Background
On Aprii 18, 2011,the Auburn C.ity Council passed OrdinanceNo. 6360 that established one (1)
yeaY:interim zoning controls pertaining to the allowance, dimensions,and location of real estate
§igns not cuRenUy permitted by ezisting sign regulations in the public right-of-way oron private
property relate to the sale, lease, oF rent of residential and non-�esidential development
properties. Ordinance No. 6360 was developed in response to inuRipie requests from
developers and owners of residential and non-residential real property in the City seeking
authoriiation for the placemen4 of real estate signs on public and private properties in locations,
numbers.and of a;size than is_currently aliowable under existing City regulations. The
O�dinance's key purpose was to assist in local economic development associated with the sale
and development of�esidential and non-residential property'in the City.
The City Counal's passage of Ordinance No. 6360 was intended to provide the City Council,
Planning Commission', interested citizens, and Citystaff a reasonable time opportunity to fully
consider all the options and akemative standards for the regulation of different sizes and types
of residential and non-residential real estate signs and provide procedures for the permitting of
these signs. Further, it will allowthe City to fully investigate, understand and appropriately
address the potential negative impacts of these signs as may be appropriate.
Discussion
The interim zoning controis for off premise real estate signs ha4e been in effect for aver eight
months now and to date several homebuilders have ereoted signs based off the new controls.
The purpose of this memorandum is to review the interimzoning controls, discuss the reasons
behind them, learn how they have been working, and whether the interim controls should
continue as is or be modified. To facilitate a discussion of off-premise real estate signs and the
inte�im controls, staff has included with 4his memorandum Ordinance No. 6360. Changes that
were madelo the sign code(on an interim basis) can be found'on page 10 (of 28) of the
ordinance.

Staff has also included the application form given to builders or developers when off-premise
real estate signsare desired as well as a notice of decision for a series of signs proposed by a
homebuilder in June of 201 L The application form and decision document should help 4he
Planning Commission understand the process through which builders and developers undergo,
the submittal requirements for a complete application, as well as the analysis that goes into
making a decision on a set of real estate signs.
The reason behind the interim zoning controls is to assist wRhlhe struggling real estate market
where any additional marketing opportunities become essential to finding a buyer for a new
home or buyer or lessee for non-residential properties. Off premise directional signs not only
direct potential buyers to the property for sale or rent, but they also gamer"drive by 6usiness!'
Therefore it was requested that Auburn consider the real estate business and ifs ability to
generate real estate excise tax; impact fees, sales tax, and property taxes for the city as well as
occupyvacant spaces, and provide jobs.
The interim zoning controls have largely controlled the height and area of off-premise real estate
signs where prior to th'e interim controls builderswould often add signs of varying heights and
areas some farexceeding the height and area maximums stated in the original zoning code.
There isn't, however, a limitation to the number of signs that can be permitted. Sfaff has
concerns that sign clutter could manifest over time.
The builders and developers also appreciate the interim sign controls. Now that they are in
place builders.have predictability in what they can and cannot do. They hade also indicated to
staff that the regulations give them the locations, sign areas, and height they need to .
successfully market their homes, the subdivisions they are located wRhin, as well as non-
residential propeRies for sale or lease. As far as the general public and their opinions off off-
premise real estate signs, planning staff has not received any formal complaints on 4he larger off
premise signs but rather portable signs (A-frame signs)which are scattered throughout the:city.
The Community Manager for the Lakeland HiIIs Homeowners Associa;ion,however, did,express
concem that Lake Tapps Parkwayis receiving its more than fair share of large signs advertising
new communities and homes there.

