CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 730 p.m. in the City of Auburn Council Chambers. A. Flas Salute Boy Scout Pac 410,1ed by Cubmaster Eric Olson, posted the colors of the flag and led the pledge of allegiance. Participating scouts included: Ryan Stillings, Kyle Stillings, Claude Jacobson, and Joshua Greegor. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Brothers, Burns, Kurle, Larson, Roland, Walters and Whittall. Staff inembers in attendance included Police Chief Jake Evans, Fire Chief Bob Johnson, Personnel Director Gretel Sloan, Parks & Recreation Director Len Chapman, Finance Director Pat Dugan, Public Works Director Frank Currie, Planning Director Mary McCumber, City Attorney Marguerite Schellen[rager, City Clerk Robin Wohlhueter, and Deputy City Clerk Jan Hubbard. C. Announcemen[s and An�ointments Announcements a. Mayor Roegner presented DARE hats and mugs to the Councilmembers and thanked them for their support of and commitment to the DARE ' program. The DARE mementos heip publicize the DARE graduations taking place the next two weeks as follows: June 6, Terminal Park Elementary; June 8, Washington Elementary; lune 12, Evergreen Heights Elementary; June 13, Chinook ElemeMary; June 15, Alpac Elementary. All graduations are at 7 p.m. and citizens are invited to attend. The DARE program is an outstanding program introduced by City government to combat drugs among our youth. b. Mayor Roegner outlined steps being taken by the Fire Department as a result of the recent fires in Auburn. The Fire Department and Building Division will be identifying types of occupancies using welding and cutting processes. These businesses will receive additional training on safe welding and cutting practices. Fire and Police will jointly present information on how to reduce the risk of arson fires. The Fire Department will focus summer inspections on occupancies that are increasing their stock for summer, or remodeling to insure we are aware of changes in fuel loads and flame producing appliances. Finally, the Police and Fire Departments will expand their arson cross training program. Mayor Roegner commended the Fire and Public Wor1;s Departments for their outstanding work in fighting the recent fires. Anoointments Human Resources Board Council consideration of the appointment of Arlista Hoiman to the Human Resources Board filling Dave Patnode's unexpired term which will expire December 31, 1990. Motion by Councilmember Burns, second by Councilmember Walters to approve the appointment of Arlista Holman to the Human Resources Board. MOTION CARRIED UNANIMOUSLY. 7-0. BIA Steerins Committee Council to confirm the appointment of Wayne Heisserman, Michael Salazar, and Greg Pascua to the BIA Steering Committee for a term to expire on July I, 1992, and Drew Hardin for a term to expire on July I, 1990. Motion by Councilmember Burns, second by Councilmember Kurle to confirm the appointments of Wayne Heisserman, Michael Salazar, and Greg Pascua to the BIA Steering Committee for terms to expire July 1, 1992, and Drew Hardin for a term ro expire Juiy 1, 1990. COUNCIL COMMITTEE REPORTS A. Municioal Services Chairman Whittall reported the Municipal Services Committee met on May 25, 1989, and the minutes are a matter of public record. The next Municipal Services Committee meeting will be June 22, 1989, at 530 p.m. B. Plannin¢ & Communitv Develonment Chairman Burns reported the Planning and Community Development Committee met May 23, I989 and the minutes are a matter of public record. Public Works Chairman Kurle reported the Public Works Committee met prior to the Council meeting this evening at 5:30 p.m. The minutes of the May 15, 1989 meeting are of public record. The next meeting of the Public Works Committee is scheduled for June 19, at 530 p.m. D. Finance Chairman Walters stated the Finance Committee met prior to the Council meeting tonight. Apolication No. REZ0003-89 Council consideration on the request of Ronald Balmer to rezone from County Suburban to C-3 (Heavy Commercial) on property located at 3214 "A" Street S.E. Motion by Councilmember Burns, second by Councilmember Walters to call for a pnblic hearing on Application No. REZ0003-89 at the next regular Council meeting, June 19, 1989. MOTION CARRIED UNANIMOUSLY. 7-0 VII. ORDINANCES AND RESOLUTIONS A. Ordinances I. Ordinance No. 4336 An Ordinance of the City of Auburn, Washington, repealing Auburn City Code section 9.40.010 entitled "Offenses Designated" contained in Chapter 9.40 entided "Disorderly Conduct" and adding a new 9.40.010 clarifying and adding offenses constimting disorderly conduct. Motion by Councilmember Whittall, second by Councilmember Brothers ro introduce and adopt Ordinance No. 4336. MOT10N CARRIED. 