For and in consideration of the sum of TEN DOLLARS ($10.00) and other good
and valuable consideration, receipt of which is hereby acknowledged, and for benefits to be
derived by the Grantor herein, Grantor, Robert L. Stobie, Nancy Lynn Stobie, Denise
Trussler and the Douglas A. Trussler Marital Trust,hereby conveys and warrants to the
City of Auburn, Grantee herein, a municipal corporation of King County, Washington, its
successors and assigns, a perpetual Nonexclusive Easement under, over, through and
across the following described real property ("Easement Area") for the purpose of
installing, maintaining and operating an INTERTIE CONNECTION BETWEEN THE
CITY OF AUBURN AND THE CITY OF TACOMA WATER SYSTEMS, INCLUDING
A PRESSURE REDUCING VALVE STATION, WATER MAIN, METER,
MONITORING AND CONTROL EQUIPMENT AND APPURTENANCES THEREOF,
said Easement Area being a portion of the above-designated Tax Parcel ("Parent Parcel"),
and described as follows:
SEE EXHIBITS "A" AND "B", ATTACHED HERETO AND BY THIS
REFERENCE MADE A PART HEREOF.
Said Grantee shall have the right for immediate entry upon said Easement Area for
the purpose of emergency maintenance or repair of the above improvements.
Said Grantee shall have the the right, at times as may be necessary, for entry upon
said Easement Area for the purpose of maintenance, inspection, construction, repair or

reconstruction of the above improvements, provided said Grantee shall not in any way
block, restrict or impede access and egress to the gate located on the Parent Parcel without
providing said Grantor or its agent a minimum of 2 (two) business days written or verbal
notice, except in the case of emergency maintenance or repair, in which case no notice is
required.
Said Grantor shall not in any way restrict or impede access and egress to, or
impede full use of the real property within the above-described Easement Area by said
Grantee for the above-described purposes, except as would be expected for normal use of
the parking lot, and as described below. Said Grantor shall not erect any new building or
structure of any kind within said Easement Area which would impact access or functioning
of the above improvements by the City or its agents. Said Grantor may relocate and
construct fencing within said Easement Area provided the fence does not preclude access
to or use of the Easement Area by the City or its agents.
No excavation or grading shall be made within said Easement Area, without said
Grantor providing written notice to said Grantee a minimum of 7 (seven) days prior to
excavation or grading work. Unless said Grantor obtains written consent from the City to
lower the surface level of the ground within said Easement Area, the entire surface of the
ground within the Easement Area shall be maintained at or above the elevation as exists
after construction of the above improvements by the City or its agents.
Said Grantor grants to the City the right of ingress and egress from B Street NW
to the Easement Area over and across the northerly paved driveway within the Parent
Parcel. In the case of any damage or disruption of the Parent Parcel, the City shall return
the property to a comparable or better condition as existed immediately before entry and/or
work was made thereon by the City or its agents.
This Easement shall be a covenant running with the Parent Parcel and burden said
real estate, and shall be binding on the successors, heirs and assigns of all parties hereto.