Lastly staff researched the sign codes of nearby ju�isdictions to leam how they are currently
handling off-premise real estate signs. Unfortunately staff found little in terms of specific
regulations. Most ckies,only fiad rules related to on-premise signs which typically consisted of
one sign per entrance, no more than 32 square feet in size, and no greater than eight feet in
height(source: Puyallup Municipal Code—See Enclosure 3) or they oniy allowed off-premise
signs for newly platted subdivisions but were not specific on how large or tall the signs could be
(source: Tacoma Municipal Code—See Enclosure 3). Staff did identify a new"real estate"
wayfinding signage progrem that was started by the City of Renton. Through a partnership with
the Master Builder Association of King and Snohomish Counties, a series of kiosks (virith
directional panels to residentiaFdevelopments)were installed along high tra4eiled corridors
throughout the city. The goal of the program was to reduce sign clutter and help stimulate
additional home-buying and development activity. See enclosure 4 for additional information on
Renton's real estate sign kiosk program.
In anticipation:ofthe Planning Commission conducting a public hearing on the interim zoning
controls, staff would like to take this opportunity to discuss the controls using the questions
below as a guide.

reduoed revenue to the city in terms of real estate eiccise taz;
development review fees, impacf fees, system development
charges, sales taxes anil property taxes, thereby having a
significant and real impacf on ihe Gity's:general fund and reduang
totaf revenue available to provide pubik senrioes
C. That because of the need to balance tl�e economic depetopmerrt
inber�ts of the Cily and tfie public heattli, safeiy and welfars af ifs
citmens irom any and all potiential impacts of residerdial teal estate
signs, speaal care and atte[fion needs to be employ�ed in .

Background:
Qrdinance No. 6360 was enacted by City Council and went imo effect on Apri126,2011. It ,
establishes interim reguls4fons goveming the estabfishment of temporary off-premise real
estete signs.
Ordinance No.6360 is effective through Aprlf 26, 2012.During this period,temporary off=
premise real estate signs are permitted pursuant to the prwisions of Sectiorr 18.56.025.F of
the Auburn City Code. Seotion 18.56.025.F of the'Aubum City Gode reads as follows: �
F. AddiUOnal signs: the planning and development drector may,grant written
suthorization to allow temporary off premise§igns in addition to tho§e pertnttted above.
The size of these signs shall be determined by the planning and developmeM direcfor
based on.factors incfuding but not limited to surrounding lend uses, sight distance end
tratfic safety, but in no instence shall the height of the sign ezoeed eight(8)feet and
the total sign face area exceed sixty-four(84)square feet NoUce of adjaoent proparty
owners"shall not be required. Such additional signs may be used to advertise open
houses,to advertise properties for sale lease or rent to provfde directions to new
developments or similar purposes. Such slgns may be ptaced within the public right-of-
wey provided they do not interfere with traiflc safety but they may not be attached to
utilfty poles or traHlc safery devices.For the placement of signs within the public right-
oi-way,ihe planning and development director shail consult with the City Engineer,

On May 6;201 i,the Planning and Development Department routed the submittal packet to
asalgned designees of the City Engineer; Police Qhief, and Risk Manager for review and I
comment: .
Findings: ,
1. Lake Tapps Parkway i§a primary vehicular entryway into the general Lakeland Hills
community. It is anticipated that ihis highly traveled thoroughfare will be a desirabte
location to place off-premise real'estate. I
2. While the City of Aubum is making public rigM-otway available for the marketing:efforts.
of private deJelopment companies, it,is appropr}ate to consider the fact that muitiple
, wmpanies are likely to seek approval to place signs alongthis stretch of highly traveled
thoroughfare. The Citymust belance the pubiic interest of keeping the rights-of,way
safe and attractive, and the private interest of using.the right-of-way to market p�ivately
owned resideritial developments. It is therefo�e appropriate to establish Iimits on the
total number of signs that areallowedby any one cortipany.
3. Jtis also appropriate for the City to consider the proximlty of the proposed sign locations
to tha development that is being edvertised. lt may be appropriate to allow a higher
concentration of terriporary otf-premise signs within the right-of-way that canstitutes the
fmmediate approach to the subdivlsion and fewer signs for the same development on
road ways that are located further away.
4. The submittal packet was rebeiVed on May 5, 2011. The request was assigned a
trackirig number of SGN11-0025.

