BURDENED PROPERTY LEGAL DECRIPTION (whole parcel or portion affected): Lot 7, Lot 8 and Tract V of final plat of Monterey Park recorded in the offices of the King County Recorder under No. 20100826001442., plus access to said spaces, located at lot 7 (937 42nd Court NE, parcel #030140-0070) and Lot 8 (927 42nd Court NE, parcel #030140-0080) and Tract V- (030140-2540). 31 1 ) 0-5 All situated in the City of Auburn, County of King, State of Washington. BENEFITED PARTY The Party benefited by this Easement in Gross shall be the City of Auburn, WA. COVENANTS RUNNING WITH THE LAND/ASSIGNMENT. The parties hereto acknowledge and agree that the easements and other rights conferred hereby are intended to, and do, constitute covenants that run with the land of the Burdened Property and shall inure to the benefit of and be binding upon the parties and their respective grantees, heirs, successors and assigns. It is further understood and this easement is granted on the condition that, if the Grantee determined that the parking spaces are no longer required by applicable City codes, standards or regulations, in connection with the development or use of the property at 919 42nd Court NE and 908 42nd Court NE , the Grantee shall re-convey the easement to the Grantor or successor, and the easement shall be of no further effect.
