MEMORANDUM OF UNDERSTANDING
BETWEEN
CITY OF AUBURN/AIRPORT MANANGEMENT
AND
NORTHWEST SKYRAIDERS
FOR
THE USE OF SPECIFIED AREAS ON AIRPORT PROPERTY FOR FLYING MODEL
AIRCRAFT.EITHER FOR PRACTICE OR SPECIAL EVENTS
PURPOSE: The purpose of this Memorandum of Understanding ("MOU") is to allow
Northwest Skyraiders, a control-line model airplane club -AMA Charter 330 ("Skyraiders") the
non-exclusive use of designated areas within the City of Auburn's Auburn Municipal Airport
("City" or"Airport")property to set up and fly line controlled model aircraft for practice or
special events.
COMMENCEMENT/EXPIRATION DATE: This MOU is executed as of the date of the last
signature and is effective for 12 calendar months. This Agreement may be extended in writing
for one 12 month calendar period only. Skyraiders must submit a written request for an extension
not later than.September 1,2012.
TERMINATION: Either party, upon a ten(10) day written notice may terminate the agreement
in whole, at any time before the date of expiration of this MOU or its extension. The City may
suspend operations immediately in its"sole discretion if it determines that a safety hazard exists
because of Skyraiders' operations.
Once.the MOU is terminated all equipment belonging to Skyraiders shall be removed within ten
(10)days. Anything left beyond that ten day period all property and or equipment becomes the
property of Auburn Airport. Skyraiders shall restore all areas used to their original condition, less
normal wear and tear.
HOURS OF OPERATION: Skyraiders may use the designated areas Sunday through Saturday
for flight operations each week between the hours of 0800-1900 local time.
ORDINANCES AND RULES INCORPORATED/DISPUTE RESOLUTION: Skyraiders
agrees-that their use of the Airport is subject to the Auburn City Code Chapters 2.18, 2.33, and
12.56, as well as the Auburn Municipal Airport Minimum Operating Standards contained in the
most current version of Administrative Policy Number 100-81. Dispute resolution shall be in
accordance with those ordinances and rules.
RENT: Skyraiders shall pay the sum of One Hundred dollars ($100.00), plus Twelve dollars and
eighty-four cents ($12.84) as Leasehold Excise Tax monthly. Payment shall be made to the City
of Auburn at 400 23rd St NE, Auburn,WA 98002 and is due on the first day of the month. Any
rent not paid by the 15th day of the month shall incur a Ten dollar($10.00) late charge.
LIABILITIES: It is understood that neither party to this memorandum of understanding is the
agent of the other and neither is liable for the wrongful acts or negligence of the other. Each
party shall be responsible for its negligent acts of omissions and those of its officers, employees,
agents, students or club members howsoever caused, to the extent allowed by their respective
state and local and federal laws.
MODIFICATION: Any modifications to this MOU shall be made by mutual consent of the
parties,by written modification,signed and dated by the authorized officials, prior to any
changes being performed.
SERVICES THAT EACH PARTY SHALL CONTRIBUTE:
1. Airport:
• The Auburn Airport will provide an area to allow a maximum of two (2) sixty foot (60')
radius circles and vehicle parking for up to four vehicles on airport property.
• As available, airport staff will mark initial area with traffic cones the area to be used the
day before each event as calendared. Events or practice days not calendared will be
subject to availability by airport management the day of said event.
• The airport cannot guarantee the areas to be used will be free and clear of aircraft the day
of an event. Management will use best efforts to keep aircraft free of said areas or offer
substitute areas.
• Airport will not provide security or crowd control before, during or after any event or
practice.
• Storage facilities (either long or short term) shall not be provided to Skyraiders by the
airport.
• The airport will provide two (2) gate security cards to the principals of Skyraiders Flying
club which will be used to enter the south end gate of the airport.
• The airport will not be responsible for any damage to'models, equipment or Skyraiders
members while Skyraiders utilizes the airport property.
• The airport agrees to advertise Skyraiders' events with the local tenants and on the
airport's website. The events may also appear in City of Auburn literature and/or website.
Skyraiders may use publicly-accessible kiosks and bulletin boards to advertise, but may
not directly solicit other tenants.
• Notice to Airmen (NOTAMS) and local notices will be.administered by airport
management.
2. Skyraiders:
• Provide Airport Management a complete list of all Skyraider club members with phone
numbers and address information. Should any club member wish to drive on Airport
Property a driver's license and auto insurance copies shall be supplied as well as the
vehicle information. In addition to this list management will need a daily name list of all
participating flying members for each practice and event day. This list to be provided at
least 12-hours in advance or at minimum before any flying commences that day.
Skyraiders acknowledges that these lists are subject to the Public Records Act, RCW
Chapter 42.56, and may be released upon request.
• Skyraiders will provide dates and times for special event dates. Once submitted any
added dates or time changes will require a 72 hour written notice to management, if less
than 72 hours airport management reserves the right to refuse the use of the airport for
that day(s).
• Skyraiders must use the south gate as entry and exit for its club members, this gate shall
remain closed when not in use. When entering the airport through the gate Skyraider
members will use best efforts to prevent any unauthorized entry(s) and shall report
unauthorized entries to management immediately.
• Crowd control of any persons shall be maintained by Skyraider members. At any time
should safety become a concern for any person(s) viewing, walking, driving,or taxiing an
aircraft,all flying operations shall cease and desist immediately until that safety item can
be resolved.
• Skyraiders is allowed one locker (no larger than 4'x4'x6') placed at their own risk within
the area of the personnel man gate by the hotel secured to the chain link fence. This
locker shall have on the exterior a label of all contents. Airport management shall be
provided a key or the combination to the locker.
• The areas used shall be left clean and free from Foreign Objects and Debris (FOD) when
members depart.
• Skyraider Members will be responsible for erecting traffic cones that provide maximum
visibility for a safe and secure area while operating. If flying continues the following day
and traffic cones remain in place overnight than night illumination devices and reflectors
must be used. When any event or practice is completed all traffic cones provided by the
Airport will be collected and plaeed.in an appropriate area as agreed. Skyraider cones
shall also be collected and placed in the Skyraider locker.
• No permanent paint markings will be allowed without the prior written consent of
management.
• Only four(4) Skyraider vehicles will be allowed to remain on airport property at any one
time. Additional parking may be allowed at Auburn Flight Maintenance with their
permission.
• Spill kits and fire extinguishers shall be utilized and kept near any flammable or
hazardous material. Any spills shall be wiped up and cleaned immediately.
• Skyraiders will maintain liability insurance in the amount of one (1,000,000) million
dollars and provide current copies of that insurance to airport management
• At any time management may terminate the days flying activities should a safety concern
arise and not immediately be corrected or if the parameters/regulations of this agreement
and/or the Airport Rules and Regulations are not strictly followed.