proposed to be no more than 10 feet in height: Additionally, sign 6 includes a crown
feature that extends approximafely 24"by 15"on each entl of the upper portion of
this sign.
b. This sign is proposed to be located within proximity of the intersection of Lake Tapps
Parkway and Sumner Tapps Hlghway.
8. Ordinance No. 6360 estatilishes an overall size limit of 64 sguare feet any individual sign
and an 8 foot hefght limit. Sign size is a measurement of the total sign face. HeigM is to
be measured from existing grade.

Concluslons:
1. City of Aubum Risk Management has evaluated the submitted insurance documerrtaiion
and determined thet i4 is satis}actory and compliant with Giry requirements.
2. Signs 1 thru 5 comply wtth the size and heigM standards establisheiJ In Ordinance No. •
6360.
3. Sign 6 complieswith the size limits but falis to comply with tfie 8 foot height lim�. In
order for this sign to be permitted it nseds 4obe reduced in height from 10 feet to no
more than 8 feet.
4. The Ciry Engineer has determined that there is a Vaffic concem pertaining to beations 1
through 5 on Lake Tapps Parkway eastbound. This is an isolafed stre4ch of a limited
access road wRh speeds up to 50 mph, located uphill on a curve with no place to stop a
vehicle safely. In addition,the pfacement of the signs in the right of way couid impaci
utilities or irrigaiion. h is appropriate to establish conditions that address 4hese
concerns. .
5. Tfie location of sign 6 as proposed is acceptable. �
6. Upon reView of the application submi#tal, and subject to the condiUons of approval
contained herefn,the Planning and'D_eyelopment Director has determined that the
subJeot proposat is consistent wfth, end coriforms to,the provisions of Section
18.56.025.F of the Aubum City Code as authorized by Ordirrance No.6360.
Decision:
The Planning and Development Director hereby grants CONDITIONAL APPROVAL to

1: The signs authorized under this conditional apprwal shall be valid and authorized for

2. Following the expiration of the authorization and validity period specified in Condition of

authorized herein shall be physicelly removed from their I�ations within five (5)calendar
days of the date of expiraUon, and any physical disturbance to public right-of-way or
private properly including but not iimited sign post holes and vegetative damage shall be
remediad to the seme or similar condition that axisted prior to 4he instellation of the
signs.
3. Signs 1-5 as specified in the submitted application that exclusively advertise the
Edgeview resideMiaf development and/orEdgeview Homes are allowed along,the south
side of Lake Tapps Parkway and shall be piaced only in the focations specifietl�in the
submitted applioatlon package, untess otherwise authorized by the Pianning and
Development Director.
4. Signs 1-5 shall be installed at the heights and maximumsign face areas specified in tha
submitted applicaUon(6 feei in height as measured from existlng grade with a billboard
face of 4 feet in height and 6 feet in width). No change or deviation in the height or

10. In order to ensure that City faoilities in the right of way are protected the applicant shall

11. Prior to sign installation the applicant shall contact Steve Bowen at 253-28&3145 in
order to develop a traffic control plan. The content of this plan will vary depending on
-- the following factors:
• Whether temporary work zones will be located off the road or on the road.
• Whether lane ciosures are necessary or not. .
• Whether work wili oxur during peak traffic perfods or off-peak periods.
12.The epplicent prior to commencement of sign instailatfon and/orremoval in accordance
with the approved traffic control plan shall call for an inspection by City construction
inspection to ensure that sign instaliation and removal is done in accordanoe with the
approved traffic control plan.The applicant shall call the inspection line at 253-931-3020
and choose option 3 and IeaVe a message requesting an inspection. The inspection
request must be submitted by 3:30 pm, one business day prior to commencement of
work. W hen leaving a message on the inspectioniine please.indicate the following:
• Sign reference number(SGNi i-0025)
• Gensral location of work. Because there is not a specific address, please
indicate the�ame of the street upon which work wiil be occurring and any
nearby cross streets.

