larson. Resolution No. 1871 A Resolution of the City Council of the City of Auburn, Washington, amending and approving the Comprehensive Plan policies for the exercise of substantive authority under the State Environmental Policy Act Rules, for the City of Auburn, Washington, pursuant to the provisions of Chapter 70.105 RCW of the laws of the State of Washington, designating said amendment as guidelines for exercising the City's suthority under the Washingtan State Environmental Policy Act (SEPA). Motion by Councilmember Burns, second by Councilmember Whittall to adopt Resolution No. 1871. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Resolution No. 1888 j A Resolution of the City Council of the City of Aubwn, Washington, recognizing the 25th Anniversary of the Planning Association of Washington. Resolution No. 1889 A Resolution of the City Council of the City of Auburn, Washington, suthoriting the Mayor and City Clerk to execute a forum interlocal agreement with King County that will consider issues of policy regarding terms and conditions of the Solid Waste interlocal agreemeat entered into by the cities aad towns located within King County. Motion by Councilmember Larson, second by Councilmamber Burns to adopt Resolution No. 1889. Resolution No. 1891 A Resolution of the City Council of the City of Auburn, Washington, approving a request of the City of Kent to use City of Auburn water franchise area and suthorizing the Mayor to execute a letter of authorization. Motion by Councilmember Larson, second by Councilmember Burns to adopt Resolution No. 1891. MOTION CARRIED UNANIMOUSLY. 6-0. 6. R.esolution No. 1892 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Comprehensive Wetiand Management Program Agreement, Phase I, between the City of Auburn and the State of Washington Department of Ecology. Motion by Councilmember Burns, second by Councilmember Whittall to adopt Resolution No. 1892. MOTION CARRIED UNANIMOUSLY. 6-0. 7. Resolution No. 1893 A Resolution of the City Council of the City of Auburn, Washington, suthorizing the Mayor and City Clerk to enter into an agreement with King County to provide county funds to the City for the planning, developmeat and implementation of a Waste Reduction Recycling Program. Motion by Councilmember Larson, second by Councilmember Burns to adopt Resoludon No. 1893. MOTION CARRIED UNANIMOUSLY. 6-0. 8. Resolution No. 1894 A Resoludoa of the City Council of the City of Auburn, Washington, suthorizing the Mayor and City Clerk to enter into a lease agreement with Car-Temps Rent-A-Car for office space located in the Auburn Flight Center Building situated at the Auburn Municipal Airport. Motion by Councilmember Larson, second by Councilmember Burns to adopt Resolution No. 1894. MOTION CARRIED UNANIlvIOUSLY. 6-0. 9. Resolution No. 1896 A Resolution of the City Council of the City of Aubura, Washington, suthorizing the Mayor and City Clerk to execute an agreement for negodation services between the City of Auburn and Duane Wells, Incorporated, for the purpose of acquiring the necessary easements for the Harvey Road project. Motion by Councilmember Larson, second by Councilmember Burns to adopt Resolution No. 1896. MOTION CARRIED UNANIMOUSLY. 6-0. Councilmember Larson recognized Councilmember Joe Duffy from the City of Tukwila who is present in the sudience. Councilmember Duffy invited the Mayor and Council to an open house of the Third Battalion of the 161st unit of the Army National Guard which is located in Kent. He stated the Guazd is available to help in emergency situations and asked for the community's support.