6-I. Councilmember Burns voted no. 2. Ordinance No. 4337 An Ordinance of the City of Auburn, Washington, adding a new Chapter 9.11 to Auburn Ciry Code Title 9 entiNed "Public Peace, Morals and Welfare", to provide a new offense of disruption of government offices. Councilmember Burns voted no. 3. Ordinance No. 4338 An Ordinance of the City of Auburn, Washington, adding a new Chapter to Title 9 of the Auburn City Code, designated Chapter 9.45 entitled "Criminal Trespass". Motion by Councilmember Whittall, second by Councilmember Brothers to introduce and adopt Ordinance No. 4338. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Ordinance No. 4340 An Ordinance amending Chapter 9.18 of the Auburn City Code entitled Domestic Violence to amend the definition, issuance and notice sections of that ordinance. Motion by Councilmember Whittall, second by Counciimember Roland to introduce and adopt Ordinance No. 4340. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Ordinance No. 4351 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 16.06 of the Auburn City Code entiNed "Environmental Review Procedures", to modify the SEPA appeals process and ro delete environmental policies. Motion by Councilmember Burns, second by Councilmember Walters to invoduce and adopt Ordinance No. 4351. MOTION CARRIED UNANIMOUSLY. 7-0. 6. Ordinance No. 4352 An Ordinance of the City Council of the City of Auburn, Washington, approving the final plat of Dos Rio ro the City of Auburn, according to the plat on file with the Clerk of the City of Auburn. Motion by Councilmember Burns, second by Councilmember Walters to introduce and adopt Ordinance No. 4352. MOTION CARR[ED. 6-1. Councilmember Kurle voted no. Resolutions Resolution No. 1969 A Resolution of the City of Auburn, Washington, accep[ing a conveyance of park property known as Ta-Weel Memorial Park, by Statutory Warranty Deed. Resolution No. 1970 A Resolution of the City of Auburn, Washington, accepting a conveyance of park property known as Mill Pond Park, by Statutory Warranty Deed. Motion by Councilmember Burns, second by Councilmember Kurle to approve Resolution No. 1970. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 1972 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a South Valley Special Operations interlocal government agreement between the City of Auburn and Pierce County Fire Protection District No. 9. � Motion by Councilmember Whittall, second by Councilmember Brothers to approve Resolution No. 1972. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resoiution No. 1973 A Resolution of the City Council of the City of Auburn, Washington, amending the Comprehensive Plan of the City of Auburn to add environmental policies and amending the plan consistent with the policies. Motion by Councilmember Burns, second by Councilmember Walters to approve Resolution No. 1973. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resalution No. 1974 A Resolution of the City Council of the City of Auburn, Washingron, authorizing the Mayor and City Clerk to execute a contract for public defense between the City and Tucker & Stein, P.S. Motion by Councilmember Walters, second by Councilmember Whittall to approve Reso(ution No. 1974. MOTION CARRIED UNANIMOUSLY. 7-0. 6. Resolution No. 1975 Sanitary Sewer ]mprovement Non-Remonstrance Agreement between the City and Brian Van on property located within the City. Resolution No. 1976 Sanitary Sewer Improvement Non-Remonstrance Agreement between the City and Frank and Jean Miles on property located within the City of Auburn Motion by Councilmember Kurle, second by Councilmember Burns to approve ' Resolution No. 1976. MOTION CARRIED UNANIMOUSLY. 7-0. 8. Resolution No. 1977 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Payback Agreement between the City and Dale Platt Enterprises on property located within the City. Motion by Councilmember Burns, second by Councilmember Whittall to approve Resolution No. 1977. Councilmember Kurle stated he owned property in [he area and would abstain from voting on Resolution No. 1977. MOTION CARRIED. 6-0. Councilmember Kurle abstained. 9. Resolution No. 1978 A Resolution of the City Council of the City of Auburn, N�ashington, authorizing the Mayor and City Clerk to execute a Sanitary Sewer Improvement Non-Remonstrance Agreement between the City of Auburn and Rueben and Edna Frostad, and Eugene and Virginia Squire on property located with the City of Auburn. ' Motion by Councilmember Kurle, second by Councilmember Burns to approve Resolution No. 1978. MOi'ION CARRIED UNANIMOUSLY. 7-0. VIII. MAYOR'S REPORT Executive Session Mayor Roegner announced there would be an Executive Session of about ten minutes to update Councilmembers on labor negotiations. No action will be taken. IX.