The following regulations shall apply to all signs irrtended or permitted to be displayed far a limited time
only:
(3)Real Estate Signs.
(a) Real estate signs shall beperrnitted in all zones;provided,that all signs shall be located upon
the property to which they apply, except as provided for in subsections(3)(d)and (7)of this
seGion.
(b) Such signs shall confortn with the follawing maximum size requirements:four square feet in
area for the first 10,000 spuare feet in lot area, plus foursquare feet for each add'Rional'10,000
square feet of lot area, not to exceed 32 square feet.
(c) Real estate signs shall be remeved upon closing of the sale..
(d)In addition, real estate sign§advertising the sale of lots located within a subdivision shall be
permitted; proyided,that there shall be;no rriore than one sign per eritrance, and each sign shell
be no greater than 32 square feet in area, no greater than eight feef in height,.and ereoted no
langer than a period of one year. Existing off-premises real eState signs shalLbe allowed to

2.Real Estate Signs:
iv.Real Estate Sign Kiosks..
(a) PerinifReguirements:Sign and Ezcess RigM-of-Way Use Permits are required for
insfallation of each kiosk. Individual real estate sign kiosk direcfional panels and panel
changes do not require a permit:Fees for each kiosk shailbe one hundred dollars($700.00).
(b)Maximum Display Period: Pertnits for real estate sign kiosks shall be issued Por a limited
period of time in twelve(12)month incremeMS.This period eommences on November 8,2009,
and will sunset on Novemtier 8,2012, unless extended by City Couneil aetion. Permits shall
not be issued beyond November 8,2012, unless the mazimum display perioil is extended by
City Council adion.
(c)Allowed Use: Real estate sign kiosk directional panels on a Cityapproved kiosk structure
may be autharized for the puryose of providing directional information to residential
developments with units for sele,Jease;.or exchange (InGuding assisteii living developments)
located oniy within the corporate Iimits of the City af Renton.
(d)Allowable Sign Type: �osks shall be of a unifortn style throughout the City, shall be
freestanding and nonilluminated,and shall contain a maximum of ten(10)real estate sign
kiosk direcBonalpanels. Indiyidual real estate sign kiosk sign direetional panels shall wntain
anly the name of the subdivision or residential development,or deveioper, or development
logo,and e logo(s) regarding en award, special certfiption,and a directional arrow.Two(2)of
these real estate sign kiosk directional panels may identify community/pubGc facilities(City �
Hall, library, parks, distriCS,historie sites,ete.), at the diseretion of the City.One additional
panel at Cie Wp_of the real estate sign kiosk shall identiry the City_of Renton.
(e)Perrnitfed Size: Real estate sign kiosk directional panels shall be five(5)square feet in
total area and shall measure a maximum five feet(5')horizontal length by one faot(1')vertical
height
(�Permitted LxaUons: Sign panels shall be located on designated kiosk struetures wkhin
the public rigM-of-way. Ii availa6le kiosk structures will not permit adeguate directianal �
infortnafion, kiosk struetures may be approved on private property with the permission of the
property owner granted through an easement.A kiosk loeation:plan shall be prepared showing
tfie sde of eaeh kiosk anC shall besubmitted to the Planning Direetor for re4iew and decision
wiffi the sign permR applications.
(g)Maximum NumberPer Ir�tersection:A maximum of two (2)real estate sign kiosks shall
be allowed atany one iMersectfon and onty one sign panel per developmeM shall be allowed
on each sign face.
(h)Maximum Height The kiosk.siggstructure shall not exeeed ten feet(10')from finished
grade to the fop of the title panel which identifies the City of ReMOn.
(i) Design Standards:Colors,for�,.ete.,shall cor�form to design standards approved by the
