HomeMy WebLinkAbout03-03-2003City of Auburn Law Enforcement Officers and Firefighters Disability Board Monday, March 3, 2003 - 10:00 AM - Council Conference Room MINUTES CALL TO ORDER Chair Jim Kelly called the March 3, 2003, LEOFF Board meeting to order at 10:00 AM in the Council Conference Room located on the main floor of Auburn City Hall, 25 West Main Street, Auburn, WA, 98001. Chair Kelly and the following Board members were present: Chair Pro Tern Bud Larson, Member Stacey Brothers, Member Gene Cerino, and Member Russ Vandver. Associate City Attorney Karen Gulliver and Board Secretary Danielle Daskam were also present. II. APPROVAL OF MINUTES Ao Minutes of the February 3, 2002 LEOFF Board Meetinq Motion by Chair Pro Tem Larson, second by Member Cerino to approve the February 3, 2003 minutes as distributed. MOTION CARRIED UNANIMOUSLY. 5-0. III. UNFINISHED BUSINESS A. Pending Disability Leave/Retirement Applications Marion F. Dukes Effective Date of Disability: September 21, 2002 Last Day of Service: September 20, 2002 On October 7, 2002, the LEOFF Board approved disability leave for Marion Dukes effective September 21, 2002. In addition, the Board waived the requirement for monthly physician reports during Mr. Dukes' disability leave. On January 6, 2003, the Board referred Mr. Dukes to the Board physician, OMAC, for examination. Dr. Gregory Chan conducted the examination on January 29, 2003. The physician's report is enclosed. Mr. Dukes disability leave will conclude March 20, 2002. Board members reviewed the OMAC report. Motion by Member Cerino, second by Chair Pro Tem Larson to grant disability leave effective March 21, 2003. Motion by Member Cerino, second by Member Vandver to find that, according to the medical information received, the disability was incurred in the line of duty. MOTION CARRIED UNANIMOUSLY. 5-0. Motion by Member Cerino, second by Chair Pro Tem Larson to find that there is no evidence that the disability was incurred in any other employment. MOTION CARRIED UNANIMOUSLY. 5-0. Motion by Member Cerino, second by Chair Pro Tem Larson to find that there is no possibility of return to duty. MOTION CARRIED UNANIMOUSLY. 5-0. Motion by Chair Pro Tem Larson, second by Member Brothers to find that the Board decision is based on the attending physician's report and confirmed by the Board physician's report. MOTION CARRIED UNANIMOUSLY. 5-0. Stan Laatsch Effective Date of Disability: February 1, 2003 Last Day of Service: January 31, 2003 On February 3, 2003, the Board approved disability leave for Stan Laatsch effective February 1, 2003, with last day of service on January 31, 2003. Mr. Laatsch's monthly physician's report dated February 25, 2003 from Dr. Mark Kim was received. Motion by Chair Pro Tem Larson, second by Member Vandver to continue Mr. Laatsch's disability leave for an additional month or until cessation of disability, whichever occurs first. MOTION CARRIED UNANIMOUSLY. 5-0. Gordon Stephenson Claim for Payment in the amount of $4.20 for medical services received. (No Medicare or Regence explanation of benefits statements received.) On December 2, 2002, January 6 and February 3, 2003, Mr. Stephenson's claim was tabled pending receipt of the Medicare and Regence explanation of benefits statements. No new information was received. Motion by Chair Pro Tem Larson, second by Member Cerino to reject Mr. Stephenson's claim due to lack of requested information. MOTION CARRIED UNANIMOUSLY. 5-0. 2. Raymond Sherman Request for reimbursement of eye exam deductible, lenses and frames expenses dated September 17, 2002 received January 10, 2003: Eye Exam Deductible Progressive Lenses (less discount) Frames (plus tax & less discount) $ 5.00 $277.4O $ 98.19 LEOFF Board Policy 9.02(A)(2) provides for reimbursement for lenses and frames as follows: Progressive Lenses Frames $100.00 $ 90.00 On February 3, 2003, the Board tabled Mr. Sherman's claim pending receipt of the Explanation of Benefits Statement for the examination. Mr. Sherman submitted the Regence Explanation of Benefits Statement on February 24, 2003. LEOFF Board Minutes March 3, 2003 Page 3 City of Auburn Law Enforcement Officers and Firefighters Disability Board Monday, March 3, 2003 - 10:00 AM- Council Conference Room Motion by Member Cerino, second by Member Vandver to approve payment in the amount of $190.00, which is the maximum allowable under LEOFF Board policy. MOTION CARRIED UNANIMOUSLY. 5-0. John Baker Request for pre-approval of hearing aids purchased from other than the Board designated hearing aid provider in the amount of $5,900.00 and batteries in the amount of $41.50. On February 3, 2003, the Board tabled Mr. Baker's claim pending receipt of a cost analysis by the Board designated hearing aid provider, Costco Hearing Aid Center. On February 11, 2003, Shirley Haarhues of Costco Hearing Aid Center advised that equivalent hearing aids from Costco are priced at $3,798.00 for two. Motion by Member Brothers, second by Member Cerino to authorize up to $3,798.00 for two MIC 100% digital hearing aids. MOTION CARRIED UNANIMOUSLY. 5-0. IV. NEW BUSINESS Disability Leave/Retirement Applications No new application for disability leave/retirement was received. B. Appeals No appeal was filed. C. Medical/HearinqNision Claims 1. Robert Almy Claim received January 30, 2003 consisting of Regence Explanation of Benefits statement for medical services received on March 28, 2002 and processed by insurance on June 12, 2002 in the amount of $50.00. Motion by Member Cerino, second by Member Brothers to authorize payment in the amount of $50.00. MOTION CARRIED UNANIMOUSLY. 5-0. Dunbar Claim receiVed February 5, 2003 consisting of Regence Explanation of Benefits statement for medical services received on November 8, 2002 and processed by insurance on December 4, 2002 in the amount of $56.00. Motion by Member Vandver, second by Chair Pro Tem Larson to approve payment in the amount of $50.00. MOTION CARRIED UNANIMOUSLY. 5-0. Stan Laatsch Claim received February 3, 2003 for reimbursement of dental expenses incurred December 18, 2002 and processed by insurance on January 23, 2003 in the amount $160.00. Motion by Member Brothers, second by Member Vandver to approve payment in the amount of $160.00 noting the injury was a result of an accident and citing LEOFF Board Policy 8.03. MOTION CARRIED UNANIMOUSLY. 5-0. Correspondence The following correspondence was acknowledged. Correspondence dated February 18, 2003 from State of Washington Department of Retirement Systems regarding retirement system proposed rules. Washington State LEOFF Education Association materials announcing the 2003 Conference scheduled for May 13 - 15, 2003 in Chelan.
